Performance Work Statement SCOPE OF WORK Spraying of Herbicide at Prompton, Jadwin, Beltzville and Francis E. Walter Dams, PA 1.0 Introduction 1.1Background. The US Army Corps of Engineers Philadelphia District has 5 multipurpose flood control projects located within the Delaware River Basin. While operating and maintaining these earth fill structures, it is critical to manage the spread of unwanted woody vegetation on the dam's critical areas. This contract will service 4 of the 5 projects including Beltzville Dam, Lehighton PA, Francis E. Walter Dam, White Haven PA, General Edgar Jadwin Dam, Honesdale PA, and Prompton Dam, Prompton PA. 1.2Scope of Work. Every two years, the Northern Area Dams require a contracted herbicide spraying program to effectively control woody vegetation on the site's embankments, groins, abutments, and 15ft beyond all contact points. This helps ensure the integrity of the earth filled structure. This program also serves as a way to control invasive plant species and the spread of unwanted phragmites while aiding to reduce maintenance efforts at each project. 2.0General Requirements A herbicide spraying contract shall be provided at Beltzville Dam, Francis E. Walter Dam, General Edgar Jadwin Dam, and Prompton Dam (hereafter referred to as "dams") as described in the following sections. 2.1General. The Contractor agrees to furnish services as described in Section 3, Performance Requirements. This contract will cover the period beginning 1 June 2019 through 1 July 2019. 2.2Government-Furnished Materials. The Contractor is expected to provide all manpower, equipment, supplies, and materials required to deliver the herbicide spraying service. 2.3Contractor Personnel, Disciplines, and Specialties. The Contractor must be certified by the State of Pennsylvania for application of proper pesticides within the State, and must adhere to all rules and regulations relating to pesticides. A copy of the appropriate certifications shall be furnished to the Contracting Officer's Representative prior to commencement of work. The Contractor shall be provided with the appropriate form (Pesticide Application Record) to maintain herbicide records. This form shall be completed and furnished to the Government Representative upon completion of each site or day. The following Pesticide Application Record shall have the following information: Performance Work Statement A. Name of applicator and Certification ID. No. B. Herbicide name and EPA Reg. No. C. EPA Registration number D. Weather conditions E. Amount of herbicide used, date and time applied F. Amount of acreage covered G. Locations applied to include zip code 2.4 Location and Hours of Duty. The Contractor shall perform work only during normal Corps of Engineers duty hours (7:00 am. to 3:30 pm., Monday thru Friday, excluding national holidays) weather permitting. Exceptions to this condition must be approved in advance by the Contracting Officer's Representative. At least five (5) days' notice shall be given to the Government indicating when spraying is to be performed at each location. 3.0Performance Requirements. The Contractor shall furnish all labor, supervision, equipment and supplies to provide spraying of an estimated 11,000 gallons of herbicide solution. Spraying will be conducted on each of the project site's dam embankments, groins, abutments, and 15ft beyond contact points, and additional areas as specified below. Services shall be provided from 01 June 2019 to 01 July 2019. All work shall be in accordance with these specifications and as directed by the Contracting Officer's Representative. 3.1Herbicide Requirements. Herbicides, Surfactant, Anti-Drift and Colorant used shall be as specified hereunder. The use of any herbicide other than specified shall require the approval of the Contracting Officer's Representative prior to commencement of work. 3.1.1 Herbicide, Arsenal, Mfg. American Cyanamid, EPA Reg No. 241-346. If substitution is used, the herbicide must be approved for ditch bank, non-irrigation use, and guarantee a 98% kill and provide residual control. 3.1.2 Herbicide, Karmex DF, Mfg. Dupont, EPA Reg No. 352-508. If substitution is used, the herbicide must be approved for ditch bank use, and be such that non-selective weed control is guaranteed for two (2) years. 3.1.3 Herbicide, Crossbow L Herbicide, Mfg. Dow Agrosciences, EPA Reg No. 62719- 260-34704. If substitution is used, must contain 34.40% by weight of 2, 4-D butoxyethly ester and 16.50% by weight of Triclopyr butoxyethyl ester. 3.1.4 Surfactant, Cleancut, Mfg. Armorchem 3.1.5 Colorant, Bulls Eye Pattern Indicator, Mfg Milliken Chemicals, Inc. 3.1.6 Anti-Drift agent Performance Work Statement 3.2 Solution Mixture. Solution to be mixed per 100 gallons of water: A. Arsenal, 96 oz. Six (6) pints. B. Karmex DF, Eight (8) pounds. C. Crossbow L Herbicide, One (1) gallons. D. Surfactant, One (1) quart. E. Anti-Drift Agent, to be used in accordance with manufacturer's recommendations. 3.3Rate of Spray. Apply the above solution at a minimum spray rate of 100 gallons per acre, to assure a thorough and uniform covering of the vegetation surface. 3.4Areas of Coverage. Walter Dam White Haven, PA 18661 4200 42 Area to also include: a) 200 ft x 200 ft outlet works. b) Spillway levee, 1100 ft x 40 ft c) 3600 ft of road shoulders, 15 ft on both sides. d) Guiderails throughout roadway 10,000ft x 4ft. In general, the areas include both the upstream and downstream portions of the dam embankments in addition to the specified areas listed in the comments section under 3.4, Areas of Coverage, see above. Areas and terrain vary by location. The Contractor is required to use a spray rig to apply the herbicides with a tank and equipped with an anti-siphon device. A spray gun/guns shall be required to accommodate a variety of different spraying requirements. (The gun shall be required to spray a wide swath pattern that is uniform across its width and achieve applying a spray solution at 100 gallons per acre, or concentrate the spray pattern for spot treatment.) A minimum of 300 feet of spray hose is required and additional hose may be necessary. 4.2Applicable Directives. The Contractor shall apply the herbicides to all locations as specified above and shall be held responsible for any off site damage caused from spraying operations, such as over spraying, leaching, and public safety. The Contractor is prohibited from using Government property to clean equipment or dispose of any waste. 4.3Safety. The Contractor shall comply with all applicable Federal, State, and Local safety regulations, including US Army Corps of Engineers Occupational Safety and Health Requirements Manual, EM 385-1-1. Performance Work Statement 4.4Security. The Contractor will be required to spray in areas that are both restricted and open to public access. For restricted areas, a Government representative will escort and give access to the Contractor to perform the work. A visitor log is maintained at each dam project office and will require the Contractor to sign in and out each day. The Contractor will not require a Common Access Card to perform this work. 4.5Mixing Location. The Contractor shall coordinate the location of a designated area for mixing and preparing herbicides with proper personnel. 4.6Emergency Action Plan. The Contractor is required to have a spill containment system constructed of impervious materials or an alternate as required. The Contractor is advised to dial 911 if any threats to the environment or public safety occur, notify dam personnel immediately and take appropriate action. Information on decontamination or emergency and non-emergency type spills may be obtained by contacting CHEMTREC toll free at 1-800-424-9300. 4.7 Limited Access. Themajority of areas to be treated are accessible by a high-volume spray rig with the exception of an 800 feet span in Beltzville's emergency spillway. This will require hand spraying (backpack) or use of an ATV/UTV. Also, depending on weather conditions, the 9 acre Bear Creek Flood Plain at F.E. Walter Dam may be difficult to access. Other arraignments may be needed. (Again, it is highly recommended Contractors visit all sites prior to bidding.) 5.0Measure and Payment Herbicide Treatment will be paid for at the contract unit price per gallon in accordance with treatment specifications, upon satisfied completion by the Authorized Representative of the Contracting Officer. If areas are missed and satisfied completion is not warranted after the Contractor leaves the project site after initial inspection, the Contractor will be required to return at no additional cost to the Government to ensure a satisfactory end product is achieved. Payment will be based on a spray rate of 100 gallons per acre solution. THE CONTRACTOR CANNOT ELECT TO SPRAY A MORE DILUTED SOLUTION THAN SPECIFIED ABOVE. Such payment shall be compensation for all labor, materials, equipment and incidentals necessary to perform the work. Upon satisfaction of the contract, the Contractor shall submit an invoice(s) for payment to: Original invoice forwarded to: USACE, Finance Center 5722 Integrity Drive Millington, TN 38054-5005 or CEFC-Payments@usace.army.mil One copy of invoice to: U.S. Army Corps of Engineers Beltzville Lake Performance Work Statement 2145 Pohopoco Drive Lehighton, PA 18235 The invoice should be submitted within five (5) calendar days after notification of acceptance of work. The invoices must provide, Contractor's name and address, Contract/Purchase Order No., date prepared and itemized costing per unit.
