Description
DISCLAIMER This RFI is issued solely for information and planning purposes only and does not constitute a solicitation. All information received in response to this RFI that is marked as proprietary will be handled accordingly. In accordance with FAR 15.201(e), responses to this notice are not offers and cannot be accepted by the Government to form a binding contract. Responders are solely responsible for all expenses associated with responding to this RFI. Responses to this notice must be submitted in writing via email and must be received not later than Wednesday December 5, 2018, 9:00am EST. No telephone inquiries will be accepted. The purpose of this notice is to gain knowledge of potential qualified sources and their size classification/socioeconomic status (service-disabled veteran owned small business, veteran owned small business, HUB Zone, 8(a), small business or large business). Responses to this notice will be used by the Government to make appropriate acquisition decisions. Responses to this notice should include company/individual name, a service capability statement, examples of similar facilities for which you have provided services to, proof of applicable certification. DUNS number, address, point of contact and social-economic category (ex: SBVOSB, VOSB, 8(a), HUBZone, WOSB, EDWOSB, Small Business). If your firm is a Service-Disabled Veteran Owned or Veteran Owned Small Business, you must be CERTIFIED in VetBiz (see internet site: http://vip.vetbiz.gov). Contractor must be registered in System for Award Management (SAM), formerly CCR (see internet site: http://www.sam.gov). Responses to this notice must be submitted in writing, and received not later than Wednesday December 5, 2018, 9:00am EST. STATEMENT OF WORK The service described below is required as soon as possible 1. General: Contractor shall agree to manage the Therapeutic Pool of approx. 34,000 gallons located at the James J Peters VA Medical Center 130 West Kingsbridge Road Bronx, NY; from date of award through March 31, 2019 in accordance with the following specifications. 1.2 Description of Services/Introduction: The Contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to provide Aquatic & Pool Services & Maintenance 5 days per week A. POOL HOURS Operating Hours: Monday Friday 8AM- 4:30PM B. PERSONNEL 1 (one) Certified Lifeguard able to perform duties during the specified hours without surpassing any State or Federal Law with regard to worker fatigue. If Lifeguard is sick or on leave a replacement Lifeguard shall be here to replace him/her. Project Manager: 2 hours/week; 8 hours/month 1.3 Period of Performance: The period of performance shall be from date of award through March 31, 2019 with pricing for option to be renewed if needed by the government. 1.4 Scope: Contractor shall render the swimming pool operational by completing the following services: Contractor shall apply for all necessary Health Department permits upon Owner s request. The contractor shall be responsible for all permit fees including a processing fee. Check inventory supplies Maintenance of pool Maintenance of filter (monitoring and refilling of media) Personnel Client Care / Supervision Chemicals & Supplies e.g. chemical test strips, log book 1.5 Contractor Responsibilities 1.5.1 MAINTENANCE OF POOL Contractor shall perform a general cleaning prior to opening the pool each day. Contractor shall be responsible for maintaining water purity, in conformance with the local Health Department regulations. Contractor shall operate pool in accordance with rules established by governing Health Department s recognized safety rules. Contractor shall ensure all users of the facility will agree to adhere to swimming pool rules included as Addendum I of this agreement. Contractor will not be responsible for gate control unless Owner authorizes Contractor to provide additional personnel specifically for these duties. Contractor will not be responsible for functionality of any pool furniture and equipment including but not limited to physical operation of filtration equipment, pool steps and ladders, chairs, chaise lounges, tables, and umbrellas. Contractor will not be responsible for the perimeter barrier of the pool (i.e., building), any locking mechanisms of the barrier, or security surrounding the pool area. Contractor shall perform maintenance of filtration equipment, to be performed by someone other than the lifeguard Contractor shall perform cleaning functions as necessary to maintain the pool daily and as needed. The following maintenance tasks shall be conducted daily, or as noted: Pool shall be checked a minimum of 3 times a day for chemical balance, including once before the pool is opened Chemicals shall be added on a weekly basis, or as needed per chemical tests Swimming pool area shall be cleaned Filters shall be checked and cleaned Vacuum pool Brush pool Clean skimmer baskets Clean waterline tile Backwash filtration system Remove trash from pool area to Owner s onsite trash been Maintain water to proper level Maintain water purity, in conformance with the local Health Department Regulations 1.5.2 PERSONNEL All personnel employed by Contractor for work under this agreement shall be employed solely by, and will be employees of, Contractor. Contractor shall be responsible for paying these employees and shall pay all taxes and costs incident to the work of the employees. All lifeguards employed by Contractor shall have proper Red Cross or other state sanctioned certification. Contractor shall have the sole discretion as to the hours and days of work of employees. Owner and Contractor have based the personnel required to safely manage the site upon the anticipated peak bather load as notated in Part 1. If peak bather load is exceeded, Owner will be notified and required to increase personnel or decrease load. Staff schedules may be adjusted to suit the particular needs of the Owner. Additional hours or days may be added at the Owner s request for an additional fee with prior written approval by Contractor. Additional lifeguard hours needed within the operating times of the contract as specified in Part 1 shall be calculated at $22.95 per hour. Special event staff shall also be calculated at the rate of $24.95 per hour. Special events would be rare and at the complete discretion of the CO. Lifeguards shall be entitled to ½ hour lunch break for every shift five hours or longer. 1.5.2.1 BACKGROUND SECURITY PERSONAL INFORMATION VERIFICATION The Contractor shall bear the expense of obtaining background investigations. If the investigation is conducted by the Office of Personnel Management (OPM) through the VA, the Contractor shall reimburse the VA within 30 days. Background investigations from investigating agencies other than OPM are permitted if the agencies possess an OPM and Defense Security Service certification. The Vendor Cage Code number must be provided to the Security and Investigations Center (07C), which will verify the information and advise the contracting officer whether access to the computer systems can be authorized. The Contractor shall prescreen all personnel requiring access to the computer systems to ensure they maintain a U.S. citizenship and are able to read, write, speak, and understand the English language. After contract award and prior to contract performance, the Contractor shall provide the following information, using Attachment II, to the CO: (1) List of names of Contractor personnel (2) Social Security Number of Contractor personnel (3) Home address of Contractor personnel or the Contractor's address The Contractor, when notified of an unfavorable determination by the Government, shall withdraw the employee from consideration from working under the contract. Failure to comply with the Contractor personnel security requirements may result in termination of the contract for default. Further, the Contractor will be responsible for the actions of all individuals provided to work for the VA under this contract. In the event that damages arise from work performed by Contractor provided personnel, under the auspices of this contract, the Contractor will be responsible for all resources necessary to remedy the incident. 1.5.3 CLIENT CARE / SUPERVISION Contractor agrees to conduct at least 3 site visits per week and advise Owner of the general pool operation. Dates and times of the site visits may vary. Contractor agrees to meet with the Owner representative periodically to discuss pool operation and related issues at Owner request. This will be done AT LEAST quarterly. 1.5.4 CHEMICALS AND SUPPLIES Contractor will supply chlorine, muriatic acid, Pulsar pellets and soda ash, CO2, and any other chemical deemed necessary for operation. SDS for any and all existing or newly incorporated will supply testing reagents and balancing chemicals as needed. Supplies such as soap, brushes, first aid items, and other expendable items needed for the operation of the pool shall be the sole responsibility of the Owner. Chemical Cost Pulsar Plus Briquettes $370.80 per 100 lbs Muriotic Acid $80.57 per QT Soda Ash $77.98 45 lbs Sodium Bicarbonate $20.38 per 5 lbs Calcium Chlorine $22.76 per 4 lbs 1.6 GENERAL INFORMATION 1.6.1 QUALITY CONTROL The Contractor shall develop and maintain an effective quality control program to ensure services are performed in accordance with this SOW. The Contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The Contractor s quality control program, (QCP) is the means by which they assure themselves that their work complies with the requirement of the contract. Contractor shall submit a written QCP, if applicable, within 30 days after contract award or with the Contractor s proposal if it is an evaluation factor, three copies of a comprehensive written QCP shall be submitted to the CO and COR within 5 working days when changes are made thereafter. After acceptance of the quality control plan the Contractor shall receive the contracting officer s acceptance in writing of any proposed change to his QC system. 1.6.2 QUALITY ASSURANCE The government shall evaluate the Contractor s performance under this contract in accordance with the Quality Assurance Surveillance Plan. This plan is primarily focused on what the Government must do to ensure that the Contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rate(s). 1.7 VA RESPONSIBILITIES (Owner) Owner will be responsible for any permit fees. Provide Contractor with an ample number of keys to the pool enclosure and facilities. Complete all needed repairs inside pool enclosure, such as plumbing, decking, fencing, locking mechanisms, caulking, area lights, depth markings, etc. Owner will maintain the perimeter barrier of the pool building and any and all locking mechanisms of the swimming pool area or enclosure, and will be responsible for security of the pool area. If Owner provides pool furniture (including chairs, lounges, tables, umbrellas and umbrella bases), it will be of good working condition. Owner will supply one base for each umbrella. Contractor will not be responsible for any damages to pool furniture or liable for injury to patrons caused by pool furniture. The Owner shall ensure that the swimming pool facility complies with all building codes and the Local Health Regulations in effect. The Owner shall provide, in good working condition, all necessary equipment for the safe operation of the facility, including but not limited to filtration equipment, pool ladders, rescue tubes, backboard with straps, head immobilizer, deep water divider ropes, elevated guard station(s). Owner will have a telephone at the pool (tone, hard wired, push button) prior to official opening date available to the lifeguards at all times. Owner will provide long distance, 900 service, toll, and internet blocks to prevent additional charges on any non-payphone. Owner will provide Contractor and Contractor s employees with free parking to service the facility. Owner will provide all utilities water, electricity and gas (if needed) for the operation of the pool. Owner will provide Contractor with a copy of Owner s approved pool rules for the facility. Owner will provide Contractor a safe working environment. Owner shall provide, free of charge, adequate and conveniently located storage space for cleaning materials and equipment of Contractor and shall be responsible to Contractor for the security of such place. Owner will not be responsible for any Contractor items left unsecured. 1.7.1 OWNER RESPONSIBILITIES FOR PERSONNEL SECURITY SCREENING The VA Security and Investigations Center will provide the necessary forms to the Contractor or to the Contractor's employees after receiving a list of names and addresses. Upon receipt, the VA Security and Investigations Center will review the completed forms for accuracy and forward the forms to OPM to conduct the background investigation. The VA facility will pay for investigations conducted by the OPM in advance. In these instances, the Contractor will reimburse the VA facility within 30 days. The VA Security and Investigations Center will notify the contracting officer and Contractor after adjudicating the results of the background investigations received from OPM. The contracting officer will ensure that the Contractor provides evidence that investigations have been completed or are in the process of being requested. 1.6 INSURANCE Contractor/Subcontractor maintains current Comprehensive General Liability, covering the legal liability for bodily injuries and property damages, for a combined limit of two million dollars ($2,000,000) per occurrence, with excess liability coverage in the amount of twenty million dollars ($20,000,000) aggregate and covering at least the following hazards; (a) Contractor s Premises and Operations; (b) Contractor s Protective for its legal liability in connection with sub-Contractor s operations; and (c) Contractual. The total insurance coverage provided is twenty-two million dollars ($22,000,000). In the event the Contractors coverage falls below ten million dollars ($10,000,000) combined liability and excess, Owner will be notified. Employers Liability Insurance, covering all employees of the Contractor/Subcontractor, with a liability limit of at least five hundred thousand ($500,000) each accident for bodily injury, five hundred thousand ($500,000) each employee for bodily injury by disease, and five hundred thousand ($500,000) policy limit for bodily injury by disease. Comprehensive automobile liability insurance, covering bodily injuries and property damage in limits of not less than one million dollars ($1,000,000) per accident, providing coverage for any accident arising out of or resulting from the operation, maintenance or use by the Contractor on the property of any owned, non-owned, or hired automobiles, trailers, or other vehicular equipment to be licensed. Owner will maintain general liability insurance policy of at least five million dollars ($5,000,000) evidencing property damage, bodily injury, products & completed operations, contractual liability and personal injury coverage for the subject premises, including the pool area. Owner will provide to Contractor a certificate of insurance evidencing the coverage naming Contractor as additional insured. Owner expressly waives all rights of subrogation against Contractor for damages caused by perils to the extent covered by insurance obtained or required to be obtained pursuant to this Agreement, or any insurance coverage applicable to the premises which is the subject of this Agreement. The waiver of subrogation shall be effective as to a person or entity even though that person or entity would otherwise have a duty of indemnification, contractual or otherwise, did not pay the insurance premium directly or indirectly and whether or not the person or entity has an insurable interest in the property damaged. Owner agrees to inform Contractor of any activities conducted at the pool during hours specified in Part 1. The Owner shall be responsible for any claims, accidents, injuries, and damages during such activities. Owner agrees to and does hereby indemnify Contractor and save it harmless and shall defend it from and against any and all claims, damages, liability and judgments in connection with personal injury and/or damage to property arising from or out of maintenance, operation or use by the Owner and/or its agents, servants, employees, invitee s, and licensees 1) outside of the hours listed in the General Specifications, 2) during any organized activities, and 3) brought forth by other Contractors and/or trespassers. 1.6.1 ADDITIONAL PROVISIONS All repairs needed to render the pool in operational condition will be made by the Owner at their expense unless found to be caused by negligence of the Contractor. Contractor, if requested by the Owner, may perform, arrange for, or supervise the work at an agreed upon fee. REPAIRS, BILLS, AND INVOICES: Owner shall pay all repair bills and invoices submitted by Contractor within 30 days of receipt. This covenant is an independent covenant of this contract. All materials supplied by Contractor remain the property of Contractor until materials are paid in full. All applicable sales taxes (i.e. Federal, State) for any equipment, labor, chemicals, or any other sales will be included in the prices represented by Contractor and shall not be applied as an extra amount to invoices. Any invoice should be complete and final and include all costs associated with the time period it covers. In the event that Owner shall become bankrupt, insolvent, or shall make a voluntary assignment for the benefit of creditors, Contractor, at its option, may terminate this agreement immediately. Owner hereby agrees to contract with Contractor to manage and operate the pool site during the term of this Statement of Work. Owner hereby agrees that Contractor is utilizing Owner property and Contractor will not be held liable for damage that is caused to Owner property by its clients. This SOW may not be amended or modified except by written instrument executed by the parties. This SOW shall be governed and construed in accordance with the laws of the State where Contractor is domiciled. Should the pool not open by 9:00 AM due to inclement weather, the pool will be closed for the remainder of the day. Contractor cannot be held liable for any hydrostatic conditions that cause damage to the pool structure and surrounding area unless they are found to be caused by the lack of pool maintenance agreed upon that the Contractor is responsible for. Additional chemicals consumed over Contractors anticipated normal usage due to pool leakage will be billed at Owner s expense. If, during the term of the contract, any increases in federal, state and/or local minimum wage occur and are in effect during the term of the pool management SOW, the Owner will not be responsible until the next option year of service. The Statement of Work is unaffected and shall continue in full force and effect in accordance with its terms. If there is a conflict between this agreed upon Statement of Work and/or any earlier agreements the terms of this Statement of Work will prevail. 1.7 General Information 1.7.1 Quality Control: The Contractor shall develop and maintain an effective quality control program to ensure services are performed in accordance with this SOW. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rate(s). 1.7.3 Recognized Holidays: The Contractor is not required to perform services on Nationally-recognized holidays unless asked specifically to open the pool. The Contractor will respond to any service/ performance issues within 24 hours of the recognized holiday unless the holiday falls on a Friday, the response is then required by the following Monday. 1.7.4 Hours of Operation: The Contractor is responsible for conducting business 8 hours per day 5 days per week except when the Government facility is closed due to local or national emergencies, or similar Government directed facility closings. For other than firm fixed price contracts, the Contractor will not be reimbursed when the government facility is closed for the above reasons. The Contractor shall, at all times, maintain an adequate workforce for the uninterrupted performance of all tasks defined within this SOW when the Government facility is not closed for the above reasons. When hiring personnel, the Contractor shall keep in mind that the stability, maturity and continuity of the workforce are essential. 1.7.5 Place of Performance: The work to be performed under this contract will be performed at The James J Peters VA Medical Center 1.7.6 Type of Contract: The government will award a firm fixed price contract. 1.7.7 Security Requirements: Contractor personnel performing work under this contract must have a minimal level of security at time of the proposal submission, and must maintain the level of security required for the life of the contract. 1.7.7.1 Physical Security: The Contractor shall be responsible for safeguarding all government equipment, information and property provided for Contractor use. At the close of each work period, government facilities, equipment, and materials shall be secured by Contractor. 1.7.8 Post Award Conference/Periodic Progress Meetings: The Contractor agrees to attend any post award conference convened by the contracting activity or contract administration office in accordance with Federal Acquisition Regulation Subpart 42.5. The contracting officer, Contracting Officers Representative (COR), and other Government personnel, as appropriate, may meet periodically with the Contractor to review the Contractor's performance. At these meetings the contracting officer will apprise the Contractor of how the government views the Contractor's performance and the Contractor will apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the government. 1.7.9 Contracting Officer Representative (COR): The (COR) will be identified by separate letter. The COR monitors all technical aspects of the contract and assists in contract administration The COR is authorized to perform the following functions: assure that the Contractor performs the technical requirements of the contract: perform inspections necessary in connection with contract performance: maintain written and oral communications with the Contractor concerning technical aspects of the contract: issue written interpretations of technical requirements, including Government drawings, designs, specifications: monitor Contractor's performance and notifies both the Contracting Officer and Contractor of any deficiencies; coordinate availability of government furnished property, and provide site entry of Contractor personnel. A letter of designation issued to the COR, a copy of which is sent to the Contractor, states the responsibilities and limitations of the COR, especially with regard to changes in cost or price, estimates or changes in delivery dates. The COR is not authorized to change any of the terms and conditions of the resulting order. 1.7.10 Key Personnel: The follow personnel are considered key personnel by the government: Ed. Mclaughlin. PCC Director, Michael Ong Director FMSC 1.7.11 Identification of Contractor Employees: All contract personnel attending meetings, answering Government telephones, and working in other situations where their Contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are Government officials. They must also ensure that all documents or reports produced by Contractors are suitably marked as Contractor products or that Contractor participation is appropriately disclosed. Contractor personnel will be required to obtain and wear badges in the performance of this service which can be attained by first reporting to Police Service at the applicable facility and will return those badges upon the completion of work on the same business day. 1.7.13 Data Rights: The Government has unlimited rights to all documents/material produced under this contract. All documents and materials, to include the source codes of any software, produced under this contract shall be Government owned and are the property of the Government with all rights and privileges of ownership/copyright belonging exclusively to the Government. These documents and materials may not be used or sold by the Contractor without written permission from the Contracting Officer. All materials supplied to the Government shall be the sole property of the Government and may not be used for any other purpose. This right does not abrogate any other Government rights. 1.7.12 Organizational Conflict of Interest: Contractor and Subcontractor personnel performing work under this contract may receive, have access to or participate in the development of proprietary or source selection information (e.g., cost or pricing information, budget information or analyses, specifications or work statements, etc.) or perform evaluation services which may create a current or subsequent Organizational Conflict of Interests (OCI) as defined in FAR Subpart 9.5. The Contractor shall notify the Contracting Officer immediately whenever it becomes aware that such access or participation may result in any actual or potential OCI and shall promptly submit a plan to the Contracting Officer to avoid or mitigate any such OCI. The Contractor s mitigation plan will be determined to be acceptable solely at the discretion of the Contracting Officer and in the event the Contracting Officer unilaterally determines that any such OCI cannot be satisfactorily avoided or mitigated, the Contracting Officer may affect other remedies as he or she deems necessary, including prohibiting the Contractor from participation in subsequent contracted requirements which may be affected by the OCI. PART 2 DEFINITIONS & ACRONYMS 2. DEFINITIONS AND ACRONYMS: 2.1 DEFINITIONS: Statement of Work (SOW) a statement of work for performance-based acquisitions that describes the required results in clear, specific and objective terms with measurable outcomes. Facilities (Owner) James J. Peters VAMC, Bronx, NY. Contractor 2.1.1 CONTRACTOR: A supplier or vendor awarded a contract to provide specific supplies or service to the government. The term used in this contract refers to the prime. 2.1.2 CONTRACTING OFFICER: A person with authority to enter into, administer, and or terminate contracts, and make related determinations and findings on behalf of the government. Note: The only individual who can legally bind the government. 2.1.3 CONTRACTING OFFICER'S REPRESENTATIVE (COR): An employee of the U.S. Government appointed by the contracting officer to administer the contract. Such appointment shall be in writing and shall state the scope of authority and limitations. This individual has authority to provide technical direction to the Contractor as long as that direction is within the scope of the contract, does not constitute a change, and has no funding implications. This individual does NOT have authority to change the terms and conditions of the contract. 2.1.4 DEFECTIVE SERVICE: A service output that does not meet the standard of performance associated with the Statement of Work. 2.1.5 DELIVERABLE: Anything that can be physically delivered, but may include non-manufactured things such as meeting minutes or reports. 2.1.6 KEY PERSONNEL: Contractor personnel that are evaluated in a source selection process and that may be required to be used in the performance of a contract by the Key Personnel listed in the SOW. When key personnel are used as an evaluation factor in best value procurement, an offer can be rejected if it does not have a firm commitment from the persons that are listed in the proposal. 2.1.7 PHYSICAL SECURITY: Actions that prevent the loss or damage of Government property. 2.1.8 QUALITY ASSURANCE: The government procedures to verify that services being performed by the Contractor are performed according to acceptable standards. 2.1.9 QUALITY ASSURANCE SURVEILLANCE PLAN (QASP):An organized written document specifying the surveillance methodology to be used for surveillance of Contractor performance. 2.1.10 QUALITY CONTROL: All necessary measures taken by the Contractor to assure that the quality of an end product or service shall meet contract requirements. 2.1.11 SUBCONTRACTOR: One that enters into a contract with a prime Contractor. The Government does not have privity of contract with the Subcontractor. 2.1.12 WORK DAY: The number of hours per day the Contractor provides services in accordance with the contract. 2.1.13 WORK WEEK: Sunday through Saturday PART 3 GOVERNMENT FURNISHED PROPERTY, EQUIPMENT, AND SERVICES 3. GOVERNMENT FURNISHED ITEMS AND SERVICES: 3.1 Services: The Government will provide on-site personnel to assist in the initial orientation of contracted staff and facility maintenance. PART 4 CONTRACTOR FURNISHED ITEMS AND SERVICES 4. CONTRACTOR FURNISHED ITEMS AND RESPONSIBILITIES: 4.1 General: The Contractor shall furnish all supplies, equipment, facilities and services required to perform work under this contract that are not listed under Section 3 of this SOW. 4.2 Materials: The Contractor shall furnish materials, supplies, and equipment necessary to meet the requirements under this SOW. PART 5 SPECIFIC TASKS 5. SPECIFIC TASKS: 5.1 Basic Services: The Contractor shall provide services for all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to provide certified/licensed personnel who maintain required standardized lifeguard and basic lifesaving designations for implementation as defined in this SOW except for those items specified as government furnished property and services. The Contractor should provide updates to personnel files as needed; and maintain all education of staff needed at time of award. PART 6 APPLICABLE PUBLICATIONS 6. APPLICABLE PUBLICATIONS (CURRENT EDITIONS) 6.1 The Contractor must abide by all applicable regulations, publications, manuals, and local policies and procedures. 6.2 Closures: Contractor reserves the right to close the pool in an emergency situation to include inclement weather, breakdown of equipment, inadequate security for the protection of the lifeguards at the facility, violation of local or state ordinance, or any other condition or circumstances which, in the judgment of Contractor, endangers the health or safety of the lifeguards or patrons and this shall not constitute a breach by Contractor. PART 7 ATTACHMENT/TECHNICAL EXHIBIT LISTING Attachment/Technical Exhibit List: 7.1 Attachment 1/Technical Exhibit 1 Performance Requirements Summary TECHNICAL EXHIBIT 1 Performance Requirements Summary The Contractor service requirements are summarized into performance objectives that relate directly to mission essential items. The performance threshold briefly describes the minimum acceptable levels of service required for each requirement. These thresholds are critical to mission success. Performance Objective The Service required usually a shall statement Standard Performance Threshold This is the maximum error rate. It could possibly be zero deviations from standard Method of Surveillance PRS # 1 The Contractor shall develop and maintain an effective quality control program to ensure services are performed in accordance with SOW paragraph 1.6.1 1.6.1 Quality Control No more than one customer complaint per report. Validated Customer Complaint received by COR PRS # 2 The Contractor shall provide Quality Assurance SOW paragraph 1.6.2 1.6.2 Quality Assurance Surveillance Plan No more than one customer complaint per report. Validated Customer Complaint received by COR PRS # 3 The Contractor shall provide Lifeguard Services with updated Certifications as needed that meet current industry standards, requirements and law. Contractor will also provide any and all maintenance with regard to the pool pump, pool chemicals, pool chemical level recording within federal guidelines.
