Box 1600, Huntsville, AL 35807-4301 CONTRACT INFORMATION 1. The objective of this performance based Single Award Task Order Contract (SATOC) is for the Contractor to perform Military Munitions Response Program (MMRP) services involving conventional munitions and Other Munitions Related Services (OMRS) including range maintenance and support activities utilizing robotic technology and/or conventional manned technologies as necessary to permit lands to be safely and efficiently used for their intended purpose or to facilitate construction efforts. This work also may involve the removal/ disposal of hazardous, toxic, and radioactive waste (HTRW). 2. Work under this contract may occur at sites located in the lands of the Contiguous United States and possible sites in Alaska, Hawaii, and US Territories. The Contracting Officer shall make a scope determination for locations that may fall outside the United States and its territories at the task order level. Individual task orders to be issued under this contract are for services as defined by FAR 37.101 and are subject to the Service Contract Act (See FAR 52.222-41). 3. In accordance with (IAW) FAR Part 15, the Government is awarding an Indefinite Delivery Indefinite Quantity (IDIQ) - Single Award Task Order Contract (SATOC) with Firm Fixed Price (FFP) and Cost Plus Fixed Fee (CPFF) provisions. The estimated maximum dollar value of this effort is $40 million. This requirement will be 100% small business set-aside. The minimum guaranteed order shall be $2,500 for the base period only. The specific task order contract types will be determined IAW FAR Subpart 16.1. The fixed fee for CPFF task orders will be established at the task order level. 4. The ordering period shall commence upon the date of award and may continue for a period of performance of one (1) 12-month base period and three (3) 12-month option periods, for a total of 48 months if all options are exercised. The contract will include the option to extend services IAW FAR 52.217-8, Option to Extend Services. Labor rates may be escalated annually at the beginning of each option period (See FAR 52.222-43 (b) for limitations) as provided in the Schedule; however, the labor rates in effect at the time an effort is awarded will remain in effect through completion of the awarded effort, unless modified due to an increase in the Department of Labor wage rates in accordance with FAR 52.222-43, FAR 52.222-44, and Chapter 7 of Engineer Pamphlet 1180-1-1. 5. Evaluation of Options: IAW FAR Subpart 17.1, the Contracting Officer has made the required determination that the inclusion of options is in the Government's interest; and, that it is anticipated that the Government may exercise the option at time of award IAW FAR 52.217-9. IAW FAR 17.203(b), the Contracting Officer shall evaluate the price of the options as part of the source selection. If services are required past the period of performance and the option IAW 52.217-8 is exercised the current binding rate for the period in which the option is being exercised shall be applicable, as these rates will have been evaluated at time of source selection and prior to contract award - escalation or negotiation of rates are not authorized. If options are exercised at the task order level at any time, evaluation of the maximum binding rates and pricing will be per the Task Order PWS. 6. The negotiated FFP hourly labor rates contained in Section J shall be binding maximum rates for the FFP effort; and, the negotiated Cost hourly labor rates contained in Section J shall be binding maximum rates for the Cost effort. If a cost reimbursable CLIN is used at the task order level, the Government will conduct an analysis of the Contractor's proposed cost elements to evaluate fairness, reasonableness and cost realism. 7. When the Request for Proposal (RFP) for task order requirements are issued, relevant and competent data supporting proposed labor rates, indirect rates, labor categories, labor hours, materials, equipment, and travel may be required to be provided by the Contractor to allow an examination of the proposed cost elements and/or prices as required by each task order. 8. The Government has the unilateral right to move unused capacity between the Contract Line Item Numbers (CLINs) to include subsequent option year CLINs, as the need develops during contract performance. 9. Profit will be negotiated, as needed, for each task order. Profit and Fee will be determined and/or evaluated in accordance with Defense Federal Acquisition Regulation Supplement (DFARS) 215.404-4. The only authorized ordering office is the U.S. Army Engineering and Support Center, Huntsville (CEHNC), unless otherwise designated as a result of a task order transfer to another USACE office for contract administration. 10. Upon request of the Contracting Officer, the contractor shall provide the results/products of all tasks listed in Section C, 3.0 Specific Services. 11.
