Description:This is a special notice prepared in accordance with Federal Acquisition Regulation (FAR) 5.2 "Synopses of Proposed Contract Actions” and DFARS 206.302-1.The U.S. Army Corps of Engineers (USACE), Far East District (POF) intends to negotiate/award a sole-source firm-fixed price bridge modification to with PAE Professional Services (CAGE: 1CA36) pursuant to 10 USC 2304 (c) FAR subparagraph 6.302-1 (b) (2) Only One Responsible Source.This contract action will provide site security monitoring services (SSMS) for the PHASE III Secure Facility at USAG Humphreys, Korea. The services include all aspects of physical, personnel, technical, and procedural security as required to fully comply with Intelligence Community Directive (ICD) 705 and ensure successful accreditation of the secure facility. The contract scope includes the full range of construction security program management, administrative, construction surveillance operations, including demobilization and closeout.The statutory authority for this non-competitive acquisition is 10 United States Code 2304(c)(1) as implemented in Federal Acquisition Regulation 6.302-1(a)(2)(iii): Only one responsible source and no other services will satisfy agency requirements; this is a continuation of the current contract for an additional two months and it is likely that award to any other source would not meet the current schedule and result in substantial costs to the Government and risk the security accreditation of the facility. It is unlikely that cost would be recovered through competition and would result in potential delays to construction in fulfilling the Government's requirements.The current task order expires on 29 February 2020. The follow-on contract has not been awarded and it is anticipated that a gap in services will occur beginning March 2020 until May 2020, therefore a bridge contract is necessary to ensure adequate time for award and mobilization of the awardee. The site is under continuing construction but multiple construction delays have occurred extending the SSMS contract for over a year.A gap in security coverage on this project will result in a security accreditation failure and the tenant organization will be unable to occupy the facility due to operational requirements. The incumbent has performed all SSMS services for SCIF USACE-FED projects since 2016. Adequate competition is being conducted on the follow-on contract, however adequate competition cannot be achieved in the timeline that exists before the current period of performance expires. A lapse in these services would result in significant delays in the completion of construction of this facility and duplication in costs to the Government.A SOLICITATION WILL NOT BE POSTED.The Government intends to proceed with this sole source action. 561612 - Security Guards and Patrol ServicesResponses to this notice must demonstrate clear and convincing evidence that competition would be advantageous to the Government, would not be cost or time prohibitive, and would not hinder the mission objective of using other than an OEM product. Information received will normally be considered for the purposes of determining whether to conduct a competitive procurement. The Government will not be responsible for any costs incurred by responding to this notice. THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS OR QUOTATIONS. All responsible sources may submit a capability statement, proposal, or quote to the contracting officer before the notice end date. If no affirmative written responses are received by 09:00 AM (Korea Standard Time) on 20 December 2019, an award will be made without further notice. Oral communications are not acceptable in response to this notice.
