- Department of Energy (DOE) Federal Energy Management Program (FEMP) Energy Savings Performance Contract (ESPC) Indefinite Delivery, Indefinite Quantity (IDIQ), Generation 4 Procurement Solicitation Number: 892434-19-R-EE000007 Agency / Office / Location: DOE / Office of Energy Efficiency and Renewable Energy (EERE) / Golden Field Office The Department of Energy (DOE) Federal Energy Management Program (FEMP) intends to issue a competitive solicitation for Energy Savings Performance Contracts (ESPCs) under the authority of 42 U.S.C. § 8287. An ESPC allows an Energy Services Company (ESCO) to arrange for financing to develop and install energy, water conservation, and renewable energy projects at Federally owned facilities. As part of these projects, the ESCO conducts a comprehensive energy audit and identifies improvements that will save energy, implement renewable energy measures, and/or reduce utility bills at the facility. Please see the full ESPC statutory requirements set forth at 42 U.S.C. § 8287, et seq., for more detailed information. DOE FEMP currently provides a streamlined process for Federal agencies to enter into ESPCs through multiple Indefinite Delivery/Indefinite Quantity (IDIQ) contracts. DOE FEMP currently administers three (3) generations of IDIQ contracts for ESPC services. The ordering period for DOE ™s Generation 1 ESPC IDIQ contracts ended on 03/02/2010, but DOE FEMP continues to administer them in relation to task orders awarded under those contracts (which could have performance periods up to 25 years after the ordering period expired). The Generation 2 ESPC IDIQ includes a pool of sixteen (16) ESCOs and the ordering period will expire on 12/16/2019. The Generation 3 ESPC IDIQ includes a pool of twenty-one (21) ESCOs and the base ordering period will expire on 04/26/2022. This procurement is for the fourth generation of IDIQ contracts. The purpose of DOE ™s ESPC IDIQ contracts is to obtain energy and/or water cost savings through the implementation of various technologies and other improvements at Federal facilities. ESPCs can enhance resilience, modernize infrastructure, and improve mission assurance through technologies and improvements including but not limited to distributed generation and energy storage, renewable energy technologies, continual/ongoing commissioning, and energy and water conservation services. ESPCs may also include process improvements that reduce energy and water consumption and/or associated utility costs, as well as energy and water-related operations and maintenance costs. In consultation with an ordering agency, an ESCO will design and construct ESPC projects that meet the agency ™s needs, as well as arrange any necessary financing. The ESCO must guarantee these energy improvements will generate energy cost savings sufficient to pay for the ESPC project over the term of the Task Order. Through measurement and verification, the ESCO must then verify the energy savings throughout the period of performance of the Task Order. At the conclusion of the Task Order period of performance, all future cost savings accrue to the ordering agency. Task Orders issued under the ESPC IDIQ contracts may have a period of performance up to 25 years. This procurement will be conducted as a full and open competition for a multiple award IDIQ with a Small Business Award Reserve. DOE plans to award fifteen (15) IDIQ contracts with up to five (5) awards reserved for small business concerns; however, DOE reserves the right to change the number of awards to both large and small business concerns when it is in the Government ™s best interest to do so. Joint ventures under the Small Business Administration Mentor-Protégé program may be considered for a small business IDIQ award. In order to maximize competition, DOE will not select any business concern for more than one (1) IDIQ award either directly or indirectly (through a joint venture). While the instructions and evaluation factors will differ from this Generation 4 procurement, interested parties should be able to get an idea of the type and volume of information that may be requested in a proposal for an ESPC IDIQ contract. Qualification Requirements: All potential awardees will be required to be on the DOE ™s Qualified List of ESCOs prior to award. Type of contract: Multiple Award IDIQ with Firm Fixed Price Task Orders, Multi-Agency Anticipated Award Value: $4 billion maximum ceiling per IDIQ contract Duration of Contract Period: Anticipated - Five (5) Year Base Ordering Period with a Five (5) Year Option Period Sustainable Acquisition Requirements: The solicitation and resulting contracts will include all applicable sustainable acquisition requirements per the FAR and/or DEAR. One or more of the items under this acquisition is subject to the World Trade Organization Government Procurement Agreement and Free Trade Agreements.
