- Sole Source Justification The John A. Volpe National Transportation Systems Center (Volpe Center), Cambridge, MA, is supporting the Federal Transit Administration (FTA) in providing a series of one-day seminars on Drug and Alcohol Testing Regulation training. The Omnibus Transportation Employee Testing Act of 1991 requires drug and alcohol testing of safety-sensitive transportation employees in aviation, trucking, railroads, mass transit, pipelines and other transportation industries. The US Department of Transportation (DOT) publishes rules on who must conduct drug and alcohol tests, how to conduct those tests and what procedures to use when testing. This is accomplished through the provision of training to assist FTA grantees, state DOTs, sub-recipients, safety-sensitive contractors, FTA-covered employers, vendors and others in understanding to the greatest extent possible the spirit, letter and law of the drug and alcohol testing regulations (49 CFR Parts 655 and 40). The Government intends to award a purchase order on a sole source basis under FAR Subpart 13.106-1(b) to Cahill Swift, who is the primary trainer of DOT drug and alcohol testing regulatory requirements for the FTA and has been since the inception of the program in 1995. The NAICS Code is 541611; the Small Business size standard is $15M. Notice: Interested firms must submit a written capability statement to the above named point of contact providing clear and convincing evidence of the firms' capability to provide the required services. Written capability statements must be submitted within eight (8) calendar days from the date of publication of this synopsis. Responses received after eight (8) calendar days or without the required documentation will be considered non-responsive and will not be considered. Such documentation will be utilized solely for the purpose of determining whether or not to conduct this procurement on a competitive basis. The Government will not pay for any documentation provided in response to this synopsis and documentation received will not be returned to the sender. A determination by the Government not to compete this requirement on a full and open competitive basis, based upon responses received to the synopsis, is solely within the discretion of the Government. Telephone calls made in place of the required documentation will not be accepted.
