Only one responsible source and no other supplies or services will satisfy agency requirements. The Government does not possess or cannot provide the data necessary to perform the required repairs of the item. Repair of the existing item requires a license to L3 Technologies. proprietary data and methods. Further, any new design would have to be approved by the Government design agent. The time required for approval of a new design is normally such that an award cannot be delayed pending approval; thus, award of the subject requirement may continue based on Fleet support needs. The proposed contract action is for supplies or services for which the Government intends to solicit and negotiate with only one source under authority of FAR 6.302. Interested persons may identify their interest and capability to respond to the requirement. This notice of intent is not a request for competitive proposals; however, any capability statements received within fifteen days after date of publication of this synopsis will be considered by the Government. A determination by the Government not to compete this proposed contract action based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. The data needed to acquire this part competitively is not physically available, it cannot be obtained economically, nor is it possible to draft adequate specifications or any other adequate, economical description of the material for a competitive solicitation. AMCS 3, 4, or 5 are valid. The Government does not own the data or the rights to the data needed to purchase this part from additional sources. It has been determined to be uneconomical to buy the data or rights to the data. It is uneconomical to reverse engineer the part. This code is used when the Government did not initially purchase the data and/or rights. If only one source has the rights or data to manufacture this item, AMCs 3, 4, or 5 are valid. If two or more sources have the rights or data to manufacture this item, AMCs 1 or 2 are valid. Approval of a source is required. NAVSUP WSS will not delay award while Source Approval is pending.
