- Naval Information Warfare Center Atlantic (NIWC Atlantic), North Charleston, SC, intends to revise the existing 52.216-22 INDEFINITE QUANTITY (OCT 1995) clause paragraph (d), from one hundred and eighty (180) days after the contract ordering period, to twelve (12) months after the ordering period expiration. This modification is necessary to permit the continuity of services to meet the current and immediate future demands of NIWC Atlantic in its support of Corporate Operations Functional Support (COFS). These services are critical to ensure continuity of operations across all command competencies. This action is being pursued under the statutory authority of 10 U.S.C. 2304(c)(1), as implemented by the Federal Acquisition Regulation (FAR) 6.302-1(a)(2)(iii)(B), only one responsible source or limited number of responsible sources. This Notice of Intent to modify this contract is not a request for competitive proposals. Any response to this notice must show clear and convincing evidence that competition of the work required would be advantageous to the Government. A determination by the Government not to compete the contract modification action based on this notice is solely within the discretion of the Government.
