?.## SOURCES SOUGHT This is a SOURCES SOUGHT announcement only. It is neither a solicitation announcement nor a request for proposal or quote and does no obligate the Government to award a contract. Requests for a solicitation will not receive a response. Responses to this Sources Sought must be in writing. The purpose of this Sources Sought Announcement is for market research to make appropriate acquisition decisions and to gain knowledge of potential qualified businesses. Responses to this notice shall include: Company Name Address Point of Contact Phone, Fax, and Email DUNS number Cage Code Type of business, e.g. Service Disabled Veteran Owned Small Business, Veteran Owned Small Business, 8(a), HUB Zone, Women Owned Small Business, SDB Must provide a capability statement that addresses the organizations qualifications and ability to perform the work described below: The Eastern Kansas Healthcare System (EKHCS) which consist of 2 VA campuses in Leavenworth, and Topeka. The EKHCS is wanting to procure an Automated Dispensing Cabinets (ADC s) to expand the capability to safely secure medications in nursing units and clinics where there are currently none. VA medication storage requirements include storing medication under double lock and key. Eastern Kansas Healthcare System Campus: Dwight D. Eisenhower VA Medical Center 4101 South 4Th Street Leavenworth, Kansas 66048 Colmery-O Neil VA Medical Center 2200 Gage Blvd. Topeka, Kansas 66622 Characteristics: 2- Medstation 4000 Main, 2 drawer units (Stock Item # 303) Oncology and Cardiac Clinic) 3- Smart Remote Managers to connect with Medication Refrigerators (Stock Item #345) Eye Clinic, Oncology, and Mental Health Clinic) Medstation 4000 Aux TowerSGL (Stock Item #314, Oncology) The current network of ADC s is Pyxis brand and would need to be the same in order to communicate. Note that the Pyxis mains and auxiliary units communicate with Vista and receive patient information for medications. The Towers and smart remote mangers do not receive any patient information. They act as locked storage areas and when a medication/supply is chosen at the Pyxis cabinet, they unlock the corresponding door where the med is stored, or the refrigerator door. Task: Leavenworth Campus: The vendor will supply the equipment listed above and have it delivered to the warehouse on the Leavenworth Campus (Bldg 41) where it will be tagged for EIL list tracking purposes. It will be then delivered to the Pharmacy in Building 89, Room 237. Topeka Campus: The vendor will supply the equipment listed above and have it delivered to the warehouse on the Topeka Campus (Bldg 20) where it will be tagged for EIL list tracking purposes. It will be then delivered to the Pharmacy in Building 1 Room A10. A Pyxis technician will prepare the equipment for use in the appropriate areas. This will involve attaching the equipment to the VA inpatient network where a separate IP address is given, a gateway address, a cabinet name so it can communicate back and forth with patient names and medication lists. The current medication formulary and master patient list will be added. The vendor will supply the equipment ordered, in a new state, as well as all necessary labor, management, skills and materials as necessary to install, validate, and maintain the equipment is working order. Installation activities will require access to the VA network, and the vendor will work with IT and BioMed as needed to complete this task. Information Security - The vendor must comply with VA information security and privacy requirements throughout the entire operation and be in compliance with VA Security. Handbook 6500. Contractors, contractor personnel, subcontractors, and subcontractor personnel shall be subject to the same Federal laws, regulations, standards, and VA Directives and Handbooks as VA and VA personnel regarding information and information system security. The contractor will adhere to all HIPAA rules and regulations and Periodic software enhancements, upgrades and service will be included in the service/maintenance contract. The contractor(s) shall insure the confidentiality of all patient and employee information and shall be held liable in the event of breach of confidentiality according to federal regulations contained in HIPPA. Any person who knowingly or willingly discloses confidential information from the VA Medical Centers may be subject to fines of up to $50,000 and may be subjected to civil litigation from the patient(s). The contractor shall be compliant with VA Handbook 6500, Information Security Program System of Records: The Veterans Affairs system(s) of records to which the contractor(s) personnel will have access in order to maintain is Patient Medical Records VA (24VA136). System Security: The contractor(s) shall provide VA with the full assurance that security measures have been implemented which are consistent with OMB Circular A-130 and VA Departmental Standards. Confidentiality of Patient Records: The C&A and Security Computer Security Act of 1987, PL 100-235 Privacy Act of 1974, 5 U.S.C. 552a Healthcare Insurance Portability and Accountability Act of 1996 (HIPPA) 1.5 Fraud and Related Activity in Connection with Access Devices and Computers, 18 U.S.C. 1029-1030. Electronic Communications Privacy Act of 1986, PL 99-508 U.S.C. 3301, Confidential Nature of Claims U.S.C. 3305, Confidentiality of Medical Quality Assurance Records U. S. C 4132, Confidentiality of Certain Medical Record Maintenance and Technical Support: Provide maintenance on all contractor-provided equipment and installed systems per the terms of the contract. Contractor shall make provisions for the proper maintenance and functioning of associated equipment, facilities and fixtures as may reasonably be required to operate the device and provide after-hours support for problems with successful operation not to exceed 30 minutes from the placement of a call for assistance. Grey Market Goods: (a) Gray market items are Original Equipment Manufacturer s (OEM) goods sold through unauthorized channels in direct competition with authorized distributors. This procurement is for new OEM medical supplies, medical equipment and/or services contracts for maintenance of medical equipment (i.e. replacement parts) for VA Medical Centers. No remanufactures or gray market items will be acceptable. (b) Vendor shall be an OEM, authorized dealer, authorized distributor or authorized reseller for the proposed medical supplies, medical equipment and/or services contracts for maintenance of medical equipment (i.e. replacement parts), verified by an authorization letter or other documents from the OEM, such that the OEM s warranty and service are provided and maintained by the OEM. All software licensing, warranty and service associated with the medical supplies, medical equipment and/or services contracts for maintenance of medical equipment shall be in accordance with the OEM terms and conditions. (c) The delivery of gray market items to the VA in the fulfillment of an order/award constitutes a breach of contract. Accordingly, the VA reserves the right enforce any of its contractual remedies. This includes termination of the contract or, solely at the VA s election, allowing the Vendor to replace, at no cost to the Government, any remanufactured or gray market item(s) delivered to a VA medical facility upon discovery of such items.
