Description
REGULATORY AUTHORITY This acquisition is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13—Simplified Acquisition Procedures, Subpart 13.5 Simplified Procedures for Certain Commercial Items.The resultant contract will include all applicable provisions and clauses of the Federal acquisition Requlation (FAR) in effect through the Federal Acquisition Circular (FAC) 2020-02, dated November 22, 2019.DESCRIPTIONPursuant to FAR Subpart 5.2—Synopses of Proposed Contract Actions,THIS IS A PRE-SOLICITATION NOTICE OF INTENT TO AWARD A CONTRACT OR PURCHASE ORDER WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME). The National Institute on Drug Abuse (NIDA), Office of Acquisitions intends to negotiate and award a contract for two service agreements: one for an Orbitrap Fusion Lumos Mass Spectrometer system and another for a QExactive HF system. The requiring agency is the Translational Neuroscience Center/Clinical Proteomics Unit, National Institute of Neurological Disorders and Stroke (TNC/CPU, NINDS).The purpose of this requirement is to procure preventive maintenance services on existing Government-owned laboratory equipment manufactured by Thermo Electron: 1) An Orbitrap Fusion Lumos mass spectrometer + Ultimate 3000 RSLCnano Ultra High-Pressure Liquid Chromatography System, and 2) A QExactive HF Mass Spectrometer + Ultimate 3000 RSLCnano Ultra High-Pressure Liquid Chromatography System. The contractor shall be an Original Equipment Manufacturer (OEM) Authorized Service Provider of this equipment, and all services shall be performed by OEM certified factory-trained technicians using genuine OEM parts. The requiring agency is the Translational Neuroscience Center/Clinical Proteomics Unit, National Institute of Neurological Disorders and Stroke (TNC/CPU/NINDS).The TNC/CPU provides NINDS clinical investigators with access to state-of-the-art mass spectrometry-based proteomics technology. CPU is also developing analytical mass spectrometry-based methods for proteomic analyses of cerebrospinal fluid (CSF) to both identify and quantify changes in the CSF proteome associated with neurological disorders. The CPU goal is to identify candidate biomarkers in disease state versus control analyses. The development of CSF biomarkers is the best possible outcome for therapeutic development in different neuroinflamatory and neurodegenerative conditions. This is accomplished by using absolute quantitative methods to screen candidate biomarkers for selectivity and specificity. In the event an investigator has pre-determined candidate biomarkers, either from alternate methodologies or literature review, the discovery phase can be omitted and the investigator can proceed directly to biomarker validation.The Orbitrap Fusion Lumos Mass Spectrometer and Ultimate 3000 RSLCnano Ultra High-Pressure Liquid Chromatography System and QExactive HF Mass Spectrometer and Ultimate 3000 RSLCnano Ultra High-Pressure Liquid Chromatography System are used to precisely measure and analyze protein and peptides, small molecules, and a defined set of biomarkers with high selectivity and sensitivity.ANTICIPATED SOURCEThermo Electron North America LLC (Thermo Electron)1400 N Point Pkwy Ste 10West Palm Beach, FL 33407-1976ANTICIPATED PERIOD OF PERFORMANCEContractor will perform required maintenance/repairs services from December 10, 2019 through December 09, 2024, which includes a base year and four option years:Base year: 12/10/2019 - 12/09/2024Option year 1: 12/10/2020 - 12/09/2021Option year 2: 12/10/2021 - 12/09/2022Option year 3: 12/10/2022 - 12/09/2023Option year 4: 12/10/2023 - 12/09/2024PLACE OF PERFORMANCEThe place of performance will be NIH Main Campus, 49 Convent Drive, Building 49, Room 2B63, Bethesda, MD 20892.REASON FOR NON-COMPETITIVE ACTIONAs stated in a letter from the manufacturer, which is included in the file, Thermo Electron is the only authorized service provider for both the Obitrap Fusion Lumos mass spectrometer + Ultimate 3000 RSLCnano Ultra High-Pressure Liquid Chromatography and QExactive HF Mass Spectrometer + Ultimate 3000 RSLCnano Ultra High-Pressure Liquid Chromatography systems. Thermo Electron has proprietary rights to the design and software utilized in these instruments and is the only company with access to proprietary performance verified component parts, spare parts, software, technical support, upgrades and engineering resources to maintain the original operating specifications. Additionally, Thermo Fisher Scientific Field Service Engineers are the only company-certified and factory-trained engineers available to service these instruments.Due to how much the program office has invested into these systems, using a service provider that is not authorized would pose too much risk to the Government. As well, procuring new equipment through a competitive solicitation is not financially feasible at this point in time and would not represent the best value to the Government. As a result, the Government intends to award this requirement to Thermo Electron without providing for competition.CLOSING STATEMENTThis synopsis is not a request for competitive proposals. All responsible sources may submit a capability statement, however, which shall be considered by the agency. Responses to this notice must include clear and convincing evidence of the offeror’s capability of fulfilling the requirement. In addition the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size must be included in the response. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov.A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. Your mass-market commercial and/or license agreement may include provisions that are customarily found in the commercial sector but which are not appropriate for a contract with a Federal agency. Specifically, NINDS considers any provision in your mass-market commercial and/or license agreement to be inappropriate and unenforceable that: (1) Contravenes a right granted NINDS under U.S. copyright law (e.g., fair use, right to archive, copying for interlibrary loan), (2) Violated the Federal Acquisition Regulation or other Federal law (e.g., Antideficiency Act, Principles of Federal Appropriations Law), (3) Departs from reasonable consumer expectations and was not disclosed by the Licensor prior to agreement, or (4) Violates fundamental public policy.We shall assume that you are in agreement with the statements herein if you submit a response.
