Description

This is a special notice prepared in accordance with Federal Acquisition Regulation (FAR) 5.2 "Synopses of Proposed Contract Actions" US Army Corps of Engineers, Portland District intends to negotiate/award a sole-source, Firm-Fixed Price contract with GE Intelligent Platforms, Inc. - CB Pacific Inc. GDACS is the automated power plant monitoring and control system for controlling power generation from Corps Northwestern Division (NWD) hydropower plants and other federal power plants that may be linked to the NWD GDACS system. The origin of the system was the necessity to develop automated control systems to work with United States Army Corps of Engineers' USACE) hydropower facilities as they were converted from analog to digital control systems starting in the 1980's. Early attempts to acquire an entirely commercial automated control system resulted in a series of commercial contract failures due to the unique technical challenges of the NWD hydropower facilities. After these failed commercial efforts, the USACE management team decided to develop an in-house "GDACS" system, using available commercial software to assist the effort. The associated GDACS software and hardware constitutes automated power control systems that fall under the requirements of Title 6 USC for cyber security, including 6 USC 131-134, protection of critical infrastructure information. As a result, access to GDACS cannot be legally offered to a wide range of competitors for GDACS support services. Moreover, as stated elsewhere in the supporting J&A, the interfaces between GDACS and GE software currently in use are also protected by GE's legal proprietary rights. This purchase is specifically for Lost Creek Dam only. A SOLICITATION WILL NOT BE POSTED. The Government intends to proceed with this sole source action. The NAICS code is 511210 Software Publishing. The size standard as defined by the U.S. Small Business Administration is $38,500,000.00. THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS OR QUOTATIONS. Interested concerns must show clear and convincing evidence that competition of this requirement would be advantageous to the Government. All responsible sources may submit a capability statement, proposal or quote to the contracting officer before the notice end date. If no affirmative written responses are received by 08:00 AM Pacific Daylight Time on May 10,2019 an award will be made without further notice. Oral communications are not acceptable in response to this notice. A determination by the Government not to compete this proposed requirement is solely within the discretion of the Government.
