Description
1. Identification of the agency and the contracting activity, and specific identification of the document as a "Sole Source Justification." This is a HubZone sole source justification. Contracting activity is NSWC-PCD, Code 024, 110 Vernon Ave., Panama City, FL, 32407. 2. Nature and/or description of the action being approved. This action will award a HubZone Sole Source firm fixed price purchase order pursuant to FAR 19.1306(a) to RAS Enterprises, LLC to acquire bulk helium in the amount of 230,000 SCF to include delivery and pick up as well as the monthly rental of a 20' MEGC Helium ISO Module detachable skid trailer for use by NEDU. 3. A description of the supplies or services required to meet the agency's needs (including the estimated value). This acquisition will be conducted using simplified acquisition procedures with a total estimated value of $217,000. This procurement is for: -QTY-1- 180,000SCF Helium Truck $.80c per SCF $144,000.00 -QTY-1- Delivery and Pickup of Helium Truck $3000.00 -QTY-1- Flask Skid with Trailer $3000.00 per month for 10 months $30,000.00 -QTY-1- 50,000SCF Helium Flask Skid $.80c per SCF $40,000.00 Total: $217,000.00 The Government's minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. This purchase will be funded with FY19-20 RDT&E funds. 4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor's unique qualifications to provide the required supply or service. 10 U.S.C. 2304(c)(5), Authorized or Required by Statute, FAR 6.302-5(b)(5). This purchase will support Naval Sea Systems Command (NAVSEA) FY19 certification and testing requirements for Naval Experimental Diving Unit (NEDU) Saturation Fly Away Diving System (SAT FADS) training and out to sea phase. Due to the required volume, logistical, and economic constraints of purchasing the commodity of bulk helium, we do not expect significant savings through competition and foresee significant and unacceptable delays that will negatively impact this requirement. Moreover, it meets the criteria as prescribed by FAR 19.1306(a). Therefore, it is in the Governments' best interest to award on a sole source basis to RAS Enterprises, LLC. 5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b). The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government's needs. 6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted. For reasons specified in paragraph 4 above, NEDU has purchased Bulk Helium from RAS Enterprises, LLC recently and in years past. RAS Enterprises, LLC will fulfill all standards and necessary documentation required for helium purity per US Navy Dive Manual Volume 1 Table 4-3, which will be used for NAVSEA Certification. Multiple vendors outside the geographic area have been contacted and none are able to provide the bulk quantities that NEDU requires due to the logistical constraints with transporting these volumes long distances. Backed by successful past performance, RAS Enterprises, LLC is the only source that can meet the Government's needs. This requirement will be synopsized in the government point of entry fbo.gov. 7. Any other facts supporting the justification. None. 8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made. As stated in paragraph 4 above, RAS Enterprises, LLC is the only source that can meet this requirement.
