Description
Notice Type: Notice of Intent to Sole Source The Department of Veterans Affairs, Regional Procurement Office (RPO) -08 Networking Contracting Office-08 intends to award a commercial (FAR Part 12) Large Business Sole Source contract with BD-Carefusion, Solutions, LLC., under the authority of Federal Acquisition Regulation (FAR) 6.302-1. Only one responsible source and no other supplies or services will satisfy agency requirements. The Government anticipates award a Base Year plus four (4) option years, firm-fixed price contract. This acquisition is Purpose and Objectives: The intent of this Notice is to identify potential offerors capable to provide maintenance services and software support of BD-Carefusion Pyxis hardware and software through a call center available twenty-four (24) hours a day, seven (7) day a week and provide remote diagnostic testing and support, field service, relocation of Pyxis equipment, training and annual preventive maintenance for James A. Haley VA Healthcare System VAHS. CONFORMANCE STANDARDS: Contractor shall ensure that the equipment functions IAW Original Equipment Manufacturer (OEM) performance standards. Do not send any information unless if are able to demonstrate the firm s ability, capability, and responsibility to deliver the service listed above. Responses should include the following information: Business name, address, business size and Socioeconomic Category (HUBZone, 8(a), Service Disabled Veteran, Small Business, Large Business, etc.), and point of contact to include e-mail address and telephone number. All offerors must be registered in the System for Award Management (www.sam.gov) and Representations and Certifications must be completed prior to any future award. Supporting evidence must be furnished in sufficient detail to demonstrate the ability to provide the full maintenance and repair service on equipment listed. Gray Market (a) Gray market items are Original Equipment Manufacturers (OEM) goods sold through unauthorized channels in direct competition with authorized distributors. This procurement is for new OEM medical supplies, medical equipment and/or services contracts for maintenance of medical equipment (i.e. replacement parts) for VA Medical Centers.   No remanufactures or gray market items will be acceptable. (b) Vendor shall be an OEM, authorized dealer, authorized distributor or authorized reseller for the proposed medical supplies, medical equipment and/or services contracts for maintenance of medical equipment (i.e. replacement parts), verified by an authorization letter or other documents from the OEM, such that the OEM s warranty and service are provided and maintained by the OEM.   All software licensing, warranty and service associated with the medical supplies, medical equipment and/or services contracts for maintenance of medical equipment shall be in accordance with the OEM terms and conditions. (c) The delivery of gray market items to the VA in the fulfillment of an order/award constitutes a breach of contract.   Accordingly, the VA reserves the right to enforce any of its contractual remedies. This includes termination of the contract or, solely at the VA s election, allowing the Vendor to replace, at no cost to the Government, any remanufactured or gray market item(s) delivered to a VA medical facility upon discovery of such items.   THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE QUOTES. This notice does not constitute an invitation for bids or a Request for Quote (RFQ) and is not a commitment by the U.S. Government to procure subject services. No funds are available to pay for preparation of responses to this notification. No solicitation package is available. Interested persons may identify their capability to respond to these requirements by Tuesday 29 August 2019 in or before 1100 AM Eastern Standard Time. A determination by the Government not to compete this proposed contract action based on response to this notice is solely within the discretion of the Government. The Government will use the information received to determine whether other sources are available and capable of satisfying this requirement.
