- This is a special notice prepared in accordance with Federal Acquisition Regulation (FAR) 5.2 ""Synopsis of Proposed Contract Actions."" US Army Corps of Engineers (USACE), Portland District intends to negotiate/award a sole-source contract with Palfinger Marine USA, Inc. The statutory authority for this non-competitive acquisition is 10 U.S.C. 2304 (c)(1) as implemented by FAR 6.302-1 and DFARS 206.302-1, Only one responsible source and no other services will satisfy agency requirements. Dredge Essayons uses a proprietary PHA davit manufactured by Schat Harding. Schat Harding has been acquired by Palfinger Marine USA and is still the proprietary supplier of replacement parts for this davit and the other lifesaving equipment and davits aboard Essayons. The existing davit hydraulic cylinders have been overhauled numerous times and have now exceeded their design service life. The manufacturer of the davit and associated components is Schat Harding, now Palfinger Marine USA. This launch carries personnel on a daily basis using proprietary components provided by Palfinger Marine USA to continue to perform safely. A SOLICITATION WILL NOT BE POSTED. The Government intends to proceed with this sole source action. The NAICS code is 336611 - Ship Building and Repairing. The size standard is 1,250 for this NAICS code defined by the U.S. Small Business Administration. THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS OR QUOTATIONS. All responsible sources may submit a capability statement to the contracting officer before the notice end date. If no affirmative written responses are received by 12:30 PM local time on�31�December 2019, an award will be made without further notice. Oral communications are not acceptable in response to this notice. A determination by the Government not to compete this proposed requirement is solely within the discretion of the Government.
