Page 1 of 2 The Department of Veterans Affairs, Network Contracting Office 22, is issuing this special notice to inform industry contractors of the intent to execute a Single Source award as prescribed in FAR 13.106-1(b)(i) with Becton, Dickinson And Company, 2350 Qume Dr, San Jose, CA 95131 Prior to soliciting, market research was conducted and concluded only one vendor can provide the proprietary supplies/services. Limited market research was completed due to the proprietary nature of the BD FACS Flow Cytometer currently at the VAMC laboratory. There are no current vendors or FSS contract holders capable of providing the required supplies/services. In accordance with FAR Part 13, specifically Subpart 13.106-1(b)(i), there is only one (1) responsible source and no other services will satisfy agency requirements. The VA San Diego Healthcare System requested Flow Laboratory Supplies for their current BD FACS Flow Cytometer system. This request is to replenish critically low supplies at the VAMC San Diego Laboratory. A verbal agreement was authorized by the designated Contracting Officer as an award date of 10-10-2019 in order to prevent a break in patient services. The period of performance is from 10-10-2019 through 09-30-2020. A solicitation for new equipment and services at this point will cause a break in service and cause direct harm to patient care. Becton, Dickinson And Company is the sole manufacturer and distributor for Flow Cytometer supplies and services. Becton, Dickinson And Company is a responsible source who has worked with the Department of Veterans Affairs on previous acquisitions. This procurement is being conducted using commercial item procedures pursuant to FAR Part 12 and FAR part 13. The place of performance is as follows: VA San Diego Healthcare System, 3350 La Jolla Village Drive San Diego, CA 92161. The North American Industry Classification System (NAICS) for this requirement is 334516. The Small Business Administration size standard for this sector is 1,000 employees. This notice of intent is neither a formal solicitation nor a request for competitive quotes. No solicitation document is available and telephone requests will not be honored. No award will be made on the basis of unsolicited quotations or offers received in response to this notice. Any response to this notice must show clear, compelling and convincing evidence that competition will be advantageous to the Government. The intent of this synopsis is for informational purposes only. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. A determination by the Government not to compete this action based on this notice is solely within the discretion of the Government. Interested parties may identify their interest and capabilities no later than 4:00 p.m. Pacific Daylight Time on November 30, 2019. Interested shall e-mail all statements, quote, and capabilities; the senders bear full responsibility to ensure complete transmission and timely receipt.
