Description
THIS SYNOPSIS IS FOR INFORMATIONAL PURPOSES ONLY. The Program Executive Officer Land Systems (PEO LS), Marine Corps, Quantico, VA 22134 intends to enter into sole source negotiations and subsequently award a Basic Ordering Agreement (BOA) to Northrop Grumman Systems Corporation (NGSC) - 1580A W. Nursery Road, Linthicum Heights, MD 21090-2202 (CAGE Code: 2S209). This effort is estimated for award in the third quarter of Fiscal Year 2020 with an approximate period of performance of 60 months. The anticipated BOA is for the procurement of sustaining engineering and logistics support for the Ground/Air Task Oriented Radar (G/ATOR) program. BOA t ask orders will provide the support necessary for resolution of warfighter reported problems and associated engineering and logistics issues to include engineering changes, contractor logistics support, depot life cycle support, Software Support Activity support, Diminishing Manufacturing Sources and Material Shortages support, technical refresh, and studies and analyses. This effort will also include retrofit of the six fielded G/ATOR Low Rate Initial Production (LRIP) systems, configured with Gallium Arsenide ( GaAs) technology, to Gallium Nitride ( GaN) technology. The Government has determined that NGSC is the only commercial company capable of providing sustaining engineering and logistics support to the G/ATOR program. The ability to provide sustaining engineering and logistics support for the G/ATOR systems is dependent on access to the complex engineering and technical data used in the design and development process of the G/ATOR systems by NGSC. A significant amount of technical data and software for the G/ATOR systems remains proprietary to NGSC and its subcontractors and is not releasable to sources outside the Government. In order for a contractor other than NGSC to provide systems engineering and logistics support to the G/ATOR program, NGSC and the Government would be required to provide the selected vendor with a comprehensive Technical Data Package (TDP) for which the Government currently only has government purpose rights. NGCS has asserted restrictions to the Government's rights to significant portions of the G/ATOR's TDP and will not allow third party vendors access to these portions. Therefore, PEO LS is currently unable to provide the associated technical data necessary in order to foster a competitive procurement. THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. This acquisition is being pursued on a sole source basis under the statutory authority of 10 U.S.C. 2304(c)(1), as implemented by Federal Acquisition Regulation (FAR) 6.302-1(a)(2)(iii)(A) "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirement." Unless stated herein, no additional information is available. Requests for the same will be disregarded. Responsible interested parties may submit a capability statement in which they identify their interest and capability to respond to this requirement. The capability statement must be received by PEO LS within seven calendar days after the date of the publication of this synopsis. The U.S. Government (USG) will consider all information received by the response date. A determination by the Government not to compete this requirement based upon responses received as a result of this notice is solely within the discretion of the Government. All submissions become USG property and will not be returned. Contractors are advised the USG will not pay for any information or administrative costs incurred in response to this notice of intent.
