- NOTICE OF INTENT TO AWARD SOLE SOURCE This is a Notice of Intent published in accordance with Federal Acquisition Regulation (FAR) 5.101(a)(1) requiring the dissemination of information regarding proposed contract actions. This Notice of Intent is for a proposed award of a sole source, firm-fixed price contract under the authority of FAR 8.405-6(a)(1)(B); only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized. The Department of Veterans Affairs, Network Contracting Office 23 intends to award a sole source, firm-fixed price contract to Omnicell, Inc. for Gold Maintenance and Service Plan for Omnicell equipment owned, installed, and operated at the Iowa City, Iowa, Des Moines, Iowa, and Sioux Falls, South Dakota, VA Health Care Systems (VAHCS). Omnicell Inc shall provide software updates and upgrades, phone support, on-site response, repair and replacement of parts, remote software and interface diagnostics, in-service training, system administrator training, and biomedical engineer training for shared services for Omnicell equipment (automated pharmacy cabinets, automated supply cabinets, and optiflex supply management solutions). Service Technicians must have original equipment manufacturers (OEM) training, full and unfettered access to all OEM service publications, diagnostic services, and software. The proposed requirement is being solicited on a sole-source basis to Omnicell Inc which retains the exclusive right to not distribute, sell or service their systems through any other source within the US Government marketplace. The proposed action is for the procurement of service from one source pursuant to FAR 6.302-1(a)(2)(ii). The basis for restricting competition is for the following reason: The Omnicell System is a proprietary system for medication administration and management. It ensures critical medications including narcotics are available for patients and provides accountability by trending/tracking administration. This maintenance agreement includes updates to software, firmware, and hardware to ensure safe and secure system performance, and for enhanced performance. Omnicell is the only servicer that provides these updates. Service of the system will also require remote VPN access. Omnicell is the only servicer with a VA approved VPN connection to access, troubleshoot, repair, configure, and update the Omnicell system remotely. The North American Industry Classification System (NAICS) code for this requirement is 819219, Other Electronic and Precision Equipment Repair and Maintenance, with a small business size standard of $20.5M. The service code is J065. THIS NOTICE OF INTENT IS NOT A REQUEST FOR COMPETITIVE QUOTATIONS. Responsible sources may identify their interest and capability to meet this requirement by submitting supporting documentation including an authorized dealer/distributor letter. Such documentation will be reviewed solely for the purpose of determining whether or not to conduct the procurement on a competitive basis.
