- INTENT TO SOLE SOURCE: The Roudebush VA Medical Center, located at 1481 W 10th Street, Indianapolis IN 46202 intends to sole source to Innovive LLC, a small business, located at 10019 Waples Court, San Diego CA 92121 for disposable cage/rack system. The Research service at the Richard L Roudebush VA Medical Center is proposing to purchase individually ventilated rack systems designed for the housing of laboratory rats and individually ventilated rack systems designed for the housing of laboratory mice.� It is necessary to use disposable caging because the facility where these housing systems will be used do not have a cage wash space available to clean and sterilize cages prior to use.� It is desired that the selected manufacturer be compatible with existing caging to utilize storage spaces efficiently and to provide continuity of existing rack systems currently on site. For this reason, we have requested the purchase of these racks from Innovive. This procurement is for new OEM medical supplies, medical equipment and/or services contracts for maintenance of medical equipment (i.e. replacement parts) for VA Medical Centers.� No remanufactures or gray market items will be acceptable. � (b) Vendor shall be an OEM, authorized dealer, authorized distributor or authorized reseller for the proposed medical supplies, medical equipment and/or services contracts for maintenance of medical equipment (i.e. replacement parts), verified by an authorization letter or other documents from the OEM, such that the OEM s warranty and service are provided and maintained by the OEM.� All software licensing, warranty and service associated with the medical supplies, medical equipment and/or services contracts for maintenance of medical equipment shall be in accordance with the OEM terms and conditions. (c) The delivery of gray market items to the VA in the fulfillment of an order/award constitutes a breach of contract.� Accordingly, the VA reserves the right enforce any of its contractual remedies. This includes termination of the contract or, solely at the VA s election, allowing the Vendor to replace, at no cost to the Government, any remanufactured or gray market item(s) delivered to a VA medical facility upon discovery of such items.� This notice of intent to sole source is not a request for competitive quotes; however any responsible source who believes it is capable of meeting this requirement may submit a capability statement to the contracting officer later than Friday, April 3, 2020 at 11:00 AM ET. A determination not to compete the proposed requirement based upon the responses to this notice is solely within the discretion of the Government.
