Description
The U.S. Army Contracting Command-Warren intends to award an eight-year Firm Fixed Price requirements contract under solicitation W56HZV-17-R-0011, for armored and unarmored High Mobility Engineer Excavator Type I (HMEE-I) Vehicles meeting the specifications in Army Automotive Tank Purchase Description 2301, Related Hardware to include uninstalled armor Crew Protection Kit, Special Purpose Kit, multi-functional attachments, and Special Tools and Test Equipment (NSN 5180-01-629-6824), and Ancillary Services including Operator and Field-Level Maintenance New Equipment Training, Total Package Fielding, and vehicle maintenance support by Field Service Representatives. This contract will establish five 12-month ordering periods with an additional three 12-month ordering periods as options, for a total potential contract length of eight years. This action will be on a sole source basis with JCB Inc. of Pooler, GA. The proposed contract action is for vehicles, hardware, and services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302-1. Specifically, FAR 6.302-1(a)(2)(ii), which states, "Supplies may be deemed to be available only from the original source in the case of a follow-on contract for the continued development or production of a major component thereof, when it is likely that award to any other source would result in - (B) Unacceptable delays in fulfilling the agency's requirements;" and, (iii) "For DoD, NASA, and the Coast Guard, services may be deemed to be available only from the original source in the case of follow-on contracts for the continued provision of highly specialized services when it is likely that award to any other source would result in-- (B) Unacceptable delays in fulfilling the agency's requirements." The Army has a need for continuous production and deliveries of HMEE vehicles, related hardware, and ancillary services beginning no later than March 2020. JCB Inc is the only company able to supply these items and services without causing an unacceptable delay to the Government. This is a notice of intent, not a request for competitive proposals, or a solicitation of offers. However, all responsible sources may submit a capability statement, bid, proposal, or quotation, which shall be considered by the agency. A determination not to compete this proposed contract action, upon response to this notice, is solely within the discretion of the Government.
