This announcement constitutes the only solicitation; quotations are being requested, and a written solicitation document will not be issued. This solicitation is a request for quotations (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-95. The associated North American Industrial Classification System (NAICS) code for this procurement is 333314, with a small business size standard of 500 employees. The Lebanon VA Medical Center is seeking to purchase, BRAND NAME, TONOREFII Marco M3 Auto-Refractor for their eye clinic. All interested companies shall provide quotation(s) for the following: Supplies Line Item Description Quantity Unit Price Total Price 0001 Marco TONOREFII M3 Auto-Refractor 1 EA 0002 ON-SITE Training 1 JB 0003 Service Manuals 2 EA Delivery shall be provided no later than 30 calendar days after receipt of order/award of contract. Delivery terms FOB destination and must be coordinated with facility Point-of-Contact (POC), prior to delivery. The contractor shall deliver line item(s) 0001 through 0003 to Wilkes-Barre VAMC, 1111 East End Blvd, Wilkes-Barre, PA 18711. The government will evaluate information based on the following evaluation criteria: "(1) price, (2) past performance, and (3) technical capability factor "meeting or exceeding the requirement Quoters must provide a copy of the authorized distributor letter to verify that they are an authorized distributor. The following solicitation provisions apply to this acquisition: FAR 52.212-1, Instructions to Offerors Commercial Items (Jan 2017) Addendum: (a) Gray market items are Original Equipment Manufacturer s (OEM) goods sold through unauthorized channels in direct competition with authorized distributors. This procurement is for new OEM medical supplies, medical equipment and/or services contracts for maintenance of medical equipment (i.e. replacement parts) for VA Medical Centers. No remanufactures or gray market items will be acceptable. (b) Vendor shall be an OEM, authorized dealer, authorized distributor or authorized reseller for the proposed medical supplies, medical equipment and/or services contracts for maintenance of medical equipment (i.e. replacement parts), verified by an authorization letter or other documents from the OEM, such that the OEM s warranty and service are provided and maintained by the OEM. All software licensing, warranty and service associated with the medical supplies, medical equipment and/or services contracts for maintenance of medical equipment shall be in accordance with the OEM terms and conditions. (c) The delivery of gray market items to the VA in the fulfillment of an order/award constitutes a breach of contract. Accordingly, the VA reserves the right to enforce any of its contractual remedies. This includes termination of the contract or, solely at the VA s election, allowing the Vendor to replace, at no cost to the Government, any remanufactured or gray market item(s) delivered to a VA medical facility upon discovery of such items. Justification: The Marco M3 TonorefII/ARK Tonometer replaces both of the clinics old outdated Auto Refractors which are starting to fail and repairing will be an issue. The unit is used daily to asses need for spectacles, provides Non-Contact Tonometry and Auto Keratometry. DEPARTMENT OF VETERANS AFFAIRS Justification for Single Source Awards IAW FAR 13.106-1 For Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K) Acquisition Plan Action ID:__**REDACTED** ___ Contracting Activity: Department of Veterans Affairs, VISN 4, Lebanon Medical Center Brief Description of Supplies/ Services required and the intended use/Estimated Amount: This is a BRAND NAME procurement for the TONOREFII Marco M3 Auto-Refractor. Ophthalmology is submitting a New Requirement to purchase the TONOREFII Marco M3 Auto-Refractor/Auto-Karatometer/Non-contact Tonometer (NCT) for use in the eye clinic. This equipment will replace an outdated and malfunctioning refractometer. Estimated amount, **REDACTED**. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: There are no other single device machines on the market that provide all three functions Automatic Refractor, Automatic Kaeratometer, and Non-Contact Tonometer (NCT). This device is manufactured by Nidek, and Marco Ophthalmic is the exclusive distributor of the Nidek automated products in the USA and for all overseas government facilities. By purchasing this device, the cost to purchase additional items that carries out the functions mentioned above, would be eliminated. Description of market research conducted and results or statement why it was not conducted: A search on Unicor and AbilityOne resulted in zero (0) hits. A list of the following keywords were used for the search: refractor, optometry, eye, examination, autorefractor, TonorefII. Another search was conducted on GSAAdvantage and NAC. By using the same keywords, there were only one (1) Small Business, MARCO OPHTHALMIC, INC., that had the items on contract. A search on VetBiz showed 37 SDVOSBs and 3 VOSBs. A Sources Sought Notification, using FSC/PSC 6650 and NAICS, 333314, was posted onto FedBizzOpps, in order to further identify the market and any interest. During this period, there was one (1) SDVOSB response and no VOSBs, or any other Small Businesses, that expressed an interest or capabilities in the procurement. A letter from a Small Business, NAC contract holder (Marco Ophthalmic, Inc.) was provided and it states that they are exclusive distributors for Nidek automated products. Marco Ophthalmic also provided a list of authorized Service Disabled Veteran Owned Small Businesses sellers. After the closing of the Sources Sought Notification, it is believed that there are enough authorized Service Disabled Small Businesses to compete on the open market.
