VHAPM Part 816.5 Indefinite-Delivery Contracts Attachment 1: Request for Exception to Fair Opportunity Memo Format VHAPM Part 816.5 Indefinite-Delivery Contracts Page 1 of 6 Original Date: 08/30/2017 Date: 03/11/2019 Rev 02 DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Exception to Fair Opportunity Memo Acquisition Plan Action ID: 36C246-19-AP-5210 Contracting Activity: Department of Veterans Affairs, VISN 6, Richmond Medical Center, 2237 # Description of Action: The Hunter Holmes McGuire VAMC in Richmond, VA requires a sole source fixed-price task order against Alvarez s SEWP contract # NNG15SD19B for a full-time engineer to support the recently installed Converged Virtual Infrastructure (CVI). This Order shall have a period of performance of one year. Description of Supplies or Services: VISN 6 Healthcare Technology Management is requesting an on-site resident engineer and support service for the recently installed Converged Virtual Infrastructure at each of the VISN 6 medical centers. The vendor will provide an onsite engineer to perform storage management, virtual machine management and other duties as assigned by the COR or identified individuals. The Alvarez engineer will complete all hospital orientation training and continuing training as a contractor and act as the primary point of contact for VISN 6 Healthcare Technology Management as it relates to the CVI hardware and software. The engineer will also provide design optimization, rule changes, user profile additions, and database updates. The total estimated value of the proposed action is REDACTED. Statutory Authority: The statutory authority permitting an exception to fair opportunity is Section 41 U.S.C. 4106(c) as implemented by the Federal Acquisition Regulation (FAR) Subpart 16.505 Subpart 16.505(b)(2)(i): ( ) FAR Subpart 16.505(b)(2)(i)(A): The agency need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays. ( ) FAR Subpart 16.505(b)(2)(i)(B): Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized. (X) FAR Subpart 16.505(b)(2)(i)(C): The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order. ( ) FAR Subpart 16.505(b)(2)(i)(D): It is necessary to place an order to satisfy a minimum guarantee. ( ) FAR Subpart 16.505(b)(2)(i)(E): For orders exceeding the simplified acquisition threshold, a statute expressly authorizes or requires that the purchase be made from a specified source. The statutory authority permitting an exception to fair opportunity for this action is 38 U.S.C. 8127(c), known as the Veterans First Contracting Program which provides the authority to directly contract with a Service-Disabled Veteran-Owned Small Business (SDVOSB) or a Veteran-Owned Small Business (VOSB). ( ) FAR Subpart 16.505(b)(2)(i)(F) In accordance with section 1331 of Public Law 111-240 (15 U.S.C. 644(r)), contracting officers may, at their discretion, set aside orders for any of the small business concerns identified in 19.000(a)(3). When setting aside orders for small business concerns, the specific small business program eligibility requirements identified in part 19 apply. Rationale Supporting Use of Authority Cited Above: The VA Richmond VAMC requires an Alvarez onsite engineer to implement the new CVI hardware and software. This instrumentation has been implemented VISN-wide and requires an onsite engineer to ensure the proper installation and training is offered to the VA staff. Alvarez engineers have the unique knowledge and expertise to complete these tasks as well as serve as support for all other VISN facilities that are currently implementing the same system. Limited competition exists because this system requires an engineer that is capable of maintaining and advising on brand name Cisco servers, brand name Cisco chassis, fabric interconnects, blade servers, Nexus switches and Dell/EMC Storage controllers, and storage shelves. The engineer also has expertise in software licenses, software support, hardware maintenance, and installation services for the aforementioned brand name products. Failure to procure this additional engineering service would negatively impact the VISN s ability to provide Medical Center BioMed backup and server virtualization, isolation and retention needs, and reliable system operations and redundancy for the overall information technology infrastructure for all seven VISN 6 VAMCs. This is a follow-on to order # 36C24618F4906. Alvarez engineers have intimate knowledge of the facilities, where they are in the implementation process. The use of another firm would result in project delays which will result in unnecessary costs. 6. Efforts to Obtain Competition: There is no competition anticipated for this acquisition. In accordance with FAR 5.301 and 16.505(b)(2), this action will be synopsized at award on the Federal Business Opportunities Page (FBO) and the justification will be made publicly available. 7. Actions to Increase Competition: The Government will continue to conduct market research to ascertain if there are changes in the market place that would enable future actions to be competed. 8. Market Research: IAW FAR 10.002(b)(1), The contracting officer may use market research conducted within 18 months before the award of any task or delivery order if the information is still current, accurate, and relevant. The market research for order # 36C24618F4906 will be used and is considered to be accurate and relevant. VA technical experts conducted market research in March and April 2018 by researching other similar hardware, software, and services from NetApp, Nutanix Corporation, International Business Machines, and Hewlett Packard. After an extensive review by VA's technical experts, these other products and services were unable to meet the compatibility and interoperability requirements needed to replicate to existing VxBlocks CVI environments as outlined in section S of this justification. In addition, no other source was found to meet VA's needs due to the proprietary source code specific for the premium software maintenance and required engineering and technical support required for the Dell/EMC and other vBlock components. Therefore, unauthorized hardware and software providers cannot provide the proprietary hardware or the software access to the proprietary data, source codes, and protocols of the software in order to provide the required Continuity of Operation (COOP) replication capability for the Dell/EMC VxBlock Systems or the engineering and technical support in order to provide software maintenance, fixes and updates. Additional market research was conducted in June 2018 by utilizing the NASA SEWP Provider Lookup Tool to determine whether the required brand name Dell EMC VCE VxBlock Systems hardware. software add-ons. software licenses. premium software maintenance, and technical support services are available from NASA SEWP V GWAC holders. As a result of this market research, the original award, order # 36C24618F4906, was competed and awarded to the contractor that provided the best value to the government. 9.
