- Coded Wire Tags for Hatchery ProgramNotice of Intent to Sole SourceSynopsis: This is a special notice prepared in accordance with Federal Acquisition Regulation (FAR) 5.2 “Synopses of Proposed Contract Actions.”The U.S. Army Corps of Engineers (USACE), Portland District (NWP) intends to negotiate/award a sole-source contract with Northwest Marine Technology, Inc. (NMT). This requirement is to provide coded wire tags in support of the NWP hatchery program. Each group of tags is made for a specific agency and contains a unique batch number or individual code which are hypodermically implanted into suitable fish tissue. NMT detection equipment is protected by several US Patent rights (4955396, 4655396, 4753193, and 5134370). The auto fish system is manufactured exclusively by NMT and is also protected by US Patent rights (5,816,196 and 6,145,476). The statutory authority for this non-competitive acquisition is 10 U.S.C. 2304(c)(1) as implemented by FAR 13.106-1(b)(1) Soliciting form a Single Source. For purchases not exceeding the simplified acquisition threshold, contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available. A SOLICITATION WILL NOT BE POSTED.The Government intends to proceed with this sole source action. The NAICS code is 334220 - Radio and Television Broadcasting and Wireless Communications Equipment Manufacturing. The size standard as defined by the U.S. Small Business Administration is 1,250 employees.THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS OR QUOTATIONS. All responsible sources may submit a capability statement, proposal, or quote to the contracting officer before the notice end date. If no affirmative written responses are received by 09:00 AM local time on 26 December 2019, an award will be made without further notice. Oral communications are not acceptable in response to this notice. A determination by the Government not to compete this proposed requirement is solely within the discretion of the Government.
