- This amendment No. 1 to this solicitation extends the due date for submission of responses to 1/2/2020 at 3 pm ET and changes the name of the sole source firm to Alligare, LLC. The manufacturer, Baker Hughes (a division of Baker Petrolite) has authorized Alligare LLC as its sole distributor for Magnacide H/Acrolein(stabilized). Firms interested in responding to this notice with their company information and quote shall submit the completed SF1449 and acknowledge this Amendment No. 1 to the solicitation via the attached SF 30. All other terms and conditions remain unchanged. The Bureau of Indian Affairs, Northwest Regional Office, intends to solicit/award a sole source, firm fixed price contract under Federal Acquisition Regulation (FAR) Part 12, Acquisition of Commercial Items, to Alligare, LLC. (1565 5th Ave., Opelika, Alabama, 36801). Alligare is the sole authorized dealer/ distributor of the required supplies. The line item description appears below and on the attached SF 1449. The requirement is for Magnacide H/Acrolein (stabilized) aquatic herbicide for irrigation /canal application. The NAICS is 325320 and the size standard is 1,000 employees. A 2,450-lb. sized skid is required for ease and efficiency of application. No other sized skid will be considered for award. A brand name justification for Magnacide H / Acrolein applies to all line items in this solicitation/resulting order because this is the only product approved by the Yakama Nation to be applied to land on Yakama Reservation land. Contractors interested in this requirement should submit a quote/ response to this request and in accordance with FAR Part 12 no later than 1/2/2020 at 3 pm ET. Submit your quote via a completed SF 1449 via email to: Anita.MacAuley@bia.gov with the subject line ""Magnacide H Wapato Irrigation 0040467781"" in the subject line of the email. The Government will consider all responses received and submitted by the due date for submission of quotes, and shall give qualified quotes received from Indian Small Business Economic Enterprises (ISBEEs) first consideration. Price shall also include pick up/ disposal of skids at the end of the irrigation season, but not later than 6 months after award. A determination by the Government not to complete this acquisition based on responses to this notice is solely within the discretion of the Government. Information received will be considered for the purpose of determining whether to conduct a competitive procurement. FAR 52.223-3 states, in part, ""d) The apparently successful offeror agrees to submit, for each item as required prior to award, a Material Safety Data Sheet, meeting the requirements of 29 CFR 1910.1200(g) and the latest version of Federal Standard No. 313, for all hazardous material identified in paragraph (b) of this clause. Data shall be submitted in accordance with Federal Standard No. 313, whether or not the apparently successful offeror is the actual manufacturer of these items. Failure to submit the Material Safety Data Sheet prior to award may result in the apparently successful offeror being considered nonresponsible and ineligible for award.""
