If your question is not listed it was determined that the answer is clearly identified in the solicitation or a similar question was asked. Question: Our APAP was not included on the approved product list as well as a good number of our Interfaces/Masks. Some of which are highly utilized by many different VA locations. How do we have those products added to the approved product lists? Answer: The approved product list is merely a list of products that the Veterans Administration (VA) currently identified for the medical treatment of Veterans with sleep Apnea. As a result, these products have been reviewed by VA and it has been determined that these products meet the minimum technical requirements of the draft solicitation. Your company s products may or may not be listed on the approved product list; however, products that are not listed in the approved product list can submit their technical literature and then will be evaluated for technical acceptability at that time in accordance with the solicitation (See Section E.9 Page 51 of the Draft Solicitation and the instructions for submission of a technical proposal in section E.5 page 47). Lack of inclusion does not affect the ability for any Offeror s product to be considered for award. Please note that this is a draft solicitation and the evaluation process is subject to change. Question: What is the process of adding newly released products to the approved product lists? Answer: There is no requirement for newly released products to be added to the approved product list. As stated in Section E.9 Page 51 of the Draft Solicitation and the instructions for submission of a technical proposal in section E.5 page 47, Offerors whose products are not listed in the approved product list can submit their technical literature. The products will then be evaluated for technical acceptability at that time and in accordance with the solicitation. Lack of inclusion does not affect any product s ability to be considered for award. Question: Can clinicians obtain products that are not on your list? Answers: The approved product list is merely a list of products that the VA currently identified for the medical treatment of Veterans with sleep Apnea. Offers will be evaluated using a lowest price, technically acceptable evaluation scheme, additionally offers must have an acceptable past performance at the time of award, in accordance with the solicitation and attached minimum technical requirements. Offeror s whose products are not listed in the approved product list can submit their technical literature. The products will be evaluated for technical acceptability at that time and in accordance with the solicitation. Lack of inclusion does not affect the ability for any Offeror product to be considered for award (See Section E.9 Page 51 of the Draft Solicitation and the instructions for submission of a technical proposal in section E.5 page 47). Question: Will this procurement be set-aside for SDVOSB as there are two or more SDVOSB to fulfill this requirement as I am sure your market research will support. Answer: The purpose of this Draft FRP is to gather information for consideration in developing the final draft of the RFP. At this time, we are still gathering information. No final solicitation has been drafted nor acquisition strategy finalized. Question: Will EQUAL products be accepted for consideration by the DALC? Answer: This requirement is not being solicited as brand name or equal. Please see section E.5 (d) and attachment D Minimum Technical Requirements for the requirements of the solicitation. All items must meet the Minimum Technical Requirements as described in attachment D of a finalized solicitation. Question: How will EQUAL products be clinically reviewed by staff to determine award eligibility? Answer: Your submitted products will be evaluated for technical acceptability in accordance with attachment D Minimum Technical Requirements. Also, please see section E.9 52.212-2 Evaluation- Commercial Items. Question: What is the anticipated RFP/Solicitation issue date? Answer: The purpose of this Draft FRP is to gather information for consideration in developing the final draft of the RFP. At this time we do not have an anticipated issue date. Question: Is the 7.5% CUF Fee to be paid by the Vendor/Supplier (i.e. would AvKARE pay this fee to the DALC)? Answer: Please see section B.16 Contractor s Report of Sales and Customer User Fee. The prices that are submitted by a contractor will have a 7.5% CUF added to them when awarded for ordering by the ordering agencies. The ordering agencies will be charged the CUF. However, the contractor must pay the CUF to the Department of Veterans Affairs at the end of each contract quarter since the total amount that will be paid to the contractor at time of ordering will be the proposed price plus the 7.5% CUF price (proposed price + CUF = Price Awarded). For example, if a proposed item by a contractor was $1, the awarded price by CSAS will add 7.5% to the proposed price to make the item $1.075 on contract award. When the ordering agency orders the item, they will pay $1.075 for the item to the contractor. Then at the end of each contract quarter the contractor will collect all the 7.5% CUF fees and pay them back to the Department of Veterans Affairs, in this example it would be.075. Question: Is this program meant for resupply only or for all utilization throughout the VA? Answer: As stated in the Draft Solicitation Section B.1 Page 5, The VA National Acquisition Center (NAC), Commodities and Services Acquisition Services (CSAS) has been tasked with a requirement to procure positive airway pressure (PAP) devices with associated accessories/replacement parts for the VA Prosthetic and Sensory Aids Service (PSAS) to supply VA Medical Centers (VAMCs). Question: We have an oral mask and you do have a category for Oral masks. It is a low volume item, but it is usually the last resort if the therapist has exhausted all other options. Can this be added or would the patients presently on this mask be switched to another style of mask? Answer: As stated above, the approved product list is merely a list of products that the VA currently identified for the medical treatment of Veterans with sleep Apnea. Offers will be evaluated using a lowest price, technically acceptable evaluation scheme, additionally offers must have an acceptable past performance at the time of award, in accordance with the solicitation and attached minimum technical requirements. Clinicians will have the ability to obtain products on a resulting contract (See Section E.9 Page 51 of the draft Solicitation and the instructions for submission of a technical proposal in section E.5 page 47). Question: Are accessories (seals/cushions, frames, headgear, etc.) approved products? Answer: See the answer to question 2 above. Question: Who determines which products are included on the approved list? Answer: See the answers to questions 1 and 2 above. Question: What are the guidelines used for approvals? Answer: See the answer to question 2 above. Question: How do you add products to the approved list? Answer: See the answer to question 2 above. Question: How do you add newly released products to the approved list? Answer: See the answer to question 2 above. Question: Are interface seals/cushion and headgear allowed products? Answer: We are unclear as to what is meant by allowed products. All products that are offered must meet the minimum technical requirements (see the Draft Minimum Technical Requirements in attachment D of the draft solicitation). Please note that this is a draft solicitation and the minimum technical requirements are subject to change. Question: For APAP, you stated that all APAPs must have an SD card. Our CPAP utilizes a USB stick for removable data storage (in addition to internal storage). Would this be allowed? Answer: Use of USB sticks is prohibited per the VA Directive 6601 dated February 27, 2007. END OF QUESTIONS
