Description
The 25th Air Force / AFCO, Joint Base San Antonio (Lackland) Texas, Contracting Office, AMIC DET 2 / PK (JBSA) intends to solicit and negotiate with one source, Lockheed Martin Aeronautics (LMA). The statutory authority for this acquisition is 10 U.S.C 2304(c)(1) as implemented by FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. In accordance with FAR 6.302-1 (b)(1)(ii), only one source is available for this acquisition for support of non-personal services to demonstrate a set of technologies developed by the Air Force Research Lab (AFRL) being placed in a superpod. Support from the U-2 aircraft contractor, Lockheed Martin Aeronautical (LMA) is required to ensure the reconfigured superpod still meets air worthiness certification requirements for the U-2. Services will be contracted as a sole source contract by the Contracting Officer. The engineering work and testing will be performed at Palmdale, CA. The prime contractor for the U-2 is LMA and they will perform the engineering, safety analyses and required testing for the IRASCIPLE pod. Only LMA can provide the required services involving the U-2 aircraft as they own the proprietary data rights to the blue prints and technical data for the aircraft. Furthermore, they are the only source able to provide the air worthiness reports required. The applicable North American Industry Classification System Code (NAICS) is 541330 - with a size standard in dollars of $15M. No solicitation document exists at this time. The clause at Air Force Federal Acquisition Regulation (AFFARS) 5352.201-9101, Ombudsman, is applicable to this request and states as follows: (a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the interested party to another official who can resolve the concern. (b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMB Circular A-76 competition performance decisions). (c) If resolution cannot be made by the contracting officer, the interested party may contact the ombudsman, Deputy Director of Contracting, AFICA/KC (OL-ACC), 114 Thompson St, Bldg 586, Rm 129, Langley VA, 23665, phone number (757) 764-5372, facsimile number (757) 764-4400. Concerns, issues, disagreements, and recommendations that cannot be resolved at the MAJCOM ombudsman level, may be brought by the interested party for further consideration to the Air Force ombudsman, Associate Deputy Assistant Secretary (ADAS) (Contracting), SAF/AQC, 1060 Air Force Pentagon, Washington DC 20330-1060, phone number (571) 256-2395, facsimile number (571) 256-2431. (d) The ombudsman has no authority to render a decision that binds the agency. (e) Do not contact the ombudsman to request copies of the solicitation, verify offer due date, or clarify technical requirements. Such inquiries shall be directed to the Contracting Officer. It has been determined that Lockheed Martin Aeronautics is the only responsible source capable of providing this service. No solicitation package will be issued. This notice of intent is not a request for competitive proposals; however, interested parties may identify their interest and capability to respond to this requirement within fifteen (15) days of the issuance of this notice. AMIC DET 2 /PK (Lackland AFB TX) will consider responses received by 12:00 P.M., EST on 03 Aug 18. Inquiries will only be accepted via email to Ms. Teresa Gonzalez at teresa.gonzalez@us.af.mil. No telephone requests will be honored. A determination by the Government not to compete this proposed effort on a full and open competition basis, based upon responses to this notice, is solely within the discretion of the Government. Oral communications are not acceptable in response to this notice. No RFP will be issued based upon this Notice of Intent.
