Description
COMBINED SYNOPSIS SOLICITATION This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. The government anticipates award of a single firm fixed price contract. A quotation is not an offer and, consequently, cannot be accepted by the Government to form a binding contract. Therefore, issuance by the Government of an order in response to a supplier s quotation does not establish a contract. The order is an offer by the Government to the supplier to buy certain supplies or services upon specified terms and conditions. A contract is established when the supplier accepts the offer. The government intends to award without discussion. Solicitation 36C10E19Q0003 is issued as a request for quote (RFQ). The solicitation incorporates provisions and clauses in effect through Federal Acquisition Circular 2005-99A, effective June 15, 2018. The combined synopsis/solicitation is set aside for Service Disabled Veteran Owned Small Business Concerns only. Only quotes submitted by Veteran Owned Small Business concerns will be accepted by the Government. Any quote that is submitted by a contractor that is not a verified Service Disabled Veteran Owned Small Business in VIP will not be considered for award. The applicable NAICS Code for this solicitation is 561990 and the Small Business Size limitation is $11M. Offers from SDVOSB concerns must be registered and verified in the Center for Verification and Evaluation (CVE) Vendor Information Pages (VIP) website at https://www.vip.vetbiz.gov/ at the time and date set for receipt of offers and at the time and date of award to be considered for award. Note 4: Contractor shall provide the secured bins. B.3 DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK SHREDDING SREVICES RO 304 1.0 GENERAL 1.1. The contractor shall provide all labor, personnel, equipment, supplies, secured vehicles, materials, supervision and other related services necessary to provide commercial on-site document destruction services for the Department of Veterans Affairs, Providence Regional Office, 380 Westminster St, Providence, RI 02903. Proposed contractor shall be HIPA compliant and meet all shredding/document destruction standards and be in compliance with VA directive 6371) if applicable). The Records Management Officer shall conduct an initial orientation to the facility; however, thereafter the Contractor shall be responsible for conducting orientations to new Contractor employees. This will not relieve the Contractor s obligation to provide documentation of trustworthiness of new employees to include if needed NACI Tier II background checks. 2.0 PLACE OF PERFORMANCE: 2.1 Department of Veterans Affairs, Providence Regional Office, 380 Westminster St, Providence, R.I 02903. 2..2. The contractor shall furnish locked security waste container(s) (top-loaded bins), as required without additional cost to the Government. 2.3. Pickup schedule shall be coordinated with the Records Management Officer. Contractor shall provide a written schedule of the days and times of anticipated performance at the facility stated in this contract. Contractor is required to perform shredding/pickup on a day agreeable to both VA Regional Office and the contractor. Any changes to the schedule shall be approved in advance of the contractor visiting the facility. The contractor shall schedule the times during normal business hours, which are between 8:00 a.m. and 4:00 p.m. Monday through Friday with the exception of Federal Holidays. 2.4. The locations for the bulk containers are subject to change by the Government. The Government shall notify the contractor in writing, of location changes or adding of additional bins. 2.5 The Certification and Accreditation requirements do not apply to this requirement and a Security and Accreditation Package is not required. 3.0 WORK HOURS: 3.1. Service for the facility shall be conducted during normal work hours (8:00 a.m. to 4:00 p.m.), Monday through Friday, with pick-up and shredding services to monthly unless the date falls on a Federal Holiday. Containers less than 50% full at the time of dump shall be emptied at a reduced rate. (For example, two containers shall be counted as one). 3.2. FEDERL HOLIDAYS: The ten holidays observed by the Federal Government are: New Year s Day, Martin Luther King Jr. Birthday, President s Day, Independence Day, Labor Day, Columbus Day, Veteran s Day, Thanksgiving Day, and Christmas Day. 4.0 SHREDDING SPECIFICATIONS: 4.1 Under 36 C.F.R. 1228.58, paper records to be disposed of that do not contain sensitive information must be sold as wastepaper. However, if the records require special protection because they are national security classified or deemed confidential by statue such as the Privacy Act of 1974 and the Health Insurance Portability and Accountability Act of 1996 (HIPPA), regulation, or VA policy, the wastepaper contractor must be required to wet pulp, macerate, chop, shred, or otherwise definitively destroy the information contained in the records so that it is not readable or re-constructible. The destruction of information must be witnessed by a Federal employee. Documented certification of destruction is to be provided to the VA that certifies complete destruction of the records. The contractor shall protect, safeguard, control, manage and destroy VA designated confidential documents complying with 6371 is dated April 8, 2014 (B.2.3.1). 4.2. Contractor will ensure personally-identifiable information (PII) and other sensitive temporary records are handled in a secure manner. At a minimum, this contract shall require documentation that any contractor who will handle the records until final destruction is completed, is bonded, insured, National Association for Information Destruction (NAID) certified for paper/printed media destruction and can provide reasonable physical safeguards for the data throughout the destruction process. 4.3 Contractor must strictly comply with VA Directive 6371 (if still an active Directive), Contractor shall meet or exceed all Federal, State, or local laws and regulations when dealing with protected material. Certificate of Destruction will be delivered to the VA Regional Office by either regular mail or email. 4.4 Contractor shall be bonded or be covered for Error and Omissions Insurance in the amount of at least $500,000. 5.0 TASKS: 5.1 Contractor shall perform tasks described below: 5.3 Contractor shall pick up all bins located at Department of Veterans Affairs, Providence Regional Office, 380 Westminster St, Providence, RI 02903. On-site destruction is required. The contractor shall maintain a chain of security/custody from pick-up to final destruction. Contractor to provide Government number of bins shredded prior to departing the facilities. 5.6 Contractor shall deliver industry standard Certificates of Destruction for completed destruction. 6.0 NON-DISCLOSURE OF SENSITIVE INFORMATION: 6.1Contractor staff involved in this contract will have access to some privileged and confidential materials of the U.S. Government. These printed and electronic documents are for internal use only and remain the sole property of the U.S. Government. Some of the materials are protected by the Privacy Act of 1974 (Amended) and Title 38. Unauthorized disclosure of Privacy Act or Title 38 covered materials, by any contractor or subcontracted staff, is a criminal offense. The contractor is responsible for actions of contract employees. 6.1 The contractor acknowledges that in the performance of this contract, the contractor will have access to sensitive information, including information provided on a proprietary basis by carriers, equipment manufacturers and other private or public entities. The contractor agrees to safeguard these privileges and use the information exclusively in the performance of this contract. The contractor shall comply with applicable Government regulations regarding information document security to prevent disclosure of sensitive information to unauthorized individuals or organizations. 7.0 INSPECTION: 7.1 Representatives of the Government shall have the right to inspect the contractor s and/or subcontractor s facilities and operations provided for the performance of work under this agreement. 8.0 DOCUMENT DESTRUCTION: 8.1 The contractor shall ensure that destruction services are performed in accordance with mandated specifications, regulations, and laws. The contractor shall develop and implement procedures to identify and prevent the occurrence of defective services. Contractor shall execute the terms of this contract in a manner that will safeguard the confidentiality of all documents and information. 8.2 The contractor shall not resell, in any form, any documents that have been destroyed. 9.0 CERTIFICATION OF DESTRUCTION: 9.1 The contractor shall prepare and submit to the Records Management Officer, an original signed Certificate of Destruction for each pick-up for each site within five working days of each pick-up. The Contractor shall maintain proper records concerning each Certificate of Destruction issued. 9.2 The Certificate of Destruction shall at a minimum contain the following: Pick-up/Delivery Location. Pick-up/Delivery Date. Name of Government Employee at Pick-up Location. Amount of shredded waste (number of containers picked up and/or pounds shredded). Destruction Certification Document Number. Destruction Certification Date. Any other information as determined necessary by the Records Management Officer. 10.0 CONTRACTOR PERSONNEL LIST: 10.1 The contractor shall provide the Records Management Officer with a list of contractor employees expected to enter the buildings to pick up confidential documents. While on VA premises, all contractor personnel shall comply with the rules, regulations, and procedures governing the conduct of personnel and the operation of the facility. Contractor shall allow only individuals aged 18 or over, who have appropriate contractor identification to assist with the shredding/removal. 10.2 The contractor s employees upon entrance into VA buildings will be escorted by a government employee at all times. 10.3 The contractor shall be required to comply with all security policies/requirements of the VA Regional Office, Providence, RI. 02903. All security policies/requirements must be met and employees cleared prior to the contractor performing work under this contract. Employees that cannot meet the security and clearance requirements shall not be allowed to perform work under this contract. 10.3.1 There is no requirement to fingerprint employees of the vendor.   However, employees who will be servicing this office will be required to sign the Rules of Behavior and complete the TMS Privacy training.   SSD will be required to keep track of vendor employees to ensure who ever arrives has completed all necessary requirements, if not they will not be given access to VA and complete shredding tasks. 10.4 It is the responsibility of the contract personnel to park in the appropriate designated parking areas. Parking information shall be coordinated with the facility Records Management Officer. 10.5 Department of Veterans Affairs, Regional Office, Providence, RI, 02903, does not validate or make reimbursement for parking violations of the contract personnel under any circumstance. 11.0 COMPLAINTS: The Government will receive and investigate complaints from various customers located at Providence, RI. All information received will be provided either verbally and/or in writing to the contractor for appropriate action. Performance Objective Performance Threshold Contractor picks up from all designated areas as outlined below. Less than two (2) verified complaints of failure to pick-up per quarter. Contractor ensures that no shred residue remains in shred bin from previous users. Less than two (2) verified complaints of shred material in bins from other customers. 1.5 Requirement: Contractor shall provide one vehicle capable of shredding all types of media at time of service. Contractor shall shred computer hard drives according to VA Handbook 6500.1 Electronic Media Sanitization. 1.6 See Appendix A. Contractor shall provide a certificate of destruction for each group of media shredded during visit in accordance with VA Directive. 1.7 See Appendix B. Contractor shall allow for on-site vehicle inspection of shredded media for compliance of VA Policy. Contractor is responsible for moving containers from holding area to contractor s vehicle for on-site destruction. The contractor acknowledges and understands the following: a. The contractor and any subcontractor(s) shall presume that the VA computer systems and storage media that the contractor or subcontractor access have sensitive information and applications, the modification or disclosure of which could cause significant harm or embarrassment to VA beneficiaries and employees and to VA's ability to perform its mission. If the security requirements for accessing, handling, and storing VA data and systems are specified in the contract, the contractor will comply with the contractual security requirements. If the contract does not contain the requirements, the contractor will handle the VA property with the same degree of care, but no less than a reasonable degree of care, to prevent the unauthorized access, use, dissemination, publication, or destruction that the contractor uses to protect its own sensitive information and systems. b. Any VA information, software, applications, computer systems, and hardware accessed by the contractor in the performance of the contract remain the sole property of VA. c. To the extent that any software or applications on the VA systems are protected by copyright, the contractor agrees that it will not copy or disclose them without first obtaining VA's prior written authorization, which will be provided only where authorized under applicable copyright law. d. The contractor, the contractor's employees, and any subcontractor and subcontractor's employees will access the VA information, software, applications, computer systems, and hardware which VA provides, or provides access to, only to the extent necessary, and only for the purpose of performing the contract. e. The contractor will take reasonable steps to ensure that it will allow only those contractor and subcontractor employees who need to see the VA materials in order to perform the contract to do so. However, this agreement also applies to any other VA systems or data to which the contractor may have access to or be disclosed to the contractor. f. The contractor will not authorize anyone else to access, disclose, modify, or destroy the information, software or applications on the VA systems provided or accessed under this contract without VA's prior written authorization. g. The contractor and its employees shall not make any copies of any VA information, including software or applications that are not copyrighted, except as necessary to restore VA computer systems or data storage devices to an operating state. Any copies made by the contractor or subcontractor shall be identified as VA property and handled as sensitive information under this non-disclosure agreement. h. Any information that the contractor and its employees learns about VA data and VA computer systems shall not be recorded except to the extent necessary to perform the contract, and such information, whether recorded or not, shall be handled as sensitive information under this agreement. The contractor may not use or disclose it except as the contractor is permitted to use or disclose VA sensitive information under the contract and this nondisclosure agreement. i. The contractor may disclose VA sensitive information to persons other than in the performance of this contract as authorized by the contract and this agreement in only two situations: (1) pursuant to an order of a court of competent jurisdiction; or (2) with VA's prior written authorization. Prior to any disclosure pursuant to a court order, the contractor shall promptly notify VA of the court order and provide VA with a copy by fax or e-mail, whichever is faster, and notify by telephone the VA individual designated in advance to receive such notices. j. If the contractor cannot notify VA before being compelled to produce the information under court order, the contractor will notify VA of the disclosure as soon as practical. The notice under this provision will include the following information to the extent that the contractor knows it, if it does not show on the face of the court order: the records disclosed pursuant to the order, to whom, where, and when, for what purpose, and any other information that the contractor reasonably believes is relevant to the disclosure. k. The contractor will refer all requests or demands for production of, or access to, VA data and systems to VA for response. The contractor will immediately inform VA by telephone, fax and/or e-mail of any access, disclosure, disposition or destruction of VA data and systems not authorized under the contract or this agreement. To the extent known, the contractor will notify VA of the information disclosed, to whom, how when, the reason for the access, disclosure, disposition or destruction, and any other information that the contractor considers relevant. VA will provide the contractor with the name, title, telephone number, fax number, and e-mail address of the VA official whom the contractor will notify if the records are requested, sought under a court order, or if any unauthorized access, modification, disposition, or destruction of VA sensitive information or computer systems occurs. l. The contractor, its employees, and its subcontractors and their employees will cooperate with VA and any law enforcement authority response for the investigation and prosecution of any possible criminal law violation(s) associated with any unauthorized access, disclosure, disposition, or destruction of VA property. The contractor will also cooperate with VA in any civil litigation to recover VA property, to obtain monetary or other compensation for a third party, or to obtain injunctive relief against any third party who accessed, modified, disclosed, or destroyed VA sensitive data and computer systems except as authorized under the contract or this agreement. m. Upon completion or termination of the contract for any reason, the contractor will immediately deliver all VA records, data, copies of VA records and data, software and equipment, and information about VA data and systems recorded or documented by the contractor, in its possession or the possession of any subcontractors, to the VA official designated in the contract or pursuant to this agreement. The contractor will not retain any copies of any of these documents. n. All additions to, or modifications of, this agreement must be in writing and signed by both parties. o. This agreement is made under, and shall be governed by, the laws of the United States. 2.0 INVOICING: Contractor will provide the VA Finance Department with a summary on invoice for any media destroyed to include as a minimum: Quantity of hard drives, electronic media destroyed, model and serial number of each hard drive should be provided by IT or SSD point of contact prior to hand off to contractor or placement in bins. Date and time service was provided. The Contractor shall comply with all security requirements imposed by the installation commander at all times while on the installation. Contractor personnel involved in civil crimes and/or other incidents of misconduct may be restricted from entry onto the installation. Installed equipment shall also possess the capability of being monitored via Contractor supplied computer software of web-based tracking. PERIOD OF PERFORMANCE: Will consist of a base year with four one-year options. Options are not guaranteed. i.e. Period of Performance: Base Year 10-01-2018 to 09/30/2019 Option year I 10-01-2019 to 09-30-2020 Option year II 10-01-2020 to 09-30-2021 Option year III 10-01-2021 to 09-30-2022 Option year IV 10-01-2022 to 09-30-2023 3.1 FEDERAL HOLIDAYS The contractor shall not be required, nor is authorized to perform any work on the following U.S. Government Federal holidays: New Year s Day, Martin Luther King Jr s Birthday, Washington s Birthday, Memorial Day, Independence Day, Labor Day, Columbus Day, Veterans Day, Thanksgiving Day, Christmas Day. RULES AND REGULATIONS 4.1 Current rules and regulations applicable to the premises, where the work shall be performed, shall apply to the contractor and its employees while working on the premises. These regulations include but are not limited to, presenting valid identification for entrance, smoking restrictions and any safety procedures as outlined in the site regulations. 4.2 The Contractor shall be responsible for the acts and omissions of all its employees and subcontractors, their agents and employees and all other persons performing any of the work under a contract with the Contractor. 4.3 Invoicing: Payment for all services will be made monthly in arrears upon receipt of an itemized invoice containing the following information: VA Contract Number / Obligation Number Company Name and Address Invoice Date Invoice Number (Note: Each Invoice must have a different Invoice Number) Dates of Services performed Description of items/services provided as well as referencing the appropriate Contract Line Item Number (CLIN). This way the proper CLIN can be billed for the invoice. Name, title and phone number of company point of contact to notify in case of a defective invoice. vii. Acknowledgement of any amendments (if applicable). Solicitation Questions: Questions of a technical nature shall be submitted to the Contracting Officer in writing via e-mail. No phones calls will be taken. Oral questions of a technical nature are not acceptable due to the possibility of misunderstanding or misinterpretation. The cut-off date and time for receipt of questions is September 18, 2018 by 4:00 PM EST. Questions received after this date and time may not be answered. Questions will be answered in a formal amendment to the solicitation so all interested parties can see the answers.
