- Description: Army Contracting Command - Aberdeen Proving Ground (ACC-APG), Huachuca Division, DOC Operations Branch intends to award a noncompetitive sole source contract to Frequentis USA, Inc 8661 Robert Fulton Drive Ste 100, Columbia MD 21046-2900. This requirement will provide the specialized parts which provide the Air Traffic Controllers necessary weather information. The statutory authority permitting other than Full and Open Competition is FAR 13.106-1(b)(1): For purchases not exceeding the simplified acquisition threshold (SAT), only one source reasonably available, urgency, exclusive licensing agreements, brand name, or industrial mobilization. The purchase of equipment from any other source would void the warranty of the current equipment. The North American Industrial Classification System (NAICS) code for this procurement is 334290. This notice of intent is not a request for proposals or quotations and a solicitation will not be issued for this requirement. Any responses or inquiries to this notice must demonstrate clear and convincing evidence that competition will be advantageous to the Government. The Government will not pay for information submitted. A determination by the Government not to compete this procurement action, based on responses to this notice, is solely within the discretion of the Government.
