Description
The purpose of this modification/amendment to Solicitation Number: 36C25718Q9659 is to provide answers to questions submitted by potential offerors. Question: Building 46 Is there roof access?                       Answer: Yes, there is a hatch to access the roof. Question:   Building 29 Do the hallway windows on 2nd level open or is there exterior access via roof?   Answer: The windows open and spin with keys. Question: Building 29 Is the metal roof surface able to support cleaners?   Answer: No, the metal surface is a walkway cover, not structurally supported. Question:  General Mineral buildup.                   Is the contractor required to remove mineral buildup on windows?                   Answer: The contractor is required to wash the windows. Question:   Smoke Shelters please clarify if the glass smoke shelters that are not on the building listing require contracted cleaning. Answer: No Question: After a review of the subject solicitation, we discovered your requirement clause under 52.219-14, for Limitations on Subcontracting. Specifically, what is your required limitation % OR If there are no limits for  this solicitation, please so state. Answer: The solicitation states the following: LIMITATIONS ON SUBCONTRACTING-- MONITORING AND COMPLIANCE (JUN 2011) This solicitation includes FAR 52.219-14, Limitations on Subcontracting, and VAAR 852.219-10, VA Notice of Total Service-Disabled Veteran-Owned Small Business Set- Aside.   Accordingly, any contract resulting from this solicitation will include this clause. The contractor is advised in performing contract administration functions, the CO may use the services of a support contractor(s) retained by VA to assist in assessing the contractor's compliance with the limitations on subcontracting or percentage of work performance requirements specified in the clause. To that end, the support contractor(s) may require access to contractor's offices where the contractor's business records or other proprietary data are retained and to review such business records regarding the contractor's compliance with this requirement. All support contractors conducting this review on behalf of VA will be required to sign an Information Protection and Non-Disclosure and Disclosure of Conflicts of Interest Agreement to ensure the contractor's business records or other proprietary data reviewed or obtained in the course of assisting the CO in assessing the contractor for compliance are protected to ensure information or data is not improperly disclosed or other impropriety occurs. Furthermore, if VA determines any services the support contractor(s) will perform in assessing compliance are advisory and assistance services as defined in FAR 2.101, Definitions, the support contractor(s) must also enter into an agreement with the contractor to protect proprietary information as required by FAR 9.505-4, obtaining access to proprietary information, paragraph (b). The contractor is required to cooperate fully and make available any records as may be required to enable the CO to assess the contractor's compliance with the limitations on subcontracting or percentage of work performance requirement. So yes, the limitations for subcontracting are applicable to the solicitation and the contract that will be awarded based off of the solicitation. In order to be considered when submitting a quote/proposal for this requirement which falls under the Service Disabled Veteran-owned Small Business Concern Program (SDVOSBC), the following criteria must be met: The Service Disabled Veteran (SDV) must have a service-connected disability as determined by the VA or Department of Defense (DoD) The SDVOSBC must be small under the North American Industry Classification System (NAICS) code assigned to the procurement One or more Service Disabled Veterans must unconditionally own 51% of the business, control its management including long-term decision making and daily operations, AND hold the highest officer position Ownership by one or more service disabled veterans must be direct ownership. A concern owned principally by another business entity that is in turn owned and controlled by one or more service-disabled veterans does not meet this requirement. https://www.va.gov/osdbu/docs/38CFR74.pdf
