Description
JUSTIFICATION AND APPROVAL LESS THAN <150K Justification for Other Than Full and Open Competition (FAR 6.3) Contracting Agency and Activity. The Department of Veterans Affairs, Network Contract Office 21 (NCO-21) plans to contract by means of other than full and open competition. This document sets forth the justification and approval for use of one of the exceptions to full and open competition allowed under the Competition in Contracting Act (CICA) of 1984. Requirement is for the VA Palo Alto Healthcare System, Menlo Park Campus. The 2237 for this requirement is 640-19-3-55036-0455. Nature ofAction Being Approved: Replace failed Automatic Transfer Switch (ATS) at Bldg 360, which houses the Continued Living Center (CLC). Description of Supplies or Services. Bldg. 360 has an ATS that has failed and needs to be replaced in order to maintain a timely emergency back-up power transition. All requirements are typically posted via Federal Business Opportunities (FBO) when practical. Fair and Reasonable. The anticipated cost to the Government for this contract action will be determined fair and reasonable by the contracting officer. The contractor pricing will be determined fair in reasonable in accordance with FAR part 15.404-1 (b)(2)(v) comparison of proposed prices with independent government cost estimate. The Efforts to Identify Additional Sources Including the Market Research Conducted. There is a sufficient number of known SDVOSB contractors under the NAICS code 238210 Electrical, or 236220 for general construction. Additional market research is not necessary al the juncture based on recent and relevant construction contracts for the VAPAHCS. Other Information. The Automatic Transfer switch part(s) are long lead items in and of themselves. We will only make the situation worse by adding the full solicitation process, which M'ill consume at least another 8 weeks to get the parts on order. This M'ill create a greater risk to the VA and the patients housed in building 360. The following sources expressed in writing an interest in the acquisition. The equipment has been in place for naany years, and any future incidents may possibly be avoided through routine maintenance checks. Once a routine maintenance check demonstrates a problem, the facility should submit a 2237 to execute repair in a timely more routine fashion. 12 Reconunendation and Certification from Program Office. Based on the above, I recommend this acquisition be conducted on the basis of other than full and open competition.
