- UNITED STATES ENVIRONMENTAL PROTECTION AGENCY Cincinnati, OH 45268 Pre Solicitation Notice SOL 68HE0C19R0011 Testing & Analytical Services for Regulation of Motor Vehicles, Engines, Fuels, and Fuel Additives The solicitation 68HE0C19R0011 will be available for downloading at FedConnect ® located at the following internet address: www.fedconnect.net/. Questions relating to the solicitation are required to be submitted electronically through FedConnect ®. ONLY those questions posted through FedConnect ® will be accepted. All responses to questions will be released on FedConnect ®. Contractor registration in the Government ™s System for Award Management (SAM) is required in order to be eligible for contract award. Once issued, solicitation documents will be available electronically for download at https://www.fedconnect.net. Hard copies of the solicitation package will not be distributed. Electronic copies of responses will be required and must be submitted via FedConnect ® (https://www.fedconnect.net). The US Environmental Protection Agency (EPA), Office of Air and Radiation (OAR), has a requirement to provide testing, engineering, and economic analytical services to support emissions characterization, technology assessment, and test procedure and equipment development activities for the Assessment and Standards Division (ASD) and Testing and Advanced Technology Division (TATD) of the Office of Transportation and Air Quality (OTAQ). This effort is in support of the mission of the 1990 Clean Air Act Amendments for mobile sources which is to deliver real results to provide Americans with clean air, land, and water, and ensure chemical safety. The Government anticipates award of an indefinite delivery/indefinite quantity (ID/IQ) contract that will allow for the issuance of firm fixed price (FFP) and time and material (T&M) type task orders over an ordering period of 5 years. The EPA intends to award a single contract with an ordering ceiling of $25 million. The anticipated solicitation release is in the late May timeframe and the close date shall be approximately 30 days thereafter. The solicitation will be issued on a full and open competitive basis with no small business set-aside(s). A Performance Work Statement (PWS) document shall accompany this Presolicitation Notice via separate attachment. Be advised that changes to any or all documentation is possible when the final solicitation is released. No hard copies will be available. The EPA has determined that actual Organizational Conflicts of Interest (OCOI) exist for this requirement. The EPA has determined to exclude from consideration for award, as a prime contractor or subcontractor, entities that are directly engaged in or that have a business, financial, or competitive relationship(s) with firms that are motor vehicle, aircraft, marine vessel, locomotive, or non-road equipment manufacturers; engine manufacturers; or that produce or distribute fuel or fuel additives and component manufacturers and distributors, and consultants working with them. The industries named above could not avoid actual Conflict of Interest as activities included in the PWS to provide testing and analytical support for the regulation of motor vehicles, engines, fuels and fuel additives would have a significant impact on policies applicable to these industries. All offerors shall submit an OCOI plan that describes procedures the offeror uses to identify and report COIs. The solicitation shall include standard EPAAR provisions (EPAAR 1552.209-70 and 1552.209-72) which require that an offeror certify whether it is aware of any potential OCOI or disclose any potential OCOI, and provide disclosure statements describing such OCOI, which may impact their ability to impartially conduct work under the PWS. The standard EPAAR solicitation provision (EPAAR 1552.209-71) requiring a contractor to make full disclosure of any actual or potential conflict of interest that is discovered or arises after contract award shall also be part of the solicitation. Furthermore, the standard EPAAR clause (EPAAR 1552.20-74 “ Limitation of Future Contracting) shall also be included in the solicitation and prohibits offerors from entering into a business or financial relationship with excluded industries named above for three years past the life of the contract. The text of the clause will mirror the clause Limitation of Future Contracting, Alternate V (Headquarters Support), (EPAAR 1552.209-74), (APR 2004), except for paragraph (c). Paragraph (c) of the clause shall read as follows: (c) Unless prior written approval is obtained from the EPA Contracting Officer, the contractor is prohibited from entering into any business or financial relationships, including acting in any type of representational capacity, with motor vehicle, aircraft, marine vessel, locomotive, and non-road equipment or engine manufacturers, fuel/fuel additives producers or distributors, and/or firms in the field of emissions control or reduction and component manufacturers and distributors, and consultants working with them, concerning any matters related to the contractor ™s specific activities under this contract, during the life of the contract and extending for a period of three (3) years past the life of the contract to allow for rules to be promulgated. All responsible sources may submit a proposal for EPA consideration. The applicable NAICS code is 541330, engineering services, with a size standard of $15 million of average annual receipts.
