1E, Inc. PPMP Software Maintenance Control Number: TAC-19-53218 2 of 5 1E, Inc. PPMP Software Maintenance Control Number: TAC-19-53218 JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY 1. Contracting Activity: Department of Veterans Affairs (VA) Office of Procurement Acquisition and Logistics Technology Acquisition Center 1701 Directors Blvd Austin, TX 78744 2. Description of Action: This proposed action is for a firm-fixed-price delivery order to be issued under the National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) V Government Wide Acquisition Contract (GWAC) for the renewal of maintenance for VA owned 1E, Inc Night Watchman Power and Patch Management Pack (PPMP) software. 3. Description of the Supplies or Services: VA Office of Information Technology (OI&T) Enterprise Systems Engineering (ESE) has a requirement to renew software maintenance on 350,000 VA-owned 1E, Inc. PPMP perpetual software licenses. The Contractor shall provide software maintenance that includes security patches and software updates. The maintenance support shall be available via the manufacturer s website, e-mail and telephone 24x7 with a 4-hour response time to reported issue(s). This effort is for services only, no software will be renewed or procured under this proposed action. The base period of performance is from January 15, 2019- January 14, 2020. The total estimated value of this action, including one 12-month option period, is $1,568,092.00. 4. Statutory Authority: Pursuant to Federal Acquisition Regulation (FAR) Subpart 16.505(a)(4), the following brand name requirement is being justified and approved as an exception to fair opportunity under the statutory authority of Section 41 U.S.C. 4106(c)(2) as implemented by FAR Subpart 16.505(b)(2)(i)(B), entitled Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized. 5. Rationale Supporting Use of Authority Cited Above: Based on market research, as described in section 8 of this justification, limited competition is viable among authorized resellers for 1E, Inc. PPMP software maintenance support. System Center Configuration Manager (SCCM) is a VA Enterprise-wide systems management tool used for security patch management, software distribution, operating system deployment, software and hardware asset management, configuration management, remote control, Enterprise reporting, and power management. Since 2011, OI&T ESE has deployed the 1E, Inc. PPMP to a majority of its desktops. The VA-owned 1E, Inc. PPMP software licenses support the Government s ability to meet power management capabilities and comply with the Office of Management and Budget (OMB) energy management mandates and White House Executive Orders #13423 and #13514 for the greening of the VA IT environment. As such, the 1E, Inc. software licenses provide VA a remote power-up and graceful power-down capability for computer workstations and increase the effectiveness of security patching. The software also provides an integrated capability that can be used for power saving scheduling and provides reporting on estimated savings. This software, in conjunction with SCCM, allows workstations to be powered down at the end of a workday, powered up, and patched, and enables remote software installations, followed by shut down. This permits remote installs or security scans to occur after normal duty hours while still saving energy. The software also monitors energy usage, energy savings, and provides related reporting. 1E, Inc. s PPMP software is a proprietary software product; therefore, no other software maintenance provider has the proprietary code to provide the necessary support. This code is needed to ensure any services provided on the software are properly configured. This code is also required to ensure all updates and patches are properly pushed through to the fielded software. Only 1E and authorized resellers of 1E, Inc. s products can provide 1E PPMP software maintenance support. 1E, Inc. PPMP software maintenance is critical to ensure the software is properly configured and running properly. 1E, Inc. owns the proprietary property rights to the PPMP software. The maintenance support of the 1E, Inc. software is critical for ESE to effectively carry out its operations. 6. Efforts to Obtain Competition: Market research was conducted, details of which are in section 8 of this justification. This effort did not yield any additional sources that can meet the Government's requirements. However, the undersigned VA technical representative determined that limited competition is available among authorized resellers. In accordance with FAR 16.505(a)(4)(iii)(A)(1), this justification will be provided with the solicitation to all appropriate NASA SEWP V GWAC holders. Furthermore, in accordance with FAR 5.301, 16.505(b)(2)(ii)(D), and 16.505(a)(4)(iii), the award notice for this action will be synopsized on the Federal Business Opportunities website and this justification will be made publicly available within 14 days of award. 7. Actions to Increase Competition: The Government will continue to conduct market research to ascertain if there are changes in the marketplace that would enable future actions to be competed. 8. Market Research: Government technical experts conduct market research in October of 2018 by reviewing other similar software maintenance agreements and opportunities to ascertain if other software products could meet the Government s requirements. Specifically, the Government s technical experts conducted web-based research on other commercial software maintenance including Adaptiva s Green Planet and Faronics Power Save Enterprise, concluding that no other vendor other than 1E, Inc. can provide software maintenance support on 1E, Inc. software due to the proprietary constraints as outlined in section 5 of this justification. Additionally, Government technical experts engaged in communications with 1E, Inc. and its authorized resellers. As a result of this market research, the technical experts confirmed that the source code required to issue the software maintenance to VA owned 1E, Inc. PPMP software licenses is proprietary. As, such 1E, Inc. or an authorized reseller is the only source capable of providing the required maintenance and support for 1E, Inc. Night Watchman PPMP software licenses. Based on the above, only 1E, Inc. software maintenance meets all the Government s requirements. The Contract Specialist (CS) conducted market research in December 2018 by using the SEWP market research tools. Based on this market research, the CS found multiple resellers under SEWP capable of meeting the full requirement. 9. Other Facts: None. 10.
