- This is NOT a solicitation. This is a Notice of Intent to Sole Source. This Notice of Intent to Sole Source is being synopsized in accordance with FAR 5.101(a)(2) and 5.203(a)(1). The U.S. Army Corps of Engineers (USACE), Portland District intends to award a sole source contract for the acquisition of Rockwell Automation/Allen-Bradley software (Brand Name) in support of The Dalles Dam Station Service Supervisory Control and Data Acquisition(SCADA) system at The Dalles Lock and Dam, Oregon. This contract will be a Single Source, awarded to a large business, North Coast Electric, the only local authorized distributor of Allen Bradley/Rockwell products in the area that The Dalles Lock and Dam resides. It is the policy of Rockwell Automation that the purchase of Rockwell Automation Branded Products from an unauthorized source would make the warranty void, there would be no product safety/recall notices, no intellectual property indemnity, no quality assurance and no customer support. The statutory authority for this non-competitive acquisition is 10 U.S.C. 2304 (c)(1) as implemented by FAR 13.106-1(b)(1) - Soliciting from a Single Source for purchases not exceeding the simplified acquisition threshold. A SOLICITATION WILL NOT BE POSTED The Government intends to proceed with this sole source action. The NAICS code is 511210 - Software Publishers. The size standard as defined by the U.S. Small Business Administration is $38.5 million. THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS OR QUOTATIONS Interested concerns must show clear and convincing evidence that competition of this requirement would be advantageous to the Government by submitting a capability statement that they have ability to complete the above services in the required timeframe. If no affirmative written responses are received by 12:00 PM Pacific Time on September 16, an award will be made without further notice. Oral communications are not acceptable in response to this notice. A determination by the Government not to compete this proposed requirement is solely within the discretion of the Government. The U.S. Army Corps of Engineers is not responsible for any costs incurred by responding to this notice.
