- UNITED STATES DEPARTMENT OF VETERANS AFFAIRS NETWORK CONTRACTING OFFICE 17 NOTICE OF INTENT TO SOLE SOURCE / SOURCES SOUGHT NOTICE On behalf of the South Texas Veterans Healthcare System (STVHCS), 7400 Merton Minter Blvd. San Antonio, TX 78229; Network Contracting Office (NCO) 17 intends to award a firm-fixed price delivery task order against GENOMIC HEALTH INC task order number V797D70053 for procurement of the following Oncotype DX test: Oncotype DX Breast Cancer Assay, CPT 81519 Oncotype DX Prostate Cancer Assay, PLA 0047U Oncotype DX Breast Cancer Assay, DCIS CPT PLA 0045U The anticipated statutory authority permitting limiting the source for the requirement is FAR 8.405 6(a)(1)(i)(B) - Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized. STVHCS requires a vendor to perform the following special cancer tests: Oncotype DX Breast Cancer Assay, the Oncotype DX Prostate Cancer Assay and the Oncotype DX Breast Cancer Assay DCIS, which are trademarked tests by Genomic Health. The required testing will analyze the activity of a group of genes that can affect how a cancer is likely to behave and respond to treatment. Testing results need to show how complex genes are expressed in cells (what their level of activity is), and the role they play in specific cancers including breast, colon, and prostate. The acquisition is anticipated to take place on or about November 6, 2019. The period of performance will be for a base year and 2 option years. The intended procurement will be classified under North America Industry Classification System (NAICS) 621511 with a small business size standard of $35 Million. This notice of intent is not a request for offers. However, all responsible sources may submit a capabilities statement that proves by the preponderance of the evidence that another contractor can provide an equivalent or higher performance to the Oncotype DX test. Equivalent tests must show clinical evidence and at least three years on the market in labs (outside of research purposes). The STVHCS requires testing that has been reliable for years and will not risk experimenting with newer specialized cancer tests unless evidence guarantees greater benefits to Veterans. All capability statements received by the closing date of this synopsis will be considered by the government. A determination by the government not to compete based on responses to this notice is solely within the discretion of the government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. Capability statements shall be submitted by email only as a MS Word or Adobe PDF attachment to Ross Futch via email at ross.futch@va.gov. Capability statements are due not later than 4:00 PM Central Standard Time on Friday 1 November 2019. No phone calls will be accepted.
