THIS IS NOT A REQUEST FOR QUOTE (RFQ) AND NO SOLICITATION IS AVAILABLE The US Bureau of Reclamation (USBR), Mid-Pacific Region, intends to negotiate a contract on a sole source basis with The Westervelt Company under the authority of FAR 13.501, Only one responsible source using Simplified Acquisition Procedures. The U.S. Army Corps of Engineers (USACE) issued Clean Water Act 404 permit to Reclamation in June 2019. This permit requires the purchase of 3.35 mitigation credits of Floodplain Mosaic Wetland habitat at the Cosumnes Floodplain Mitigation Bank in Sacramento County. The credits are required to offset permanent impacts to waters of the United States that will result from the construction of a new fish passageway on the Nimbus Dam downstream in the Sacramento County. As stated in the permit, the contractor shall be a certified-USACE mitigation bank that serves the Project area. The Cosumnes Floodplain Mitigation Bank was acquired by Westervelt Ecological Services (WES), LLC., a subsidiary of The Westervelt Company, in 2008. Since its ownership 12 years ago, it has sold mitigation banks credits and has provided environmental mitigation and habitat planning services to landowners, businesses, Government agencies such as the Army Corps of Engineers, the Department of the Air Force, and various civilian entities. Based on the above information Westervelt Ecological Services, LLC, is the only one responsible source for the mitigation credits required for this project area. The Army Corps of Engineers CWA permit directs the purchase of mitigation bank credits from an USACE-certified mitigation bank such as the Westervelt Ecological Services. Firms which can provide the mitigation credits above must submit written notice to the Contracting Office and must provide evidence in sufficient detail to demonstrate the respondent�s ability to meet the stated requirement. This is not a request for competitive proposals. A determination by the Government not to compete this proposed action based on responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. Responses shall include the firm�s Dun and Bradstreet number and Tax Identification Number. Firms shall identify their business size (small, other than small, etc.) in accordance with the size standard $16.5M.for NAICS code 813312 (Environment, Conservation and Wildlife Organizations). This notice is the only official pre-solicitation notice of this requirement. Please note that any prospective offeror must be registered in the System for Award Management (SAM) at www.sam.gov in accordance with FAR Subpart 4.11. The following information is pertinent to this notice: 1. Responses shall be submitted by 1200 PST, May 18, 2020 to the point of contact below. 2.
