Description

The Consumer Product Safety Commission (CPSC) intends to issue a solicitation on a sole-source basis to Actus Analytical, 351 Plandome Road, Manhasset, NY 11030 for 4500a FTIR 3 Reflection. Import surveillance currently has Agilent 4500a FTIRs that are used to test children's products for prohibited phthalates in excess of 0.1%, as outlined in Section 108 of the CPSIA of 2008. The Agilent 4500a FTIR is currently the only portable FTIR that is capable of measuring phthalates near the regulatory limit of 0.1%. Actus Analytical is the distributer of the 4500a FTIRs that have been developed with the phthalate calibration methods/models used for testing consumer products. Under the authority of FAR 6.302-1, only one responsible source and no other supplies or services will satisfy the agency requirements. This notice is NOT a request for competitive quotes; however, any firm that believes it can supply the service may give written notice to the Contract Specialist via email at dbraswell@cpsc.gov, by 3 PM EST on APRIL 9, 2019. SUPPORTING EVIDENCE MUST BE FURNISHED IN SUFFICIENT DETAIL, to the above listed email address, Attn: Derrick Braswell, Contract Specialist. NO TELEPHONE REQUESTS. Responses will be evaluated: however, a determination by the Government not to compete the proposed procurement based upon responses to this notice is solely within the discretion of Government. If no responses are received, CPSC will proceed with negotiating a sole source award to Actus Analytical.
