Description
Intent to Sole Source NOTICE OF INTENT TO AWARD A SOLE-SOURCE CONTRACT The US Department of Commerce (DOC), National Oceanic and Atmospheric Administration (NOAA), Eastern Region Acquisition Division, Simplified Acquisition Branch intends to negotiate on a sole source basis with Aquatrak Corporation, 1100 E. 25th Street Sanford, FL 32771, using the procedures in FAR Part 13, to provide Aquatrak transducers, controllers, cables, temperature probes, and thermistors. The statutory authority for other than full and open competition is FAR 13.106-1(b), only one responsible source. The Aquatrak acoustic water level measurement system is the standard water level monitoring system used at National Ocean Service (NOS), Center For Operational Oceanographic Products and Services, (CO-OPS) environmental monitoring stations on the Atlantic coast, Pacific coast, the Gulf of Mexico, the Caribbean, and throughout the Pacific. This purchase is for equipment to repair and maintain the continued operation of water level stations in the National Water Level Operating Network (NWLON). Under the current CO-OPS operating system, any environmental monitoring equipment that has not previously been approved must be subjected to a series of tests to ensure the quality of the data and the durability of the equipment for the intended use. These tests usually include bench testing using controlled conditions and physical measurement, controlled environmental testing to check reliability under different conditions, and long term comparison testing with accepted equipment at multiple real world locations. The CO-OPS environmental monitoring systems are designed to operate with the components in this purchase. Implementing different components will result in compatibility issues. Currently CO-OPS field personal and contractors are trained in the use and maintenance of the equipment in this purchase. CO-OPS also has the ability and equipment to test and troubleshoot the equipment in this purchase. Aquatrak is the manufacturer and sole distributor of the replacement parts for the Aquatrak acoustic water level measurement system. Aquatrak has developed and produced these components and they are proprietary to Aquatrak. There is currently no other source capable of meeting this requirement. The North American Industry Classification Code (NAICS) for this acquisition is 334513 with a business size standard of 750 employees. This is not a solicitation for competitive quotes. However, if any other interested party believes that it can meet the requirements, it may submit a statement of capabilities, which if timely received, will be considered by NOAA. A determination by the Government not to compete this proposed requirement based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. Evidence must be provided of ability to provide the required services. The capability statement and any other information furnished must be in writing and must contain material in sufficient detail to allow NOAA to determine if the party can meet all of the requirements.
