Description
Notice of Intent to Sole Source INTENT TO SOLE SOURCE The Air Force Installation Contracting Center (AFICC) intends to negotiate and award a non-competitive, sole source Firm Fixed Price contract to Magellan Healthcare, Inc., located at 14100 Magellan Plaza Maryland Heights, MD 63043-4644 for the project entitled, "Employee Assistance Program Services". The proposed period of performance is for a base period of 1 October 2019 through 30 September 2020, with one (1) four (4) month option period of 1 October 2020 through 31 January 2021. The statutory authority permitting Other Than Full and Open Competition is 41 U.S.C. 253(c)(1), as implemented by FAR 6.302-1 (b)(1), which provides for limiting competition in those situations where the services are available from only one responsible source and no other type of services will satisfy the AFICC 's requirements. The designated North American Industry Classification System (NAICS) Code is 541612, Human Resources Consulting Services, with a size standard of $16.5M. The Health Promotion for Government Employees Act, Pub. L. No. 79-658, 60 Stat. 903 (1946), as amended and codified at 5 U.S.C. § 7901, authorizes the head of an agency to establish a health service program to promote and maintain the physical fitness and emotional well-being of federal employees. The current contract (HHSP233201400013C) was written by the Department of Health and Human Services (DHHS), Federal Occupational Health (FOH), and awarded to Magellan Healthcare, Inc., on 1 May 2014. This contract will expire on 9 November 2019 due to the Health and Human Services Agency ending an inter-agency agreement (A220507 dated 18 December 2018) that included all of the Department of Defense (DoD). The Air Force is now faced with an urgent need to provide these critical and legislatively-mandated services. The need for continuation of services during this process makes Magellan Healthcare, Inc., the only viable service provider for the sole source award. Award of a sole source contract to the incumbent contractor will allow the USAF to meet mission requirements and to ensure that customer requirements abide by government regulations. The current contract was awarded as a firm-fixed price contract. The Air Force intends to follow the same format for this transitional bridge contract. IAW FAR 6.302-1, Magellan Healthcare, Inc., is the only capable source for EAP services within this sixty (60) day time-frame. Magellan Healthcare, Inc., has the staff and capability to provide services on day one (1) with little to no transition or start up delays. Awarding to Magellan Healthcare, Inc., will prevent a lapse in service delivery as there is no other vehicle available to ensure continuity of these critical and legislatively-mandated services. The requested sole source contract extension is an expedient and short-term solution so that the Air Force can continue to provide EAP services until a new contract can be awarded, an Authority to Operate (ATO) be issued, and services transitioned to the successful contractor. This notice of intent is not a request for competitive proposals and no solicitation is available. Any interested responsible party that believes it is equally or otherwise uniquely capable of meeting the requirements described herein may submit a proposal (to include contact information, size status under NAICS 541612, DUNS Number, and CAGE Code). Supporting evidence must be furnished in sufficient detail to demonstrate the ability to fulfill this requirement, must clearly demonstrate that competition would be advantageous to the Government and would not create a break in service or degradation of performance quality. All responses must be provided in writing to the Contracting Officer (JoAnn Parks) with a copy to the Contract Specialist (Jamie Harrell) not later than 4:00 PM Local Dayton, Ohio Time (Eastern) on 4 October 2019. A determination by the Government not to compete this proposed contract action is solely within the discretion of the Government. The Government will not be responsible for any costs incurred by responding to this notice. This notice in no way obligates the Government to award any modifications to the existing contracts.
