- (i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. (ii) The solicitation number is HHS-NIH-NIDA-OA-19-009239-CSS and the solicitation is issued as a Request for Quotation (RFQ). This acquisition is for a commercial item or service and is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13-Simplified Acquisition Procedures and FAR Part 12-Acquisition of Commercial Items. This acquisition is not expected to exceed the simplified acquisition threshold. THIS IS A NON-COMPETITIVE COMBINED SYNOPSIS SOLICITATION TO AWARD A CONTRACT OR PURCHASE ORDER WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME). This acquisition is conducted as non-competitive for a commercial item or service and is conducted under the authority of the Federal Acquisition Regulations (FAR) Subpart 13.106-1 (b) Soliciting from a single source. (1) For purchases not exceeding the simplified acquisition threshold, contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, or industrial mobilization). The rationale for the brand name justification is the unique capabilities of the requested product. (iii) This solicitation incorporates the provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2019-05, effective August 13, 2019. (iv) The associated North American Industry Classification System (NAICS) code: 333314- Optical Instrument and Lens Manufacturing. Small Business Size Standard: 500 employees (v) Confocal Microscope System Resonant Scanner Software and Hardware Upgrades (vi) The National Institute on Drug Abuse (NIDA), Office of Acquisition on behalf of the National Institute of Neurological Disorders and Strokes (NINDS) intends to negotiate and award a purchase order without providing for full and open competition (Including brand-name) to Nikon Instruments Inc., 1300 Walt Whitman Road, Melville, New York 11747, Phone: (631) 547-8542. The non-competitive justification is based on the fact that the original equipment manufacturer (OEM), Nikon Instruments Inc., is the only source with the capability of providing the hardware and software upgrades to the existing government-owned Confocal Microscope System Resonant Scanner Software and Hardware. Background / Purpose / Objective: The National Institute of Neurological Disorders and Strokes (NINDS) Synaptic Transmission Section (STS) combines news technique of microscopy and cell biological approaches to investigate the fundamental process of exocytosis and endocytosis as well as how the fusion pore opens, expands and close. Fluorescence microscopy is a fundamental technique used in the laboratory to perform fluorescence protein-based experiments for detecting the kinetics of fusion pore during vesicle exocytosis in living cells. These experiments require 700 Hz time resolution to detect signals, therefore an upgrade to the existing government-owned Nikon Confocal Microscope system is required. This upgrade will be used to study the molecular mechanism of the fusion pore opening and closure with fast scanning. The hardware and software upgrades include: (1) Product number: MQS42930, Product Description: NIS-Elements Illumination Sequence for flexible triggered laser/led experiment setup. Available for C, HC and AR Only, software update. Quantity: 1-each; (2) Product number: MHS50000. Product Description: NIS-Elements C Imaging Software for A1 and C2 Confocal Applications software update and reconfiguration. Quantity: 1-each; (3) Product number: A1R/DU4-HD. Product Description: HD resonant scanner upgrade includes new resonant scanner update, 4 channel GaAsP detector unit and a new PC. A1R-HD Upgrade Kit for A1 with DU4. Includes HD hardware for the A1R/DU4, required high end workstation and control cards, service visit for the upgrade and a 1-year warranty on the system (excludes lasers). SUA. Quantity: 1-each; (4) Product number: 999-53 405. Product Description: 405nm laser upgrade module on-site installation and alignment. Quantity: 1-each; and (5) Product number: 77013248. Product Description: STORM laser control card for new generation PC, PCIe-6323 NIDAQ card. Quantity: 1-each. (vii) Government's Anticipated Delivery: Within six (6) weeks After Receipt of Order (ARO). Delivery Point: FOB Destination. Delivery Location: National Institute of Neurological Disorders and Strokes (NINDS), Bethesda, Maryland 20892. The successful offeror shall coordinate delivery arrangements with the customer prior to shipment. The Loading Dock hours are as follows: 8:00 am to 4:30 pm Eastern Time, Monday through Friday except on Federal holidays. All products delivered must contain a Packing Slip (with serial numbers as applicable). (viii) The provision at FAR clause 52.212-1, Instructions to Offerors - Commercial Items, applies to this acquisition. (ix) The provision at FAR clause 52.212-2, Evaluation - Commercial Items, applies to this acquisition. The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The factors used to evaluate offers are the unique technical and performance capabilities of product and cost. Technical and past performance, when combined, are significantly more important than cost or price. (x) Offerors are advised to include a completed copy of the provision at FAR clause 52.212-3, Offeror Representations and Certifications - Commercial Items, with its offer. (xi) FAR clause at 52.212-4, Contract Terms and Conditions - Commercial Items, applies to this acquisition. (xii) FAR clause at 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders - Commercial Items, applies to this acquisition. (xiii) There are no additional contract requirement(s) or terms and conditions applicable to this acquisition. (xiv) Defense Priorities and Allocations System (DPAS) and assigned rating, is not applicable to this solicitation. (xv) All quotations or offers are due 12:00 Noon, Eastern Time, on September 18, 2019, and must reference the solicitation number noted herein.
