Description
NOTICE OF INTENT TO SOLE SOURCE to Vaisala INC. RFQ# N66001-20-Q-6297 The proposed contract action is for One Base year and Two Options for DIGICORA ANNUAL SOFTWARE SUPPORT AND SUBSCRIPTION MAINTENANCE which the Naval Warfare Information Center Pacific (NIWC PAC SD) San Diego intends to solicit this requirement on a sole source basis to Vaisala INC. Address: 194 South Taylor Avenue Louisville, CO 80027, under the authority of Far 13.106-1(b)(1). Justification: Under the authority of FAR 13.106-1(b)1;Sole source justification is based on Vaisala is the ONLY OEM company that can provide proprietary software and is the only vendor capable of providing patches and updates. The software has been vetted through DIACAP, DADMS and is Authorized to Operate(ATO) in our Government Systems. This is a solicitation for Supplies, prepared in accordance with the format in FAR subpart 12.6 as supplemented with additional information included in this notice. This notice of intent is not a request for competitive proposals; however, the Government will consider all proposals received within three (3) days after date of publication of this synopsis. A determination by the Government not to compete with this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of the determining whether to conduct a competitive procurement. This announcement constitutes only solicitation, quotations are being requested and a written solicitation will not be issued. The solicitation number, N66001-20-Q-6297 is issued as a request for quotation (RFQ). The North American Industry Classification System (NAICS) Code for this acquisition is 511210. Size 41.5 (# millions of dollars), The statement below applies to CLIN(s) .0001,1001,2001. The offeror certifies that the product(s) being delivered are new and in their original packaging. The subject product(s) are eligible for all manufacturer warranties and other ancillary services or options provided by the original manufacturers, authorized suppliers, or suppliers that obtain parts from the manufacturer or its authorized supplier. The offeror further certifies that it is authorized by the manufacturer to sell the product(s). The offeror is required to submit documentation identifying its supply chain for the product(s). Within the aforementioned documentation, the offeror shall also identify the country of manufacture and indicate one of the following, if applicable: � Manufacturing occurs in the U.S., but more than 50% of the cost of components is from foreign/nonqualifying country content � Originally foreign manufactured products substantially transformed in the United States or a designated country The offeror assumes responsibility for authenticity. Costs of counterfeit parts are unallowable unless the conditions set forth in DFARS 231.205-71(b) are met. By making an offer, the offeror acknowledges that a full or partial termination for default/cause for non-compliant awarded items may occur if any of the products provided are not recognized or acknowledged by the manufacturer as new products eligible for warranties and all other ancillary services or options provided by the manufacturer, or the offeror was not authorized by the manufacturer to sell the product in the U.S."" (2) DFARS 246.870-3 prescribes two contract clauses that address contractor sourcing requirements for electronic parts.
