- DEPARTMENT OF VETERANS AFFAIRS Justification for Single Source Awards IAW FAR 13.106-1 For Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K) Acquisition Plan Action ID: 36C249-19-AP-1104 1. Contracting Activity: The Department of Veterans Affairs, Network Contracting Office located in Murfreesboro, Tennessee intends to issue a sole source firm fixed priced commercial item contract to BioMerieux Vitek, Inc., 595 Anglum Dr., Hazelwood, MO 63042 for PM Services for BioMerieux laboratory equipment for the Robley Rex VA Medical Center Louisville located at 800 Zorn Avenue, Louisville, Kentucky 40206. The requirement will be sole sourced to BioMerieux, Inc. due to urgent and compelling need and this vendor is the manufacturer and sole provider of this existing equipment used at the VA. Service will be provided immediately. This justification for single source award will be posted to FedBizOpps. 2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: Contractor shall furnish all labor, transportation, parts, and expertise necessary to provide onsite preventive maintenance, emergency (unscheduled) repair, and telephone support of the BioMerieux equipment. This repair service will be provided form 3/19/2019 through 3/18/2020. The estimated amount is $29,748.00. 3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: BioMerieux, Inc. is the sole source manufacturer and maintenance provider of the Vitek 2, BacT / Alert 3D instruments. All BioMerieux Field Service Engineers are certified and qualified with extensive factory trained experience in working on the entire range of BioMerieux products including the Vitek 2 and BacT /Alert instruments. Biomerieux, Inc. as the manufacturer of the equipment requires (1) Preventative Maintenance Inspection to be performed on an annual basis for the BacT/ALERT 3D Combo w Observa(FSA) and BacT / ALERT 3D Incubator (FSA) for the Vitek 2 XL, the equipment requires (2) Preventative Maintenance Inspections to be performed on a 6 month interval. 4. Description of market research conducted and results or statement why it was not conducted: Limited market research was conducted due to unusual and compelling urgency of the requirement. Hospital leadership has concurred on the urgent and compelling need of this requirement. A search on Vetbiz.gov was conducted using NAICS code 811219 Other Electronic and Precision Equipment Repair and Maintenance and the keyword Biomerieux. The search revealed zero (0) SDVOSB/VOSB registered under this NAICS code. A search on SB Dynamic Small Business website was conducted using NAICS code 811219 and the keyword Biomerieux. The search revealed zero (0) registered under the NAICS code. Market Research revealed 1 large vendor (BioMerieux, Inc.) that can provide services for preventative maintenance calls and visits for laboratory equipment. 5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b).
