Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. The solicitation number for this procurement is 140A0319Q0015 and is issued as a Request for Quote (RFQ). The Bureau of Indian Affairs (BIA), Southern Plain Regional Office intends to award a firm-fixed price contract in response to this Request for Quote (RFQ). The solicitation documents and incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC 2019-01 dated December 20, 2018. This solicitation is an Indian Small Business Economic Enterprise (ISBEE) set-aside. Under the Buy Indian Act, 25 U.S.C. 47, offers are solicited only from Indian Economic Enterprises (Subpart 1480.8) that are also small business concerns. Any acquisition resulting from this solicitation will be from such a concern. Offers received from enterprises that are not both Indian economic enterprises and small business concerns will not be considered and will be rejected. As part of your offer, you must complete and return the Indian Economic Enterprise Representation form (DIAR Clause 1452.280-4 (see attached)). The associated North American Industry Classification System code (NAICS) is 541620, Environmental Consulting Services, and the size standard is $15 Mil. The Bureau of Indian Affairs (BIA), Southern Plains Regional Office, is soliciting offers for Programmatic Biological Assessment (PBA) and Section 7 Consultation for Lease Approvals at Pawnee Agency. CLIN 00010 and Price Schedule: Programmatic Biological Assessment (PBA) and Section 7 Consultation for Lease Approvals for the Southern Plains Region, Pawnee Agency-OKPAA. Quantity: 1 Job @ $________________________ Please provide a breakdown of the price schedule, such as hours to perform the requirement and hourly rate. Description of Services: The contractor shall prepare and submit to the Bureau of Indian Affairs (BIA), Pawnee Agency, Section 7 of the Endangered Species Act consultation documents which support approval of farming and grazing (agriculture) and oil and gas (mineral) leases that will encumber trust restricted Indian lands under the jurisdiction of the Pawnee Agency. The Programmatic Biological Assessment (PBA) and Section 7 Consultation shall be in support of a "may affect, not likely to adversely affect" determination as outlined in the PEA's. Section 7 Consultations shall be conducted with the USFWS Oklahoma Ecological Services Field Office using their online project review system. Each draft PEA shall receive its own PBA and associated consultation documents. The documents shall include: - a PBA which includes: o an official species list from an IPaC report; o a species conclusion table; o an online project review concurrence letter; o proof of consultation sent to USFWS at okprojectreview@fws.gov; o any responses received from the USFWS; and o appropriate lease stipulations and other factors such as avoidance and minimization measures (those can be found in the draft PEA's and its attachments) * The following statement for the oil and gas PBA "The act of leasing does not authorize any development or use of the surface of lease lands without further application by the operator/lessee and approval by the BLM. In the future, the BLM may receive Applications for Permit to Drill (APDs) for those parcels that are leased. If APDs are received, the BLM would conduct an additional site-specific NEPA analysis before deciding whether to approve the APD, and what conditions of approval (COA) should apply. Appropriate and prudent site-specific conservation measures and mitigation would be developed and made a requirement of each project during the APD process. This would consist of site-specific mitigation based on the findings of project specific environmental assessments, special surface stipulations from the BIA, and BLM stipulations modifying the drilling plan (if needed) as COAs for the APD. BIA surface stipulations would be incorporated into the APD before it is approved. In addition, no drilling or production activities are permitted along shorelines where shorebirds may find the habitat to be suitable." * The following statement for the farming and grazing PBA "BIA will evaluate site specific actions which are not covered under the standard language of the leases such as constructing new ponds or bulldozing trees on an independent basis as they are proposed. Livestock will not access river bottoms and cropland requires a buffer zone along river banks. Conservation measures to protect T&E species are included in the leases. Proposed actions which are beyond the scope and limitation of the lease will be independently evaluated and avoidance and mitigation measures will be implemented as necessary to protect T&E species." Pawnee Agency has draft programmatic environmental assessments (PEA) for both leasing programs and those documents shall be provided to the contractor to perform and complete section 7 consultations with the USFWS. Each draft PEA shall receive its own BA and associated consultation documents. The section 7 consultation documents shall be prepared in accordance with: - The National Environmental Policy Act of 1969, - The Endangered Species Act - Any other applicable law(s) BIA, Pawnee Agency shall make the contractor the official party responsible for section 7 consultations via formal letters provided to the United States Fish and Wildlife service (USFWS). Those letters shall be issued within 1 week of the contract award or agreement date. BIA will incorporate the documents into its PEA's upon final receipt from the contractor. No later than September 30, 2019, the contractor shall submit to BIA, Pawnee Agency, all final documents. The formats of the submitted final documents are: 1 PDF of each complete consultation package, and all Microsoft Word documents available. The electronic formats will be submitted to Jeremy.lovekamp@bia.gov. The contractor is advised that USFWS requires 45 days to review the package after they receive it so the package shall be sent to USFWS within 40 days of contract award or agreement date. The contractor is authorized to enter onto the trust properties under the jurisdiction of the Pawnee Agency, but shall carry a copy of the contract/agreement on them at all times. Attachments: - Draft PEA's for each leasing program with Appendices - BIA's Template Farming and Grazing (Agriculture) Lease - BIA's Template Oil and Gas (Mineral) Lease - Onshore Energy and Mineral Lease Management Interagency SOP - Map of BIA, Pawnee Agency Jurisdiction - Surface Use Plan of Operations for proposed drilling activities Period of Performance: 3 June 2019 to 30 September 2019 PROVISION FAR 52.212-1 -- INSTRUCTIONS TO OFFERORS -- COMMERCIAL ITEMS, applies to this acquisition. FAR 52.212-2 - EVALUATION - COMMERCIAL ITEMS (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: (i) Technical Capability to perform services to meet the BIA's requirements and submit documentation to verify (ii) Past Performance 1. Past performance contact information for minimum of two references for which work was conducted which was similar in scope, magnitude and complexity to the requirements described in this solicitation: a. If applicable, explanation of any problems or delays encountered. (iii) Price 1. Price will be evaluated in order to determine if it is reasonable in accordance with FAR Parts 13.106-3 and 15.402(a)(2). Offers should be sufficiently detailed to demonstrate their reasonableness. Technical Capability and Past Performance, when combined, are equal to price. (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer, emailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer ¿s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. S. Department of the Treasury's Invoice Processing Platform System (IPP). "Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Items included in commercial item contracts. If the Contractor is unable to comply with the requirement to use IPP for submitting invoices for payment, the Contractor must submit a waiver request in writing to the Contracting Officer with its proposal or quotation. OMB MEMORANDUM M-11-32 Accelerating Payments to Small Businesses for Goods and Services This policy requires agencies to accelerate payment to small business prime contractors to the full extent permitted by law with the goal of making payment within 15 days of receipt of a proper invoice. In return, prime contractors are expected to accelerate payment to small business subcontractors when they receive accelerated payments from the Government.
