- Presolicitation Notice for W15QKN-19-R-0133 The U.S. Army Contracting Command - New Jersey (ACC-NJ), Picatinny Arsenal, New Jersey 07806-5000, on behalf of the Program Manager-Close Combat Systems (PM-CCS) intends to issue a Request for Proposal (RFP) for the production of the M211 Infrared Countermeasure Decoy, and the MJU-50A/B and MJU-51A/B Infrared Countermeasure Decoys. The M211, MJU-50/B and MJU-51/B Countermeasure Decoys provide U.S. aircraft protection against advanced air-to-air and surface-to-air infrared weapon systems as an effective solution against infrared seeking Man Portable Defense (MANPAD) missiles. The contractor shall be responsible for the manufacture, assembly, inspection, testing, packaging, marking and shipping of the above items in accordance with a Government Technical Data Package (TDP), drawings and performance specifications. The applicable North American Industry Classification (NAICS) Code for this effort is: 325998. The Government intends to fulfill this requirement with a single award, five year, Firm Fixed Price (FFP), Indefinite Delivery/Indefinite Quantity (ID/IQ) utilizing best value full and open competition with the exception of the Pyrophoric Material Manufacturing Process (PMMP) utilized in the M211 Infrared Countermeasure Decoy, the MJU-50 A/B and the MJU-51 A/B Infrared Countermeasure Flares. The PMMP will be restricted to the National Technology and Industrial Base (NTIB) under the authority 10 U.S.C. 2304(c)(3), as implemented by FAR 6.302-3, Industrial Mobilization; Engineering, Development, or Research Capability; or Expert Services. It is anticipated that one award will be made as a result of the forthcoming solicitation. The maximum contract value is estimated at $28,823,677; with a minimum guarantee of $1,100,000. The initial delivery order will satisfy the contract minimum. The Government-owned TDP, drawings and performance specifications will be provided as an attachment to the upcoming solicitation. The Government-owned TDP, drawings and performance specifications are marked as Distribution Statement D (Distribution authorized to the Department of Defense and U.S. DoD contractors only.) The TDP, drawings and performance specifications contain technical data whose export is restricted by the Arms Export Control Act (Title 22, U.S.C., Sec 2751, et. seq.) or the Export Administration Act of 1979, (title 50 U.S.C., App. 2401 et seq.) as amended. Violations of these export laws are subject to severe criminal penalties. Disseminate in accordance with provisions of the DoD Directive 5230.25. The M211, MJU-50 and MJU-51 performance specification also contains a classified appendix. The pyrophoric payload material used in the current M211 Countermeasure Flare Decoy, MJU-50/B and MJU-51/B must perform to the performance specification. Any interested parties who wish to request a copy of the TDP must provide a signed and approved DD form 2345 Military Critical Technologies Data Agreement. If an interested party is not based in the U.S., a copy of their approved Export License issued by the U.S. Department of State must be provided as well. After receipt of these documents, the Contract Specialist will provide an AMSTA-AR Form 1350 Technical Data Questionnaire and a completed and signed Non-Disclosure / Non-Use Agreement for completion. When all completed documents are received by the Contract Specialist, the TDP will be sent. Note: These forms will be provided as an attachments when the solicitation is posted. DESTRUCTION NOTICE: For classified documents, follow the procedures in DoD 5220.22-M, Industrial Security Manual, or DoD 5200.01 Volume 3, DoD Information Security Program Regulation. For unclassified, limited documents, destroy by any method that will prevent disclosure of contents or reconstruction of the document in accordance with DoD 5200.01, Volume 4. Please note this notice does not constitute a Request for Proposal (RFP) and is not to be construed as a commitment by the U.S. Government. Responses to this announcement are not proposals and cannot be accepted by the Government to form a binding contract. This is not a guarantee of a future RFP/solicitation or an award. It is anticipated that a solicitation will be issued on or about fifteen (15) calendar days from the date of this announcement. Proposals will be required within thirty (30) calendar days from issuance of the solicitation.
