Description
SAP Business Objects Licenses and Maintenance Control Number TAC-19-54794 11 of 12 Control Number TAC-19-54794 JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION 1. Contracting Activity: Department of Veterans Affairs (VA) Office of Procurement Acquisition and Logistics Technology Acquisition Center 23 Christopher Way Eatontown, NJ 07724 2. Description of Action: The proposed action is for firm-fixed price (FFP) Delivery Order (DO) issued under the National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) V Government Wide Acquisition Contract (GWAC) to acquire brand name SAP Business Object Enterprise Licenses and associated secure enterprise annual maintenance support services. 3. Description of Supplies or Services: The Department Of Veterans Affairs, Office of Information & Technology (OI&T), IT Operations and Services (ITOPS), Service Operations (SO), Infrastructure Operations (IO), Enterprise Web Infrastructure Support (EWIS) has a requirement to procure brand name SAP Business Objects Enterprise perpetual licenses for 120 Windows users including associated secure enterprise maintenance support services. SAP software has been incorporated into a production environment consisting of the VA Patient Advocacy Tracking (PATs), Veterans Personal Finance System (VPFS), and Blind Rehabilitation (BR) Systems since their inception in 2006. The licensing for existing SAP products has expired within the legacy Windows Server 2003 environment therefore new licensing for the Windows Server 2016 environment is required to allow the VA to upgrade the existing operating systems from Windows Server 2003 to Windows Server 2016. All peripheral and Back-office software will be upgraded simultaneously in order to ensure VA is fully compliant with National Institute of Standards and Technology (NIST) security requirements. Peripheral backoffice software includes but is not limited to Oracle, Microsoft SQL, WebLogic, and several other related middleware applications. The Contractor shall provide secure enterprise support which includes software updates, upgrades, and patches, as well as online and telephone technical support services available 24 hours per day, seven days per week, 365 days a year (24x7x365). The period of performance for this action is a 12-month base period with two, 12-month option periods for continued maintenance support services. The total estimated price of the proposed action, inclusive of the options, 4. Statutory Authority: Pursuant to Federal Acquisition Regulation (FAR) Subpart 16.505(a)(4), the following brand name requirement is being justified and approved as an exception to fair opportunity under the statutory authority of Section 41 U.S.C. 4106(c)(2) as implemented by FAR Subpart 16.505(b)(2)(i)(B), entitled Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized. 5. Rationale Supporting Use of Authority Cited Above: Based on market research, as described in paragraph 8 of this document, VA determined that limited competition is available among resellers for the required brand name SAP Business Objects Enterprise licenses and associated maintenance support services. The SAP software has been incorporated into a production environment consisting of the VA PATs, VPFS, BR, since their inception in 2006 which are customized VA solutions to maintain veteran patient records and veteran banking information. SAP Business Object software is integrated within the production environment and provides patient record print functionalities and the automated reporting capabilities to allow VA medical centers (VAMCs) to print medical records and VA to generate customizable reporting capabilities for congressional review. The existing SAP licenses have expired, and therefore new SAP licenses are required to support an upgrade to the Windows Server 2016 environment. Only SAP software will allow for the seamless integration of these critical reporting capabilities within the production environment and ensure continued, uninterrupted operation, service and functionality as the applications that make up this legacy environment are migrated to Windows 2016. Replacing SAP with any other brand software would require extensive reengineering of the production environment in addition to training hundreds of VAMC personnel resulting in duplicative costs that would not be recovered through competition, as well as significant project delays, potential data loss, and the unacceptable risk of interrupted application functionality for Veteran s patient care and benefits. In addition, only SAP can provide the requisite software maintenance as no other vendor has the ability or data rights to access the software source code in order to develop and push software updates, patches, or provide technical support on its products. Specifically, if any other source was to provide these maintenance services without the SAP proprietary source code, it would not be able to push upgrades to the existing software or fix, and configure the services provided to the software. Access to the proprietary source code is critical to meet VA s need to maintain SAP software as operational and lack of annual maintenance and support could result in the loss of reporting capabilities. 6. Efforts to Obtain Competition: Market research was conducted, details of which are in section 8 of this justification. This effort did not yield any additional sources that can meet the Government's requirements. However, the undersigned VA technical representative determined that limited competition is available among resellers of brand name SAP licenses and associated software maintenance support services. In accordance with FAR 16.505(a)(4)(iii)(A)(1), this justification will be provided with the solicitation to all appropriate NASA SEWP V GWAC holders. Furthermore, in accordance with FAR 5.301, 16.505(b)(2)(ii)(D), and 16.505(a)(4)(iii), the award notice for this action will be synopsized on the Federal Business Opportunities website and this justification will be made publicly available within 14 days of award. 7. Actions to Increase Competition: In order to remove or overcome barriers to competition in future acquisitions for this requirement, the Government will continue to perform market research to determine if there are any products available that will enable future requirements to be competed. 8. Market Research: The Government s technical experts conducted market research in December 2018 by requesting informal proposals from NASA SEWP contract holders and reviewing similar licenses and maintenance support services offered by other manufacturers including Domo, InsightSquared and Looker. Although these products have functionality similar to SAP, none of these products can be seamlessly integrated within the existing production environment without an extensive re-engineering effort and the resultant impacts described above. Further, only SAP can access its proprietary source code in order to provide the required maintenance support. Additionally, in March 2019 the TAC conducted market research by using Provider Look Up Tool on the NASA SEWP V GWAC website and communication with the Original Equipment Manufacturer (OEM). The tool revealed multiple resellers of SAP products and maintenance support, including multiple verified Service Disabled Veteran Owned Small Business (SDVOSB) resellers in Group B2. Therefore, based on the results of the market research, there is reasonable expectation that limited competition exists among verified SDVOSB contract holders in Group B(2) of the NASA SEWP V GWAC. 9.
