VHAPM Part 808.405-6 Limiting Sources Attachment 1: Justification for Limiting Sources for Micro-Purchase Threshold up to the SAT VHAPM Part 808.405-6 Limiting Sources Page 1 of 3 Original Date: 08/30/2017 Revision 01 Eff Date: 04/23/2018 DEPARTMENT OF VETERANS AFFAIRS FAR 8 Justification for Limiting Sources (LSJ) For Limiting Sources (<SAT) Acquisition Plan Action ID:_ 689-19-3-4803-0082/36C241-19-AP-2303 Thundercat/Everbridge Communications System Contracting Activity: Department of Veterans Affairs, VISN 1, West Haven Medical Center Prior YR. 689-18-3-4803-0109 Description of Action: Thundercat would be continuing the Everbridge mass notification services that are being currently provided by to VA CT through Everbridge directly under GS35F0692P. These services are critical to departmental communication during emergencies that affect patient care and being able to maintain continuity of operations during emergencies. Order against: SEWP Contract Number: SEWP V SDVOSB Contract (Group B): NNG15SD26B Name of Proposed Contractor: ThunderCat Technology Street Address: 1925 Isaac Newton Sq. E, Suite 180 City, State, Zip: Reston, VA 20190 Phone: 1-248-412-3907 Description of Supplies or Services: The estimated value of the proposed action is $20,800.00 per year. Plus two options for one year each. Total contract value if options exercised is $62,400.00. Authority: ORDER AGAINST FSS: Authority of the Multiple Award Schedule Program, Title III of the Federal Property and Administrative Services Act of 1949 (41 USC 251, et seq.); Title 40 USC 501, Services for Executive Agencies; and Section 803 of the National Defense Authorization Act of 2002 (PL 107-107) and implemented by FAR 8.405-6. Mark the applicable exception: An urgent and compelling need exists, and following the procedures would result in unacceptable delays(FAR 8.405-6(a)(1)(i)(A); Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; (FAR 8.405-6(a)(1)(i)(B)); In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order and the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order was not previously issued under sole-source or limited-sources procedures (FAR 8.405-6(a)(1)(i)(C)); or Items peculiar to one manufacturer. An item peculiar to one manufacturer can be a particular brand name, product, or a feature of a product, peculiar to one manufacturer). A brand name item, whether available on one or more schedule contracts, is an item peculiar to one manufacturer (FAR 8.405-6(b)). Rational/explanation to support cited authority: Most Mass Notification Patents: Patent 7,664,233 allows Everbridge notifications to be sent out using a unique sequential approach based on a pre-determined order. This sequential process sends messages to an Organization's preferred device first, and then sequentially moves to the second, third and more preferred devices until the recipient acknowledges receipt. This is a crucial capability for mass notification solutions to meet the changing demographics and technical requirements of recipients. This is especially important due to the fact most employees have multiple devices or methods for contact. Once they have been contacted and respond the alert ends. This stops the possibility of duplication or misinterpretation of the alerts sent out. Patent 7,895,263 allows Everbridge to send geographic notifications based on both contact information contained in an R911 database and also contact information provided by the message recipient through an opt-in member registration portal. This unique approach of combining sources for contact information ensures that the most accurate and relevant contact data is always available. This useful for the many employees for VA CT that are working in the field providing patient care (Home Based Primary Care, Social workers). By being alerted to only the emergency situation that are relevant to their geolocation it allows them to better communicate with the patients. Support for Organizational Hierarchies: Everbridge supports the creation of organizational hierarchies to provide customized attributes to individual organizations within an entity and is the only mass notification provider that supports sending cross organization notifications from within a single account. Multiple departments currently use this feature and already have their department recall lists and emergency contact information set up. Departments such as the Cardiac Cath Lab, OR, Blind Rehab, Facilities use this feature to send out general notifications as well. Everbridge has proved to already be an invaluable asset that should be continued to maintain continuity of patient care and facilities operations around the clock. To begin service with another provider would end up costing the government additional time and money to set all these alert groups back up and re-build the departmental and internal notifications that are already in place. BRAND NAME ONLY (Everbridge Mass Notification): This buy is estimated to exceed $25,000 and this documentation will be posted along with the RFQ on e-Buy, as required by FAR 8.405-1(e). Note that this determination satisfies the requirements of FAR 8.405-6. The requirement to prepare a written justification IAW FAR 6.303 does not apply to Federal Supply Schedules.
