- Sources Sought Notice, VAMC San Juan Puerto Rico Phase 5 Parking Structure This is a two-part Sources Sought Notice: 1) Market Research Sources Sought; 2) Project Labor Agreements (PLA) Sources Sought Part 1: The Department of Veterans Affairs (VA), Office of Construction and Facilities Management is looking for potential small, bondable, and experienced businesses certified in the following categories: (1) Service Disabled Veteran Owned Small Business (SDVOSB), (2) Veteran Owned Small Business (VOSB), (3) Small Disadvantaged Business (SDB) including 8(a), (4) HUBZone, and (5) Woman Owned Small Business (WOSB) for design-build construction of a new parking structure at the VA San Juan Medical Center, Puerto Rico, Project No. 672-085E. The firm must be a General Construction Firm with an approved NAICS Code 236220, Small Business Size Standard of $36.5 million and a bonding capacity sufficient to bond 100% of the proposed cost to perform this work. The estimated cost for this project is between $20,000,000 and $50,000,000. The project includes Construction of a new Parking Structure addition at the VA Caribbean Healthcare System VACHS San Juan Medical Center, PR. The structure will be second phase of the existing parking structure completed in March of 2016 and will accommodate approximately 776 additional vehicles. The proposed structure shall consist of drilled-reinforce concrete piles, cast-in-place post-tensioned concrete beams and slabs, cast-in-place concrete columns and shear walls, seven (7) parking decks. Scope will include the demolition and removal of a 20,000-gallon underground fuel oil storage tank. A new hazardous material holding building (approximately 1000 SF) shall be constructed and the existing hazardous storage building must be demolished. Construction activity shall allow for maintaining full operation of the existing facility. There are one base bid item and two (2) add alternates as follows: CLIN 001 Base Bid Item General Construction; CLIN 002 Add Alternate 1 Vegetated Green Walls; CLIN 003 Add Alternate 2 Photo Voltaic Array This is a Market Survey and if you are a Small business contractor having the skills and capabilities necessary to perform the stated requirements including the NAICS code and size standard for small business you are invited to provide information to contribute to this market survey/sources sought. Construction experience of similar projects in size and complexity Industry Day All interested parties are invited to the Department of Veteran Affairs (VA), Construction and Facilities Management (CFM) Industry Day Forum to discuss the construction process for the VAMC San Juan Puerto Rico Phase 5 Parking Structure VA will host an Industry Day Forum to discuss the upcoming VAMC San Juan Puerto Rico Phase 5 Parking Structure construction procurement. This Industry Day Forum will be used for market research to give CFM the opportunity to engage with contractors to determine overall interest in the project, experience with cemetery construction, capacity to successfully accomplish the work, and small business participation. The Industry Day Forum is tentatively scheduled to take place on February 20, 2019 at 10:00 AM at the following location: VA Medical Center, 10 Casia Street, San Juan, PR 00921 Please respond with your intent to attend to Derek Underwood, Contracting Officer at Derek.Underwood2@va.gov. Part 2: A PLA is defined as a pre-hire collective bargaining agreement with one or more labor organizations that establishes the terms and conditions of employment for a specific construction project and is an agreement described in 29 U.S.C 158(f). Federal Acquisition Regulation (FAR) Policy: (a) Project Labor Agreement (PLA) is a tool that agencies may use to promote economy and efficiency in Federal procurement. Pursuant to Executive Order 13502, agencies are encouraged to consider requiring the use of project labor agreements in connection with large-scale construction projects. (b) An agency may, if appropriate, require that every contractor and subcontractor engaged in construction on the project agree, for that project, to negotiate or become a party to a project labor agreement with one or more labor organizations if the agency decides that the use of project labor agreements will (1) Advance the Federal Government's interest in achieving economy and efficiency in Federal procurement, producing labor-management stability, and ensuring compliance with laws and regulations governing safety and health, equal employment opportunity, labor and employment standards, and other matters; and (2) Be consistent with law. Reference: Provision: 52.222-33 Notice of Requirement for Project Labor Agreement Clause 52.222-34 Project Labor Agreement. Responses to this labor market survey will be used by the Government to make appropriate acquisition decisions. All interested sources must respond to future solicitation announcements separately from responses to this survey. (5) Does the local market contain the sufficient number of available skilled workers for this project? a. Are the other projects in the vicinity going to limit the pool of skill labor available for your project? (6) Has a project like this been done before in the local market? (7) What investments have been made to support registered apprenticeship programs? (8) Will the completion of the project require an extended period of time or have sensitive deadlines? (9) Have PLAs been used on comparable projects undertaken by the public or private sector in this geographic region? Have PLAs been used on this type of project in other regions? (10) Which CBAs are likely to expire during the course of the project under consideration that might cause delays? (local building trades and contractors can provide information) (11) How do prevailing wage rates in the local market compare to Davis Bacon rates? a. What impact does unionization in the local market have on wages? (12) Could a PLA contribute to cost savings in any of the following ways? a. Harmonization of shifts and holidays between the trades to cut labor costs? b. Minimizing disruptions that may arise due expiration of CBA? c. Availability of trained, registered apprentices, efficient for highly skilled workforce? d. Allowing for changes in apprentice to journeyman ratio. e. Serving as a management tool that ensures highly skilled workers from multiple trades are coordinated in the most efficient way? f. Other? (13) Could a PLA minimize risk and contribute to greater efficiency in any of the following ways? a. Mechanisms to avoid delays b. Complying with labor standards, safety rules and EEO laws. c. Ensuring a steady supply of skilled labor in markets with low supply or high competition for workers. (14) Are there ways in which a PLA might increase costs on this particular project?
