Description
Summary: The U.S. Geological Survey (USGS), Department of the Interior, is contemplating the grant of an exclusive license in the United States of America, its territories, possessions and commonwealths, to USGS’s interest in the invention embodied in U.S. Patent No(s). 7,294,275 and 7,491,322, titled “Method and Apparatus of Removing Phosphorous from Wastewater,” to a joint venture between Hedin Environmental and Advanced Pump and Equipment. USGS requests public comments on or objections to the proposed grant. The USGS provides no funding in conjunction with these potential licenses. The Technology: Scientists at the USGS have developed a novel approach in removing phosphorous from water through a filter consisting of a low-cost Iron Oxide pelletized material. The filter material can be stripped of phosphorous allowing it to be used again in a system. To express comments or objections to the exclusive license they must be received within fifteen days of the publication in FedBizOpps for consideration. Include the FedBizzOpps document number. Information relating to the prospective license will be available at this address during regular business hours, Monday through Friday, except Federal holidays. Supplementary Information This notice is issued in accordance with 35 U.S.C. 209(c)(1) and 37 CFR 404.7(a)(1)(i). 35 U.S.C. 209(c) gives USGSthe authority to grant exclusive or partially exclusive licenses in federally-owned inventions where a determination is made, among other things, that the desired practical application of the invention has not been achieved, or is not likely to be achieved expeditiously, under a nonexclusive license. The statute and implementing regulations (37 CFR 404) require that the necessary determinations be made after public notice and opportunity for filing written comments and objections. Within 15 days of publication of this notice, any person may submit in writing to USGS's Patent and Licensing Manager (see contact information), either of the following, together with supporting documents: (i) A statement setting forth reasons why it would not be in the best interest of the United States to grant the proposed license; or (ii) An application for a nonexclusive or exclusive license to the invention that evidences its ability to bring the invention to practical application expeditiously. The prospective exclusive license complies with the requirements of 35 U.S.C. 209 and 37 CFR 404.7. The proposed license would be exclusive, subject to a license and other rights retained by the United States, and subject to a negotiated royalty. USGS will review all timely written responses to this notice, and will grant the licenses if, after expiration of the 15-day notice period, and after consideration of any written responses to this notice, a determination is made in accordance with 35 U.S.C. 209(c) that the license is in the public interest. No follow-on procurement is expected to result from responses to this Notice.
