Description
Software Maintenance for Innovation Data Processing 2 JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY Contracting Activity: Department of Veterans Affairs (VA) Office of Procurement Acquisition and Logistics Technology Acquisition Center 23 Christopher Way Eatontown, New Jersey 07724 Description of Action: This proposed action is for a brand name firm-fixed price delivery order to be issued under the National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) V Government Wide Acquisition Contract (GWAC). Description of Supplies or Services: VA Office of Information and Technology (OI&T), Information Technology Operations and Services (ITOPS), Infrastructure Operations (IO) has a requirement for brand name Innovation Data Processing (IDP) software maintenance. This will allow IO to receive software upgrades and updates to include major releases, point releases, service releases and security releases of applicable software on a quarterly basis, and/or within 48 hours in cases in which a high-risk vulnerability fix becomes available. The software maintenance and updates are necessary to ensure the software remains operational. For the proposed action, the period of performance is October 1, 2018, through September 30, 2019, with four additional 12-month option periods. The estimated price is $XXX, inclusive of all options. Statutory Authority: The statutory authority permitting this exception to fair opportunity is Section 41 U.S.C 4106(c)(2) as implemented by Federal Acquisition Regulation (FAR) Section 16.505(b)(2)(i)(B) entitled, "Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized." Rationale Supporting Use of Authority Cited: This is a brand name justification in accordance with FAR 11.105, Items Peculiar to One Manufacturer. Based on extensive market research, as described in paragraph 8 of this justification, it was determined that limited competition is viable among authorized resellers for this requirement. The current IO infrastructure is based on existing IDP software and VA requires support compatible with the existing infrastructure protocols and functionality for continued operational availability. Only IDP or an authorized reseller can provide the necessary software updates, because of the propriety source code required to develop and implement software updates. No other source can provide the required software maintenance that meets VA's unique functional requirements. In addition, a prior implementation of IDP software licenses already exist in IO and VA is not considering reprocuring licenses at this time. No other license is compatible with or interoperable with the existing IDP software, proprietary database structures, protocols, and software application programming interfaces. Therefore, only IDP brand name software maintenance can meet the Government's requirements. Efforts to Obtain Competition: Market research was conducted, details of which are in the market research paragraph of this document. Although the Government is limiting competition, it is anticipated that there will be several authorized resellers of this product on the NASA SEWP V GWAC. In accordance with FAR 5.301 and 16.505(b)(2)(ii)(D), this action will not be synopsized and the justification will be made publicly available on the Federal Business Opportunities Page within 14 days of award of the order as the total value of this effort is above the simplified acquisition threshold. Actions to Increase Competition: The Government will continue to conduct market research to ascertain if there are changes in the marketplace that would enable future actions to be fully competed. Market Research: The Government's technical experts conducted market research during July 2018 and at present there is no other software available in the market place. VA networking Subject Matter Experts reviewed industry trade publications and conduct internet research to ascertain if any other brand name software is available. Although other vendors possess similar capabilities, such as XXX and XXX to provide the required software licenses and maintenance, only IDP or an authorized reseller have access to the proprietary database structures, protocols, and software application programming interfaces specific to this particular software. Based on all of these market research efforts, the Government's technical experts have determined that only the aforementioned Innovation Data Processing brand name software can meet all of VA's needs. Additional market research was conducted by Government representatives in April 2018 by utilizing the NASA SEWP V Provider Lookup Tool. The search revealed that there are multiple authorized resellers for this item. Based on this, there is reasonable expectation that limited competition exists on the NASA SEWP V GWAC for the IDP brand name software licenses and maintenance. In addition, the NASA SEWP V GWAC is a dynamic Information Technology contract in which products can be added to vendor catalogs based on customer requests on as frequent as a daily basis, as long as the required IT item is within scope of the NASA SEWP V GWAC.
