Page 3 of 3 NOTICE OF INTENT TO SOLE SOURCE: The Department of Veterans Affairs Network Contracting Office 4, 1700 South Lincoln Avenue, Lebanon, PA 17042, intends to award a sole source Firm-Fixed-Price Contract to ScriptPro USA Inc. for the provision of ScriptPro product maintenance at the Wilkes-Barre VA Medical Center (VAMC), located at 1111 East End Blvd., Wilkes-Barre, PA 18702. This contract action is for services for which the Government intends to solicit from only one source under the authority of FAR 6.302-1, Single Source Awards. Interested parties may identify their interest and capability to respond to the requirement or submit proposals. The North American Industry Classification System (NAICS) for this requirement is 811219 with a small business size standard of $20.5 million. THIS NOTICE OF INTENT IS NOT A REQUEST FOR COMPETITIVE QUOTATIONS. Responsible sources may identify their interest by submitting capability information by 3:00 P.M., EST, on Monday, March 4, 2019, in order to establish sources that meet this requirement. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. The Government will not be responsible for any costs associated with the preparation of responses to this notification. Order against: FSS Contract Number: V797P-4237B Name of Proposed Contractor: SCRIPTPRO USA INC Street Address: 5828 REEDS ROAD City, State, Zip: MISSION, KS 66202 Phone: 800-606-7628 Description of Supplies or Services: The Annual Estimated Value is: ***REDACTED***. The Total Estimated Contract Value: ***REDACTED***. Our facility currently has a number of ScriptPro workstations housed in our Outpatient pharmacy department, and we use them to keep up with the high quantity of prescriptions that are filled on a daily basis. we have used the ScriptPro workstations for a number of years and we would like to add the new maintenance contract since our current maintenance contract will ***REDACTED***. Authority: ORDER AGAINST FSS: Authority of the Multiple Award Schedule Program, Title III of the Federal Property and Administrative Services Act of 1949 (41 USC 251, et seq.); Title 40 USC 501, Services for Executive Agencies; and Section 803 of the National Defense Authorization Act of 2002 (PL 107-107) and implemented by FAR 8.405-6. Mark the applicable exception: An urgent and compelling need exists, and following the procedures would result in unacceptable delays(FAR 8.405-6(a)(1)(i)(A); Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; (FAR 8.405-6(a)(1)(i)(B)); In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order and the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order was not previously issued under sole-source or limited-sources procedures (FAR 8.405-6(a)(1)(i)(C)); or Items peculiar to one manufacturer. An item peculiar to one manufacturer can be a particular brand name, product, or a feature of a product, peculiar to one manufacturer). A brand name item, whether available on one or more schedule contracts, is an item peculiar to one manufacturer (FAR 8.405-6(b)). Rational/explanation to support cited authority The equipment that requires services has been previously purchased from ***REDACTED***. ScriptPro USA Inc. holds a National Acquisition Center (NAC) contract for the related products and required service. The entity was contacted and they provided a written statement that verifies two (2) vendors that are only authorized to provide ScriptPro products, but does not include services. ScriptPro equipment is proprietary and is the only authorized vendor to provide the services. If another vendor were to provide the maintenance service on the ScriptPro equipment, other than the authorize vendor (***REDACTED***), it voids the warranty for the equipment and software. In accordance with FAR 6.302-1 and FAR 8.405-6(a)(1)(i)(B), no other vendor is capable of providing the required service. To satisfy FAR 19.1405, 15 U.S.C. § 657f, 38 U.S.C. § 8127 & 8128, a Sources Sought Notification was posted onto FBO.gov. By the close of the Sources Sought Notification, only two (2) entities responded, ***REDACTED*** (Large Business) and ***REDACTED***. For the NAICS, 811219, ***REDACTED*** is listed a Small Business (reference SAM.gov, DUNS: ***REDACTED***), but does not fit in with the SDVOSB/VOSB socioeconomic category. ***REDACTED*** did not have, or provide, any information that shows they hold a Federal Supply Schedule. A letter from the Senior Contract Administrator, ***REDACTED***, was provided to the Program Office. In it, ***REDACTED*** list two (2) SDVOSBs as resellers but not authorized to carry out services on ScriptPro equipment. ***REDACTED*** states that the warranty of the equipment and software would be void if another party, other than ***REDACTED***, were to perform services, due to proprietary information. Note that this determination satisfies the requirements of FAR 8.405-6. The requirement to prepare a written justification IAW FAR 6.303 does not apply to Federal Supply Schedules. ***REDACTED*** Date NCO 4 NOTE: THIS NOTICE WAS NOT POSTED TO FEDBIZOPPS ON THE DATE INDICATED IN THE NOTICE ITSELF (27-FEB-2019); HOWEVER, IT DID APPEAR IN THE FEDBIZOPPS FTP FEED ON THIS DATE.
