- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The solicitation number for this procurement is 140A0318R0001 and is issued as a Request for Proposals (RFP). The Bureau of Indian Affairs (BIA), Southern Plain Regional Office intends to award a firm-fixed price contract in response to this Request for Quote (RFP). The solicitation documents and incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC 2005-101 dated October 25, 2018. This solicitation is an Indian Small Business Economic Enterprise (ISBEE) set-aside. Under the Buy Indian Act, 25 U.S.C. 47, offers are solicited only from Indian Economic Enterprises (Subpart 1480.8) that are also small business concerns. Any acquisition resulting from this solicitation will be from such a concern. Offers received from enterprises that are not both Indian economic enterprises and small business concerns will not be considered and will be rejected. As part of your quote, you must complete and return the Indian Economic Enterprise Representation form (DIAR Clause 1452.280-4 (see attached)). The associated North American Industry Classification System code (NAICS) is 561612, Security Guard and Patrol Services, and the size standard is $20.5 Mil. Guards shift begins at 8:00 am and end at 4:30 pm local time, Monday - Friday, excluding federal holidays. The Contractor / Licensed Unarmed Security Guard's role shall be to mitigate / minimize any events or situations the Contractor or Anadarko Agency staff find threating or disruptive, until the arrival of the Bureau of Indian Affairs (BIA) Law Enforcement if deemed necessary. The Contractor / Licensed Unarmed Security Guards have no arresting and apprehension powers. The Contractor must be able to operate various screening equipment (provided by the government) and technology to detect dangerous objects in bags, purses and on clients and preventing those objects from being brought into the building. The Contractor shall control access to the facility by verifying the identity and purpose of individuals seeking entry maintain log of all visitors and provide visitor passes. Deny entry to individuals not authorized to have access to the building. The Contract/Licensed Unarmed Security Guards must patrol the visitor waiting areas hourly throughout the day to ensure the safety of the staff and visitors. Guards must keep a detailed time log of the patrols, noting any events and/or concerns of interest. Contractor must perform a complete end of day walk through of the Anadarko Agency areas prior to departing at 4:30 PM. Guards must respond to all visitor disruptive behavior incidents within the agency to minimize the situation or until law enforcement arrives. Guards shall be competent and have the ability to make independent determinations on whether the situation warrants the support of the BIA, Law Enforcement or 911 call, or neither. In the event of a disruptive situation deemed to require security assistance, the Contractor / Licensed Unarmed Security Guard shall immediately contact the BIA, Law Enforcement via phone then attempt to mitigate / minimize any events or situations, until the arrival of Law Enforcement. All duties and responsibility become that of the BIA, Law Enforcement upon arrival. If the situation is deemed hostile and could result in an imminent life or death situation, the Contractor shall call 911, and then attempt to mitigate / minimize any events or situations, until the arrival of BIA, Law Enforcement. All duties and responsibility become that of the BIA, Law Enforcement upon arrival. Guards may be required to escort staff/visitors to parking lot, if requested. Provide assistance, directions, answer questions and otherwise serve as a central or visible source of general information for employees, visitors and vendors. QUALIFICATIONS: All Contractor personnel must have relevant experience performing the unarmed security services. Minimum Qualification Standards: Security guards employed by the Contractor shall meet the following minimum qualification standards: Education/Experience: Possess a high school diploma or equivalency and have two (2) year's experience demonstrating: The ability to interact with the public. The ability to read, understand and apply printed rules, detailed orders, instructions, and training material. The ability to maintain poise and self-control under stress. The ability to construct and write clear, concise, accurate, and detailed reports. Age: All Contractor personnel performing under this contract shall be a minimum of 18 years of age and be qualified as required by local and state laws. Training: All personnel assigned to work under this contract shall have completed Phase I and II training (20 hours each) and passed the Phase I/II Unarmed Security Guard Exam prior to an assignment. For any replacement personnel, the Contractor shall be responsible for hiring/training/licensing the guards. License: The Contractor shall provide a list of names of all security guards and their security guard licenses ten days prior to the start of the Period of Performance. The Contractor is responsible for keeping the guards licenses update/renewed. The list should have only guards listed that will undergo a complete background check. No guard shall be authorized to work at the agency without an approved background check. CONTRACTOR PERSONNEL: Contractor personnel working under this contract shall not be considered BIA employees for any purpose and shall be considered employees of the Contractor. All Contractor personnel assigned to the performance of this contract shall wear a Contractor-provided uniform that clearly identifies the individual as a Contractor. Contractor personnel shall present a neat appearance, to include no visible tattoos, ear rings, serviced beards, no unprofessional hair-cuts, styles and hair colors. Contractor personnel shall wear distinctive clothing such as uniform, badges, patches, etc. Such uniform shall clear identify the individual as a Contractor. The cost for the uniform and associated items will be borne by the Contractor in accordance with the Service Contract Act. The Contractor shall ensure that the staff assigned shall be cognizant of the BIA's sexual harassment and drug-free workplace policies. Consumption of alcohol on BIA property is prohibited. The contractor shall be immediately notified of any guard that reports for duty and appears to be impaired. If the Guard uses tobacco, he/she must comply with the BIA's tobacco use policy. The Contractor shall ensure the post is filled each duty day and shall have means to augment the post should the employee be sick or on vacation. CONTRACTOR'S RESPONSIBILITIES: The Contractor shall be licensed and insured as prescribed by the State of Oklahoma and the terms and conditions of the contract. Contractor shall take all precautions necessary to protect persons and property from injury or damage during the performance of this contract. Contractor shall be responsible for any injury to himself/herself, his/her employees, or others, as well as for any damage to personal or public property that occurs during the performance of the contract that is caused by him/her or his/her employees fault or negligence. Contractor shall comply with all BIA safety standards, industry standards, and state & local laws. The Contractor shall provide supervision for all guards and serve as a liaison between the BIA and Security Guards with respect to any and all issues, concerns and relevant information including communicating/enforcing BIA policies and procedures to the guards. If there are any problems that need to be corrected, the Contractor shall report to the Contracting Officer Representative (COR). BIA shall reserve the right, at its sole discretion, to require the contractor to remove any guard for any lawful reason and request a suitable replacement. BACKGROUND INVESTIGATION: After the contract award but prior to the Period of Performance, the Contractor shall be required to contact the Anadarko Agency to obtain the necessary paperwork to complete and submit for the Government Background investigation for any and all personnel that might be providing services under this contract. This could be a 30-45 day process. The Anadarko Agency will be providing a badge and access card for those that have an approved background clearance. DOI POLICY: Possession of weapons is prohibited. Enclosed containers are subject to search. Violations of BIA regulations may result in citations answerable in the United States (Federal) District Court. When a Holiday falls on a Sunday, the following Monday shall be observed as a legal Holiday. The office may also close for inclement weather. INTERFERENCE TO NORMAL FUNCTION: The Contractor may be required to interrupt their work at any time so as not to interfere with the normal functioning of the facility, including utility services and fire protection systems. Contractor personnel shall inform the COR of the need to gain access to secured areas. If access is required to secure areas, prearranged scheduling shall be made with the COR or their designee. Period of Performance: Base year, January 21, 2019 - January 20, 2020, and four option years Work is to be performed during a regular eight (8) hour work day, commencing no earlier than 8:00 a.m. and ending no later than 4:30 p.m. The Contractor must adhere to the Federal schedule for holidays, time off due to inclement weather conditions, building closures, etc. Location: Bureau of Indian Affairs, Anadarko Agency, Hwy 281 & Parker McKenzie Drive, Anadarko, OK 73005 (Caddo County). PROVISION FAR 52.212-1 -- INSTRUCTIONS TO OFFERORS -- COMMERCIAL ITEMS, applies to this acquisition. FAR 52.212-2 - EVALUATION - COMMERCIAL ITEMS (OCTOBER 2014) (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: (i) Factor 1: Technical Capability (ii) Factor 2: Past Performance (iii) Factor 3: Price Factor 1 - Technical Capability The offers will be evaluated using the information submitted in the technical approach and demonstrated experience/evidence of ability to successfully perform the services by addressing the following elements: 1) Expertise: What is the Contractor's level of expertise in this field? This includes key personnel (submit information on qualified key personnel, such as resumes and licenses). 2) Scheduling: What is the Contractor's proposal to accommodate duty-hours, shift-change, breaks, employee meal breaks, and response to incidents, or emergencies? 3) Subcontracting: Does the Contractor plan to subcontract out any portion of the work? If so, do they have a letter of commitment from the subcontractor indicating their commitment to this project upon award? Factor 2 - Past Performance The past performance questionnaires that the contractor submits with their proposal package will be reviewed to determine if the previous work was recent (within the past 5 years) and relevant (similar size and magnitude). The questionnaires will also be reviewed to determine the overall trend in the ratings of quality for the previous contracts. The offeror shall include a minimum of three, but no more than five questionnaires. In addition, the Government may solicit past performance on contracts not listed by the offeror. If an offeror does not have any past performance information to submit as the entity under which the offer is being submitted, then the offeror should submit past performance data identified above under which the offeror's key personnel have worked. The offeror's proposal will be evaluated to determine the extent to which its past performance demonstrates the likelihood of successful performance. The evaluation will consider both the relevance and quality of past contracts. The Government may choose to evaluate publicly available reports, and/or data from the Past Performance Information Retrieval System (PPIRS). The Government may use present and/or past performance data obtained from a variety of sources. The information gathered for past performance may also be used in the responsibility determination. Factor 3 - Price Schedule The pricing information will consist of the contractor ¿s overall price to provide these services. To submit the pricing information, fill out the price schedule with the unit price and calculate the extended total. Technical capability and past performance, when combined, are approximately equal to cost or price. (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). The offeror shall submit pricing for the base period and all option periods, including option pricing for an additional 6-month period that may be authorized IAW FAR 52.217-8. See FAR 52.217-8 which authorizes the Government to require continued performance of any services within the limits and at the rates specified in the contract. The pricing proposal should include a separate line item for the additional 6-month period IAW FAR 52.217-8. (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days of contract expiration date. (End of clause) 52.217-9 Option to Extend the Term of the Contract. As prescribed in 17.208(g), insert a clause substantially the same as the following: OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000) (a) The Government may extend the term of this contract by written notice to the Contractor within 15 days of contract expiration date; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 45 days before the contract expires. The preliminary notice does not commit the Government to an extension. (b) If the Government exercises this option, the extended contract shall be considered to include this option clause. (c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed five years. As prescribed in section 1401.670-1, insert the following clause: Authorities and Delegations (SEP 2011) (a) The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work. (b) The Contracting Officer will designate a Contracting Officer's Representative (COR) at time of award. The COR will be responsible for technical monitoring of the contractor's performance and deliveries. The COR will be appointed in writing, and a copy of the appointment will be furnished to the Contractor. Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment. (c) The COR is not authorized to perform, formally or informally, any of the following actions: (1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract; (2) Waive or agree to modification of the delivery schedule; (3) Make any final decision on any contract matter subject to the Disputes Clause; (4) Terminate, for any reason, the Contractor's right to proceed; (5) Obligate in any way, the payment of money by the Government. (d) The Contractor shall comply with the written or oral direction of the Contracting Officer or authorized representative(s) acting within the scope and authority of the appointment memorandum. The Contractor need not proceed with direction that it considers to have been issued without proper authority. The Contractor shall notify the Contracting Officer in writing, with as much detail as possible, when the COR has taken an action or has issued direction (written or oral) that the Contractor considers to exceed the COR's appointment, within 3 days of the occurrence. Unless otherwise provided in this contract, the Contractor assumes all costs, risks, liabilities, and consequences of performing any work it is directed to perform that falls within any of the categories defined in paragraph (c) prior to receipt of the Contracting Officer's response issued under paragraph (e) of this clause. (e) The Contracting Officer shall respond in writing within 30 days to any notice made under paragraph (d) of this clause. A failure of the parties to agree upon the nature of a direction, or upon the contract action to be taken with respect thereto, shall be subject to the provisions of the Disputes clause of this contract. (f) The Contractor shall provide copies of all correspondence to the Contracting Officer and the COR. (g) Any action(s) taken by the Contractor, in response to any direction given by any person acting on behalf of the Government or any Government official other than the Contracting Officer or the COR acting within his or her appointment, shall be at the Contractor's risk. (End of clause). 1452.228-70 Liability Insurance. As prescribed in 1428.301, insert the following clause: Liability Insurance-Department of the Interior (JUL 1996) (a) The Contractor shall procure and maintain during the term of this contract and any extension thereof liability insurance in form satisfactory to the Contracting Officer by an insurance company which is acceptable to the Contracting Officer. The named insured parties under the policy shall be the Contractor and the United States of America. The amounts of the insurance shall be not less than as follows: $200,000 each person $500,000 each occurrence $20,000 property damage (b) Each policy shall have a certificate evidencing the insurance coverage. The insurance company shall provide an endorsement to notify the Contracting Officer 30 days prior to the effective date of cancellation or termination of the policy or certificate; or modification of the policy or certificate which may adversely affect the interest of the Government in such insurance. The certificate shall identify the contract number, the name and address of the Contracting Officer, as well as the insured, the policy number and a brief description of contract services to be performed. The contractor shall furnish the Contracting Officer with a copy of an acceptable insurance certificate prior to beginning the work. (End of clause) 1452.233-2 Service of Protest. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Items included in commercial item contracts. Under this contract, the following documents are required to be submitted as an attachment to the IPP invoice: - A copy of the contractor's official company invoice reviewed and accepted by the designated COR The Contractor must use the IPP website to register, access and use IPP for submitting requests for payment. The Contractor Government Business Point of Contact (as listed in SAM will receive enrollment instructions via email from the Federal Reserve Bank of Boston (FRBB) within 3 - 5 business days of the contract award date. If the Contractor is unable to comply with the requirement to use IPP for submitting invoices for payment, the Contractor must submit a waiver request in writing to the Contracting Officer with its proposal or quotation. OMB MEMORANDUM M-11-32 Accelerating Payments to Small Businesses for Goods and Services This policy requires agencies to accelerate payment to small business prime contractors to the full extent permitted by law with the goal of making payment within 15 days of receipt of a proper invoice. In return, prime contractors are expected to accelerate payment to small business subcontractors when they receive accelerated payments from the Government.
