Description
This is a Special Notice to all Department of Homeland Security (DHS) Service Contractors. This is to alert you that the January 31, 2020 deadline for Fiscal Year (FY) 2019 Service Contract Reporting Requirements is fast approaching. In accordance with Federal regulation, failure to complete Service Contract Reporting in the System for Award Management (SAM) by January 31, 2020, will result in your noncompliance being included in your contractor performance evaluation in the Contractor Performance Assessment Reporting System (CPARS). Please note, CPARS is used to inform source selections across government. Therefore, DHS urges its contractors to complete the reporting requirement before the January 31, 2020 due date. The attached notice provides further information regarding this upcoming deadline and all other necessary requirements.Subject: Notice to all Department of Homeland Security (DHS) Service Contractors - January 31, 2020 Deadline Approaching for FY 2019 Service Contract Reporting RequirementsWhen is Service Contract Reporting required?The SAM opened for Fiscal Year (FY) 2019 Service Contract Reporting on October 10, 2019 and closes on January 31, 2020.What is Service Contract Reporting?On January 30, 2014, a final Federal Acquisition Regulation (FAR) rule became effective to implement statutory requirements for service contract supplemental reporting. The FAR requires prime and first-tier contractors to report in the SAM for the previous fiscal year the (1) total dollar amount invoiced for services performed and (2) direct labor hours expended on the services performed under certain contracts. Service Contract Reporting applies to all contract for services that contain FAR clause 52.204-14, Service Contract Reporting Requirements or FAR clause 52.204-15, Service Contract Reporting Requirements for Indefinite-Delivery Contracts.How do I know which of my awards require Service Contract Reporting?Per FAR 4.1705, awards made for services (as opposed to products) and meeting certain contract type and dollar thresholds require Service Contract Reporting. The following information is provided to assist you in determining if your award qualifies: You are required to report, if you received a DHS award that is a cost-reimbursement, time-and-materials, or labor-hour service type of contract with a total estimated value of $150,000 or more. You are required to report, if you received a DHS award that is fixed priced with a total estimated value of: $2.5M or more awarded in FY 2014; $1M or more awarded in FY 2015; or $500K or more awarded in FY 2016 and subsequent years. If you are still unsure if you are required to report or not, contact your Contracting Officer immediately.
